On February 23, 2022, we contracted with ************************* of Alpha Omega Development to build a casita in our backyard based upon a bid from him of $150,800, which he stated sufficed as a contract. He was an aquaintance of one of our sons, so we trusted him. He represented that he was qualified to build a casita and had done so before. He required 50% down to begin, and we wrote him a check for $78,500 (which we have since learned was exorbitant). Plans needed to be submitted and approved by the City of *******. He submitted plans with incorrect setbacks, which he should have known. We were heavily involved with the City for approval (even though he stated we wouldn't have to be at the time he collected our check), and we did all the legwork for the Special Use Permit ourselves. There were numerous delays with the plans due to his negligence. He had trusses delivered to our backyard, laid on the ground, in June 2022 and wasn't even here for delivery. My husband had to purchase tarps to cover them himself. We received approval on October 31, 2022. During the entire 9 months, we requested a valid contract from him and proof of his insurance; he never provided either. In the end, we had to cancel because he stated he could not build the casita for the price of his initial bid, in addition to his failure to provide the crucial documents. He refunded $48,800 and is keeping $29,700. This includes $10,000 for trusses, $10,000 for his time, and $9,700 for windows and plans. He has never sent the original invoices even though we requested them numerous times. We have learned the trusses alone cost $6,378 to build and were told they should not sit at all unprotected. They have been rained on continuously and constitute material defects. He has overcharged us for building materials and for his time and we request a refund for the remainder of our money. We have explained our experience to other contractors and were advised they would never operate in this manner.
