I paid $6000 to Fair Exchange Auto Sales for a used 2014 Kia *** and it had a 14 day implied warranty. The second day I had the vehicle it stalled on the highway, then did it once again before I could pull off. I got the car back from the dealer and the same thing happened - again, on the highway which is very unsafe. Now the dealer is saying the lemon law does not apply to him and he isnt required to fix the car or provide a refund. He is claiming that I ruined the car by driving it when overheated. What is a person to do when a car overheats? During our last heated argument he threw slurs at me. I got off the highway as soon as I could. He will not answer calls now.

On 4/18/2024, I walked into Fair Exchange Auto Sales. I was greeted by ****, a salesman. I advised him I was looking to purchase my first vehicle. We went out to the lot to look at the first vehicle and as I turned it on a lot of light came on. **** advised that the problem could be fixed. I continued looking at cars and found the 2017 ****** Rogue that I purchased. I went ahead and test drove it. At the time I didn't hear anything wrong with the engine. This being my first vehicle purchased I went ahead and signed the contract. I didn't know that an issue could arise down the line. I have been paying my vehicle on time for 4 mths now. I did have an issue that the dealership fixed. At this time my check engine light has been on for the last month now. The keyfob stopped working. I went ahead and changed the battery to see if that was the problem. But the keyfob has not worked and I had to park the vehicle as I was not able to lock and unlock the car. This is where I realized the keyfob did NOT belong to the vehicle. At this point I contacted **** and advised of the problem with the keyfob but he told me I would have to reach out to ****, the owner for any issues. He also mentioned that the vehicle was purchased with only one keyfob from auction. I explained to **** that the keyfob key did NOT unlock the vehicle. I then reached out to **** to explained the issue. He told me that this is how the vehicle was purchased from the auction and I would be responsible to contact a locksmith for a new key. I thought in good faith he would do the right thing & provide the correct key. I have been having to ask for rides & pay for Lyft to get to work & school. I feel this is not the experience I expected from a dealership. I have reached out to a ****** dealer to see how much it would cost for a new keyfob with key & programming. It cost $500 that I don't have. I don't feel this is fair to me to have to pay out of pocket for this when I've been making my payments on time.
