BHFC Financial Services, an auto finance company in ********, *******, imposes a 29% annual interest rate on subprime customers, regardless of their creditworthiness. They also recommend dealerships sell vehicles at 200% of market value, doubling the consumer cost. Unlike typical repossessions where vehicles are auctioned and sale details are promptly notified, **** resells repossessed vehicles directly to new customers through partner dealerships, bypassing legal requirements for commercial reasonableness and consumer notification. Additionally, **** is accused of installing GPS units in vehicles without customer consent, violating Arizona law. These actions question why banks like ******** continue to extend credit to such companies.I am furious with the situation I faced. The signing forms arrived in the mail without clear fee details, showing a lack of transparency. Over a year after the car was repossessed, I was contacted to collect on a vehicle resold just a week prior. Retrieving my personal belongings was difficult, and I was informed of a fee never disclosed during my phone arrangement. Upon arrival, I was immediately asked for money and my keys before collecting anything. When I expressed ignorance about the fee, the agent walked away, leaving me to reschedule the appointment. This ordeal is unacceptable, and now they are trying to charge me for a vehicle I no longer have, disregarding all communication and utterly infuriating.Business Response

The Consumer signed a Retail Installment Agreement to purchase a vehicle. She failed to make one full payment and the vehicle was repossessed. The Retail Installment Agreement was a standard form contract that clearly showed all the fees and terms. BHFC Financial Services, **** was not responsible for the policies or fees of the **************** that repossessed the vehicle. I am writing to formally reject the response provided by **************************** regarding my complaint. Their reply fails to address the core issues of my dispute and contains misleading claims.
1. Failure to Acknowledge Deceptive Practices
The business states that I signed a Retail Installment Agreement, but it does not address my concerns about the deceptive lending practices that led to the agreement. If the terms were misrepresented or unfairly enforced, the contracts validity is questionable.
2. Unreasonable Deficiency Balance
BHFC Financial Services, **** is attempting to hold me responsible for an unjustified deficiency balance.
3. Failure to Address Repossession Process
The response places all responsibility on me while failing to acknowledge any potential wrongdoing in how the repossession was handled. I request documentation proving compliance with all applicable repossession laws, including proper notice, opportunity to cure, and fair sale of the vehicle.Business Response

The Consumer purchased a vehicle by signing a standard form contract for ******, the Retail Installment Agreement. This form contract clearly represents the all the terms in of the Retail Installment Agreement, including the interest rate, the length of the contract, and the monthly payment. The vehicle was legally repossessed after the Consumer failed to make one payment on the loan. I have auto loan with the bank and I made of payment of 345 and the payment was supposed to be 350 and when I paid it they repossessed my vehicle. So I called and tried to see what was the issue and they explained that I didn't pay them what they wanted. So I ask what did I have to pay to received my car back after I just payed 345 they said they never received the funds which was weird and then they told I would have to pay 1700 to get my car back. They wanted me to pay 1500 for my pay off and 250 for repossession fee. So I also ask them where was my vehicle located so I can get my personal property. They didn't want to tell me and that I would have to pay the full amount to know where my car and for me to get my property. Which I thought was illegal so the next day I called cause to speak with someone else with the recovery department. They also mention for me to retrieve my personal belongings I would have to pay a fee and now it's a key fee of 100 dollars which is weird cause before they made the key I had to pay full amount and now I don't. So days go by I make arrangements to make the payment. One day I go up to there office to make a payment not knowing the my personal property was there the whole time. So once I made the payment they end up bringing out some of my belongings. So now I'm missing important pictures and pool stick also a watch charger. I just believe the broke so many laws and I would like to see if I can get compensated for this time and property I lost 8-6-2024 to 8-16-2024Initial Complaint

Where do I began I financed my car from this make shift finance company in February 2024 its been nothing but non sense with this company they are so money hungry. I missed my car payment $400 something dollars in June due to me being out of town with a locked bank so my plan was to pay it when I got back literally not even 24 hours after I got back home they repoed my car I kid you not they also cut all communication with me because I told them to email me and not call me certain times due to me working who does that? So I ask them how much to get my car back they say $1630 okay I tell them Ill pay that the 17th next day I go get my important belongings out of the vehicle couple hours later they call me to tell me the bank ended my loan and I cant get my car back unless I pay it off. They have yet to tell me what other payments I missed for them to take my car and they have to tell me why the bank stopped my loan. Also in my contract it states nothing about repo policies with them nor does it state missed payment consequences. Just run from this company. Oh not to forget the loan or even the car payments NEVER showed up on my credit I bet the debt of me owing them 14k will tho because they are a shady company and takes peoples cars.Business Response

The Consumer's Retail Installment Agreement clearly states that her monthly payment was $461.73. The Consumer's payments were to begin on March 29th, 2024. The Consumer made her first payment late on March 31st, 2024 and for only $400.00. Over the next four months the Consumer continued to make late or insufficient payments leading to her being over 41 days in arrears on the day the vehicle was repossessed.
The Retail Installment Agreement also states that if the Consumer fails to follow through on her obligation to make timely payments for the appropriate amount that BHFC Financial Services, **** could take immediate possession of the vehicle. Due to her default BHFC Financial Services, **** legally repossessed the Consumer's vehicle.
BHFC Financial Services, **** has provided the Consumer with a copy of her payment history.

I VOLUNTARILY RETURNED THE **** DUE TO LACK OF PROPER SERVICING BY THE DEALER. AS THE *** I BOUGHT BROKE DOWN 3 DAYS LATER AND WHEN I CONTACTED THE DEALERSHIP THEY TOLD ME IT WAS NOTHING THEY CAN DO AS IF THEY DIDNT SELL ME LEMON. THEY REPORTED IT TO MY CREDIT WITHOUT MY PERMISSION. According to FCRA section 605B, it is illegal to report information on my credit report without my permission. I had the truck repoed back in march of 2016 I left a bad review but it wasn't enough ive seen other reviews that I wasnt the only screwed over but I has personal belongings that I never recovered thanks to them I do plan on possibly suing them no one should have to deal with thieves like this unacceptableBusiness Response

The **************************** paid off the entire loan as the vehicle was deemed a total loss from an accident. The **************************** requested a 10 day payoff on July 25th, 2022 and BHFC Financial Services, Inc. provided them with the amount required to pay off the Consumer's loan at that time. BHFC does have a signed contract with the Consumer and the signature matches the Driver's License provided with the application. I believe my consumer right were violated by this company 12 U.S.C. 5531(d) states that the Consumer Financial Protection Act (CFPA) defines abusive acts or practices as conduct that: (1) materially interferes with the ability of a consumer to understand a term or condition of a consumer financial product or service; or (2) takes unreasonable advantage of (A) a lack of understanding on the part of the consumer of the material risks, costs, or conditions of the product or service; (B) the inability of the consumer to protect the interests of the consumer. I am constantly lied to and threatened by this company.
