      April 20, 2023 ***************** of ************************** entered into a contract to remove an old fence and install a new pine treated fence. He was going to stain it 2 weeks later. **** guaranteed his work & said that he could be trusted because he was a ********** licensed, bonded & insured. He & 2 of his fence installers began the work on the 20th & returned the 22nd to complete the job. On completion, I paid him $2600.00. Later that evening, I noticed that some boards were discolored, worn & of poor quality. Also, in looking closer at the fence there was a board that was split at the top and another one was broken at the bottom located on the gate. I called him Sunday, the 23rd and expressed my concern about the broken boards, *************** of the fence. He argued that pine wood was always different colors and said that he was coming by to look at the fence Monday. I asked where did he buy the poor quality boards. He said that he purchased the fence boards from Lowes and they were not the best but they would not allow him to look at boards other than the ones he purchased. I told him as the professional, he should have left them there. He told me that he would replace the boards, but it would cost me more. I refused to pay him anymore money for a newly constructed fence. He told me to carry my complaint to Lowes because they should not have sold the inferior boards to him, the professional. When I visited Lowes on Mon. 24th, ***** said the fault was Popes because he should not have chosen, purchased & installed those bad boards. **** did return Mon. and looked at the fence. He took responsibility for only 2 broken gate boards & would return to fix them. He never returned. One & half months later, the whole fence, posts & timbers are buckling & splitting. On **** & 14, *** emailed him twice, to discuss the problem, ask him to return & he wont return my emails, calls or come by my home. ***** will take by the boards if he returns them. No integrity.

      We tore down existing fence to install new fence and gates. I brought the boards from Lowes I hand picked the best boards they had I delivered the boards to **************** home in my truck, I made 4 trips.  **************** looked at them before installing it took two days to complete the first day we did half of the fence.  She was watching us if she didnt like it she should have stopped us before we finish all the boards I would have stopped immediately  .The next day we came back to  finish installing the rest of the fence.  We completed the job she paid the balance we shook hands she was happy. We packed up loaded ********** from her property and left. Days later she called and wanted me to come back I told her I was on another assignment I couldnt come when she wanted me too.. Sorry I cant afford to replace those boards.

      The boards that ************ used for my new fence are splitting and buckling on more than 100 fence boards of the 225 plus he used. Three fence companies have looked at them and they say they are old weathered boards that were probably in someones shed. They pointed out that it takes new boards years to look like my new fence. He gave me a receipt that he presented as the original receipt and it was an was an estimate quote not signed by Mr: ******** Manager at Lowes. He said he purchased 225 boards from Lowes, but according to his receipt he gave me, he only purchased 160 fence boards. I dont know where he got all the other boards over the 160 he purchased. Right now there are 201 boards that I counted,  not counting the 20 or more they broke or pieced together. I counted the boards and marked all the 100 plus bad boards. I have included pictures to verify that he defrauded me and did not use new boards for the job. Nothing has been done to the boards and in 2 months time, experts other than me have verified that the boards are old. ***** said they would take the boards back if **** would bring them back. He wont come back and say that he is not in error. He said he would come back and replace at least 2 boards that were cracking on July 24th and didnt. His attitude is that he had his money and it was Lowes responsibility to replace all my splitting and buckling boards. ***** said that **** picked the boards and they didnt make him buy the boards. I gave **** $1600 to purchase the materials and ********** is located 1.2 miles away from Lowes; he could have gone there and purchased them. I believe he has defrauded me because he came here with an old rusted can of paint trying to get me to purchase it. I refused and bought my new paint from ******************************* to paint my door. Also, he asked me to pay him in cash because he didnt want to report it to Uncle ***. I should have walked away then, but I had sacrificed and saved up my money and had cash in my hand at the time. I made sure to get receipts and signatures. He is a deceitful and crooked businessman who tries to take advantage of a woman. I am retired and I want a refund of my money because I do not trust a liar to go and purchase new fence boards without switching or getting them from his shed. I am disgusted the way this this ********** licensed, bonded and insured man has done me about my new ********** I want from him is my money back. I have to have the whole fence redone because of his trickery. Pictures of his receipt and my fence are attached. I never shook hands with him and parted when he finished with an understanding that he was going to make things right by replacing my fence boards. He said he needed the rest of he money to pay his workers, so I paid him. Big Mistake. He wont even come by now to look at the fence, address the problem or fix it.  His attitude is that he has his money and the fence boards are my problem and Lowes. Also, he is incompetent because when he started the job, he didnt call **** Call Before You Dig and cut my  ATT U-verse lines when they dug the holes. *** had to come out and fix the problem. . All he said to his men is yall need to be careful next time. His men laughed about it. This whole experience has been a terrible nightmare. ALL I WANT IS MY MONEY BACK!

      I am rejecting this response because: ************ purchased 160 fence boards and used over 200 to build my fence. Three fence companies looked at the fence boards and said they are old boards that were probably stored in a shed or yard somewhere. It took him 5 hours to go to Lowes and purchase my boards. Lowes is located 2.2 miles away from me.  When I went up to Lowes to see what was taking him so long and his men were waiting, he and his wife were not there. When he returned to my house, I asked where had they been, and they said *****. I looked all over the store and the were not there. I dont know where he got the boards. I believe that because they were not at Lowes, he made a trip to a shed to get them. The boards were not new and they are cracking and buckling after only 2 months after he installed them. His receipt and pictures are attached to support the facts. I showed him some boards that needed to be replaced and he said he would do it and turn the brown discolored boards around to make it right. I said that I wanted new boards especially after they started splitting and buckling after only 2 months. New boards dont do that in such a short period of time. Pictures attached.

