A sales person named ***** ******** ************, also another company is involved Everbright account # ********** phone# ************. ***** came to our door to solicit solar panels in the neighborhood. We signed up to get the solar panels to lease them not buy. The payment became too expensive and really didnt make a difference in our power bill. We contacted the company to cancel the contract and told them to pick up the solar, on 09/23/2024 we did a 3 way call and requested a cancellation in which they issued a ticket number for #******* and also requested for them to remove the lien on our home so we could refinance. The *** said it would take up to 14 days. they removed the lien only to put it back on the record and did not cancel the solar contract as stated and was now sent to collections. This company also changed during the tenure of the contract and we were not notified of any new company or service area that would be handling this account. We simply wanted to cancel the contract and someone was supposed to come remove the panels and that never happened. This company is predatory and all of the reviews of this company says the exact same thing. they are preying on the elderly to get contracts and then telling us we cant get out of it and then sending us to collections for the entire amount of the solar panels. please investigate this and get to the bottom of this. I also paid ****** via credit card on 09/23/2024 for the contract cancellation fee. Also the lien company is lien solutions po box ***** ********, ca no number listed.Business Response

Hello,
Empower Solar has no liens on this account. It is possible the company that holds the lease (**********) has done so but we cannot attest to that. ***** ******** is a sales representative with Solar *************** who than chose Empower Solar to do the installation of the panels. A review of the account details on our end show no record of cancellation was requested from us and all our calls are recorded. We spoke directly to Mr. ******** multiple times throughout the process and these concerns were never brought to our attention. As this is a PPA, the system is owned by ********** so I do recommend that the homeowner reaches out to them directly.

I got the solar panels installed in early December 2024 and began operating in late December. The sales **** ******* ******, informed me once the install the solar panels are installed and operating, I should not receive an Eversource bill, and if I do receive a bill, it should be a small bill around 20 bucks. Since installing the panels I have been receiving an Eversource bill and the solar panels bill at $200 each bill. Last year in December and January I had an Eversource bill of the same amount. Now I have to pay $400 a month for electricity in the winter months, which I was actually paying that amount in the summer with my HVAC and pool. I have reached out to Empower and they claim they dont deal with any billing issues and referred me back to the sales representative *******. He does not want to deal with me anymore and stated to call Empower from now on. Now I am stuck paying double by having the solar panels installed with no one to contact for help. I was misrepresented and would like the solar panels removed at no cost to me.Business Response

I purchase solar panels for my residents through this company in 2023. The month of July 2024 the system started to malfunction. I have contacted the company multiple time via email and phone to get repairs under the 30 year warranty that came with the system without success. I just want my system repaired but I keep getting to they are working with their service crew to schedule the repair for the past 6 months without any resolution.Business Response

Empower solar is very misleading when it comes to the government solar tax insensitive or tax credits they lead the customers to believe they are getting a 30 percent back on their tax return in my case I was told I would get $****** dollars back that I was supposed to use to pay one of 2 loans that was used to pay for the solar panels installation there are 2 loans one is for I believe 20 years that I have to pay monthly the other is for 18 months interest free the last one is supposed to be paid with the government tax insensitive or. Credit the problem is that I didnt get ****** dollars back I got $11,000 instead right now Im in a big problem I have to come up with $13,000 dollars before the 18 month ***** period ends or Ill have to pay over $4,000 of interest if the loan is not paid before their 18 months due date, not only are they misleading on the government credit but I was offered a 17 kWh the most I have seen the system produce is 12 kWh in the summer time in the winter Im paying more for electricity than I used to pay before if I add up the $225 monthly loan payment and the PSE&G electric bill. I dont know how the government allows this companies to operate in the way they do.Business Response