      **************** and I agreed together to purchase the boards at Lowes I personally picked the boards and delivered to her house she saw us unload the boards and I picked the best boards they had. Some of the boards on the pallets was terrible I asked the loader can he bring better boards off a pallets that was wrapped he told me he couldnt do it he would get fired. I made three trips it took the ********* 2 days to complete.Day 1 they installed half of the fence she looked and said they was ok.  If she had said she didnt like I would have stopped immmediatly she said everything looked fine. We came back the next day to finish we completed the fence she looked and paid the balance she wasnt complaining at all now all of a sudden she want to complain after the job was completed. I am not crooked I did what she paid to do she wanted more she wanted to paint the boards or stain the she couldnt decide what she wanted to do . I did not take advantage of her thats not my character maybe she thought I would do but Im not that kind of businessman. Im sorry it happen this way but I cant afford to buy new boards when we shook hands after the job was done..

      I reject Mr. ***** explanation as to why my supposedly new boards that are not 2 months old are cracking and buckling. If he is a professional, why would he buy and install terrible boards for my new fence. I trusted him to do a professional job. He is lying about the boards coming from Lowes because there are over 200 boards and on his quote from Lowes, he had a total of 160 boards. Even if he purchased the boards from Lowes (some terrible as he says) where did the rest come from? Where is the receipt? He is a crooked businessman that cheats people and cant produce a legitimate receipt other than a quote for something that cant be verified as to whether he purchased it or not. Three fence companies and the manager at ***** said that they have never seen new pine wood to do what my fence is doing. Everyone believes that the wood is old and came out of his shed. He knows the truth and I told him from the beginning that the wood was no good. He said that he was coming back to fix 2 boards the next day but didnt. Two months  later, over 100 boards began to split and buckle. He insisted that ***** was at fault for selling him the terrible boards. He is the professional that picked the boards. I preferred my boards to be purchased from ********** because at the time they had better quality boards. I do not know where these boards came from that he used to build my fence. I have never shook his hand and agreed to anything. A new fence with new boards should last longer than 2 months. He is taking advantage of me because I am a woman and if I was a man, he would have come back over here and took care of the problem. I want my money back. He has lied about making things right from the beginning by saying he guarantees his work. Once he is paid, he refuses to correct what he has done wrong. ************ is a cheater, *****, liar and shady business owner. I want my money back and do not trust him to do anything else for me. I reject everything he said in his reply. He and his wife were not at Lowes when they said they were there purchasing my fence boards because I went to Lowes looking for them and they were not there. I am retired and living on a fixed income. I saved my money to get a new fence and not to give to a ***** who cheats everyone for a living and brags about it. No Integrity and I reject his reply.

      On November 05, 2021, I hired Jack Pope Construction to extend my storage building and roof 6ft, replace old boards, repair roof, repair back side of building, replace the door, and paint the exterior of the storage building for a total of $4,500. In May of 2022, I noticed that the roof has a gap, and a board is sagging inside of the storage building causing water to leak inside. I have contacted ************ regarding this issue multiple times since noticing the needed repairs; as ************ provided a 1 year guarantee on all work. ************ stated on numerous occasions that he would return to assess the repairs, as of July 11, 2022, he has not returned to have the repairs made. I am requesting a refund of $2,500 to have the repairs made to the storage building or have Jack Pope Construction make the necessary repairs.

      My name is ***************** I received a letter dated 7/11/22.. The customer complaint is not true. I did the *********************** that she and i agreed to do per contract.  I told the customer she needed to replace shed she told me she couldnt afford to pay for new shed she saidjust repair existing shed . I replace all rotten wood, i added 6ft attaching to existing shed we framed and add roof bought new door and locks. A month later she call to say it was a leak but the leak came from the existing shed not the added 6ft that we built, i went she and i look it wasnt a leak, i went again after the rain it wasnt a leak. It has been a storm, i told her it was storm damage i wasnt responsible for that.. I responded to her and i came back i didnt see any leaks.

      I am rejecting this response because: The storage building is leaking in the area that was repaired and added on by ************. I have had the storage building assessed by a contractor who also advised that there is in fact water damage in the area that was repaired/added on by ************ and also nails showing on top of the roof that need to be covered. I am attaching picture to show the damage and nails.

      When i finished the repairs on the shed the customer and i walked around and made sure she was satisfied with the work before she paid the final payment. We both agreed she was satisfied. Now 6 months later shes saying she is not satisfied we have had several storms since November, the 1yr warranty does not include storm damage i told her that, i came back when she called we both walked around in the rain there was no damage. I think the existing shed was damaged thats why she added 6ft extension to repair it. I told her added new wood to old may not work i advise her she may have to tear down and rebuild. She stated she didnt have enough money to rebuild just repair it.. i did repair the wood, added roof and doors. All materials and labor was included. the materials took almost all of the money. I cannot afford any refund.