Absolutely no transparency. Signed on to have solar panels with ********** provider agreement). Under the assumption the lease payment would be the bulk of my electric bill. After a year of true up bills from ****** I called Empower and asked why my electric bill was essentially the same as before panels installed. After much back and forth I discovered batteries were recommended for consumers with NEM3. Why wasn't I offered batteries is baffling. I now have a lease payment and a true up bill each month. If there's a benefit it's impossible to see it. Empower could have told me many months ago what to expect. There is no good faith on there behalf. Empower will not return my calls anymore. We have responded to Mr. ******* numerous times. His system was sold right during the time of the NEM2 sunset. At that time in the solar industry, it was still a learning process for all contractors on how NEM3 was going to work. He was not sold a battery as at that time, it was not known how much or if they would be needed. We can completely sell him a battery to add on to his system if he would like one and we having even been willing to lower the cost due to the situation. Currently he is using more electricity than his system can supply, which from what we are seeing is increased from last year. Expanding his system is an option as well. He does have a PPA so there is a production guarantee in place but that all would be handled with his finance company directly.Customer Answer

All businesses dealing with solar had a year to learn what effect nem3 would have. To claim nem3 in it's infancy was the reason no batteries were offered is absurd. Empower had ample time to inform me of the effects. Making a sale in those lean times for the industry seems to be the goal. Free batteries for both homes is warranted. Enphase the equipment supplier should take notice on how they could've sold more product.Business Response

While I do understand the reasoning and continued frustration, there were numerous systems sold at that time with no battery due to the changes and the **** not being forthcoming regarding details. The Time of Use batteries were not even a manufactured option when the *** change was first announced. I understand that adding a battery could be beneficial for your system. I am rejecting this response because: Empower says batteries weren't offered because of NEM3 being in it's infancy which sounds like incompetence or ignorance maybe both. Then you blame **** for not being forthcoming regarding details. That's another lie. CPUC voted 5-0 to implement NEM3 many many months before NEM3 went into effect stating: NEM3.0 also encourages pairing rooftop solar with energy storage to maximize export value during peak hours. I can't imagine Empower solar not understanding repercussions of panels without batteries after NEM3 went into effect. On this date 8/2/2024 I made a electronic check direct deposit of $3000 to the Empower Solar, Inc. in order to have the solar panel be removed/reinstall because of the damage of my roof has water stain so I have to replace the whole roof. The Empower Solar, *** will void the warranty if anyone else touches the solar panel, so I agree and made the payment so my warranty with them will not be voided. I found out other information that was disturbing. I was misled and uninform by their sale representative "Coby" from the *******************. Who I am not able to get in contact with. I spoke to *****-supervisor at Empower Solar Energy claiming that what I am requesting is not exit. I am asking for the itemized cost of the solar panel, if there are cost for the installations among other things. ***** claimed what I am asking doesn't exit. And they cannot produce anything that does not exist. Originally, I has agreed to sign the contract because I was told by Coby that the installation of the solar and everything will be free of charge. The only thing that i will be paying is the Solar Panel because of the California solar incentive for home owner. I also told Coby that when my roof will need to be replace in the next couple years and he told me that they will be able to removed it and installed back in with not charge, additionally he also said that if I have to move the solar can be move with me to the new home with free installation as well. Now, when I found out today, in order for me to have my roof fixed and not void my warranty, Empower Solar, Inc. has to be the one to remove it and install it with a cost, So I paid it, which is $3000 to have it remove and to installed back. So, I asked if they could install the guard around the panel to prevent pigeons from going under the solar, that would be another $1100 to do that, so I said fine there is no need for that. I do not except the response made by the business to resolve this complaint. Because no one from Empower Solar, Inc. reach out to resolve this issue. They just prolonging the process and make me wait until now, nothing has been resolved. So pretty much Im tired of waiting
I want to voice my side of the story. Empower Solar ****shut me down with everything I requested. Until Now all the issue I have complaint has not been resolve. I have to bite my tongue and swallow everything and except everything and agreed to have them reinstall the solar back on my roof. No one from Empower Solar **** have call me back from their upper management to work it out or do anything to resolve or meet the middle ground with me. I really hope that BBB raise awareness to other consumers of this company, so they will not fall for their fault advertainment. For me I am stuck with them at this point,they tied my hands with their services.

The homeowner did allow us onsite to re-install her solar. We did offer that at a discounted price for her as well from the beginning. She was upset and demanding free critter guard as she says she was unhappy with her sales *** but we are unable to just give that for free and we did direct her to the dealer group for that sales partner.
Her contact is over 2 years old so we are unable to cancel. Empower does not hold the financing for this system

Contract signed 5/31/2023 and we still do not have PTO and they refuse to update despite countless emails and calls. There has been one issue after another. When they did the install they flew the fuse in the attic which resulted in an electrician expense. Then we had to have them replace the breaker and they wired it incorrectly and we lost power to half the home and had to demand a worker to come back out and fix their mistake. We failed two fire department inspections that they had to fix due to incorrect installation and one city inspection. February 8th of 2024 we were advised we would have PTO in 4-6 weeks since we finally passed the inspections. and here we are with no end in sight and no replies and it is now August 20th 2024. Six months from when we passed inspection. This is a literal nightmare.Business Response

We completely understand the homeowners concerns and frustrations and we spoke with them yesterday and have multiple times before. We did have to get forms resigned but all of the delays are due to utility issues with processing these new non export applications. We have 100s of customers dealing with the same utility enforced limbo and are working closely with CALSSA as well as enphase energy. All our provided timelines come directly from the utility. These are not set by Empower and sadly we have no control of them not being met. We will continue to work diligently to get this project approved.

We had a ground mount solar system installed as an aggregated system. It was to include 5 meters. We are with SCE as the power company. The system was up and running on Sept 4th 2023. We received our first bill on Oct 4th 2023. They did not set it up as aggregated. Only 1 meter. I notified Empower in ****** on 10/16/23. Spoke with ******* on October 17 & 20th& 24th & also on 10/25/23 & many other times in October. I continued to talk w them through Nov, Dec, Jan, and every month since. I have been assured that paperwork was submitted to Southern Ca ****** and they were waiting. On 2/19/24 I was copied from a submission to ****** (*** Aggregation). ****** was asking for correction on information submitted with a 10 day window to correct it. However they did nothing. The problem was they submitted a new application instead of a program change request. More phone calls followed. I have spoken to SCE *** people. The *** people only let you leave a voice mail and they say it will be returned in 1-3 days. They are forthcoming with information but they cant do the submission. It must be submitted by the solar company. Since the February submission that was cancelled because Empower did not correct it within the 10 day window there have been no submissions. I last spoke to ********************* at Empower on 5/29/24. I am always assured that its in the works. I am currently wailing for a call from SCE *** who I also called on 5/29/24 At this point I think that Empower is just giving me lip service. 10 months have passed since I received my first SCE bill and saw that I was only having 1 meter credited. Ive paid over $5,000 dollars so far on power bills. How do I get them to do their jobs?Business Response

I am rejecting this response because:
Since I filed the complaint I received a call back from SCE NEM (the Southern California **************** that deals specifically with the application for all Net Metering on their utilities. I was informed on the call that I received Friday May 31 2:20 pm that nothing had been submitted to them in regards changing our SCE agreement to an aggregated system. There has been no updated paperwork submitted or contact between Empower and SCE since February.
There was a submission by Empower to SCE in February that was submitted as a new permission to operate. This was returned by SCE NEM to Empower for correction. They had 10 days and did NOT submit corrections. Therefore it was withdraw by SCE. Nothing submitted since that February submission means that they haven't followed up on it.Business Response

I am rejecting this response because: Ive been told this would be corrected for the last 10 months. I last spoke with Southern California ****** NEM Metering on 5/31/24. No action had yet been taken by Empower to submit a correction. It requires an EMAIL from them for a CORRECTED application on the ORIGINAL application. It is NOT to be a new application like they did in March which was rejected. I have asked many times to speak to someone who has direct control over this process. ALL Ive been told that it is with unnamed UPPER MANAGEMENT. Until I receive something in writing or by phone call by the people who actually do this CORRECTED APPLICATION I do not believe that anything is being done. *** had no contact from anyone in the department who actually is doing the work in the 10 months this has been brought to their attention. Everything was submitted via email to SCE in April. We submitted supporting documents on 6/6, 6/12 and sent a follow up email on 7/2 to see if we could get an update but have had no response. We will be reaching out to them via phone today. It is hard to provide an exact ETA but based on current SCE timelines we should have final approval in around ***** days. We will continue to push for sooner. We have been speaking with the customer and keeping her updated on all of this as well.

I contracted Empower Solar to install a solar battery (enphase 10), install 4.06 kw of panels, and fees to retrofit existing panels into the battery.I have paid them $26,532.16 for installation, with $6,358.04 due on PTO.I chose Empower because they told me they had an inhouse electrician, and had a good BBB rating.During install, the electrician was not in house, and the installation was performed incorrectly with the ** sensors flipped.I found out about this due to 45+kw hours of reported use when not home, with the battery erroring and fully discharging. I reported this to Empower July 20th ***************************************************************** about the issue. I have offered to video share the issue (which I identified with the help of a separate solar installer), and even pay to have it fixed. Empowers Solars reply was "there is nothing wrong, you cannot fix the issue, and there being installation issues does not get you out of paying the final payment".I have plenty of records of communication which I will gladly submit.Empower Solar has since shut down my battery, put a mechanics lien on my house, and still refuses to even inspect the system despite panel underperforming and battery issues.This issue persist to this day.When contacting the company directly via email and phone I can no response. My sales contact, and project manager both are unresponsive. The collections department only demands payment before any sort of potential resolution.Going on social media I've seen others with similar situations of incomplete installations with no help.I trusted the BBB rating when chosing this company, and would like it updated to protect others.Business Response

We were able to speak with Enphase and confirm there is a CT issue. The homeowner has removed our access to the system with Enphase so we will need access given back so we can come on site and take care of the issues. Email from Enphase attached. I am rejecting this response because:
Empower claims that they need system access to investigate the issue, however this access was removed May 14th 2024 due to Empower changing my home battery settings. I'm still considering legal action. Up to this point they still deny any potential issue (see emails below) and threaten to disable my system. I am more than happy to video share the issue or work with them in any other way.Here are some email quotes directly from empower:

Then can you explain the issue I presented? It started in July when the battery was installed and my power use increased by over 40 KWH a day including the battery discharging and powering randomly. This issue persists to this day.
These screenshots are from when no one is home and only phantom power is drawn. You can see the power use increased since the installation of your system by over 40 KWH a day. These are concerning numbers and have been going on since July 2023.
Please let me know what your technical resource thinks. I have record of contacting your company about this issue when it was reported and over the months following.

I believe you are not understanding that your system did pass inspection and there is nothing wrong with it or it wouldve never passed inspection. Please note that I have had our Monitoring Supervisor turn your battery to no export. However, when you do meet your contractual obligations and pay Empower what you owe I will be more than happy to have it turned back to Grid Profile: CA Rule21.
Please also note that if your system is tampered with by other installers it can void your warranty.

Again, we are more than willing to come out and take care of any an all system issues but per Enphase we do not have site access. The homeowner has not paid the final payment on his system as per the contract is due upon written permission to operate from utility. We honor our warranty in our contract and will come out to take care of everything that is needed. At this time though, Enphase will not allow us to see the ** system therefor we cannot access the envoy on site to remedy the issue. I do greatly apologize the emails received before were stating/arguing an issue there was no issue but at this time we have confirmed with Enphase what the issue is and are ready and willing to correct this asap.

I appreciate you finally after 11 months admit there is an issue, and only when brought to a public forum where it can damage your reputation.Also this is after your company has changed my system settings maliciously.
This is after your company has denied my ability to use or update my system.
This is after your company tried to financially bully me including try to lien my house.
As I said before, I will not allow your company access again to my enphase as your company has a history of trying to disable the system (all of this is tracked via email).
I offered to share any data you wish to see, I can email you screenshots or do a video walkthrough. I would be down to talk to a technical member of your team. Please send me an email with next steps.
Let me know if you want any documented proof of the previous behavior mentioned above. Since it's stored on Gmail servers it will be verifiable with a subpoena.
