My contract with this company was initiated by Turbo tax when I ordered the their plan. The *** sent me a notice which I know is in error. The taxaudit rep told me that I was covered. They sent me an e-mail with a link. About an hour later my advisor told me to complete the form and send her the notice from the *** so that she can get started. The website required a password, which I never got from them, and an account number, which I also didn't get. Several attempts to contact them have yielded no return call. One rep from Turbo tax told me that I wouldn't be covered for 2019 unless I bought the service now and paid again. This was in contradiction to what I was told yesterday by another TT rep. I don't have a lot of confidence in this company to handle this matter. Their website and management is very poorly organized. It's been 3 days since I contacted them and I still haven't completed the application or downloaded the necessary documents.

We are sorry to hear you were having difficulty navigating our site. Our records show that you first contacted us on March 25, 2024. We note that you have spoken with several individuals from our company on March 26, 28, and April 2, 2024. A review of your file indicates that as a benefit of the product you purchased from a third-party software provider to prepare your taxes, a membership to our services was provided for the years you purchased. While our service provides audit defense for a covered tax year, your software provider did not automatically provide any of your tax files to us. Thus, we had to request you authorize your software provider to supply us with a copy of your return. A review of your records indicates you have been able to access our website and provide that authorization. As a result, we have a copy of your tax return. However, you have not sent us a copy of the several IRS notices you indicated you have received and responded to over the last few months. We require the notice so that we can compare the notice to your tax return, and then discuss it with you to determine whether the items can be defended or if the notice is correct.

It is our understanding, based on your conversation with our representative, that you have been working with a lawyer to resolve this matter. On March 29, 2024, you left a voicemail for that representative stating that your deadline to respond to the latest IRS notice ends in early April. Due to the deadline, you have decided to protect your rights by filing with the Tax Court. While our services are available to you as a benefit of the product you purchased, you are not obligated to work with us. In fact, it would appear you chose to work with someone else to resolve the matter, and thus, we had not previously started working on your case. Our records further show that you spoke with our representative on April 2, 2024. It is our mutual understanding that no further action is required by TaxAudit and we have closed this case as you have decided to pursue your matter directly with the Tax Court due to there not being sufficient time for us to review the matter.

I don't know why this company is contacting me. I got upsold something from taxaudit.com via TurboTax. I did not want the product and have rejected the license agreement and said No when asked by TurboTax if they could share my information. Yet here they are contacting me. I already have a BBB complaint against TurboTax for this practice and a dispute filed with my credit card. Yet even with all this, I still get generic messages asking me to use the product and refusing a refund even though I flatly denied the license agreement and don't want it. I want a refund plain and simple. And I want to never hear from either of these companies again once this situation is resolved.

We are sorry to hear that you are not happy with the selection of the optional MAX ****** product you purchased directly from TurboTax. Previously, we responded to the emails you sent to our customer service department regarding the issue. As you were informed, you selected a bundled product in TurboTax; that option includes a 1-Year Audit Defense Membership and Tax Identity Restoration. TurboTax chose to offer these items together in a bundle called the ************************ ****** or TurboTax MAX ******. The bundles are nonrefundable. To request more information regarding the ************************ ****** or TurboTax MAX ******, you will need to contact TurboTax for assistance. We apologize for the inconvenience. For more detailed information, log into TurboTax at www.turbotax.com.

As I have communicated with the company multiple times now, I did not intend to purchase this product and do not want it.  This was done as part of multiple attempts at predatory upsells on TurboTax that I must have missed one before **************.  This process and this policy are counter to any valid and ethical business practice.  I want a refund.  I want my data removed from your systems.  And after this is resolved I want to never hear from the company again.

      Business response

      02/23/2024

Please note, as we have stated before, you purchased a ****** not from us as a company directly but through a 3rd party vendor. While the ****** you purchased does give you the benefit of audit defense, it also includes a variety of other benefits, and any refund requests need to be directed to the 3rd party, as you did not purchase audit defense directly from us.

As for the information we have in our system on you, it is only your name and contact information and that you purchased the MAX ****** product. We were only provided this contact information in order to provide you with information detailing how the benefits could be accessed in the case of an audit. We do not have any additional information related to your actual tax filing; we only know that you purchased the tax software, and it included the MAX ******. However, if you wish, we can remove even that information from our system and cancel the benefits you were provided with the purchase.Additionally, we will not contact you any further, as you requested.

I wish I had not gotten tax audit protection. I wasted valuable time and had fines and interest from the **** I waited for an appointment and then all they told me to do was refile my tax. I did so, and received a message that I would get 27K back on next years tax. I assumed that the *** would send me a revised tax bill. They kept telling me not to speak to the ***, which I should have done. They said it would void my protection. I finally called them and had to get more time to pay my tax bill. I hired a CPA who revised my tax return correctly. Turbo tax is fine for a simple tax return, but this protection is absolutely worthless.

      Business response

      11/29/2023

We are sorry that our service did not meet your expectations. We appreciate you taking the time to share your concerns regarding your case with us and discussing these concerns with the representative who phoned you today.

As we discussed with you, TaxAudit provides audit protection services. TaxAudit does not engage in any tax preparation on original or amended tax returns. As such, our representatives are required to recommend that you file an amended tax return when necessary. An amended tax return can be processed using the online software or by seeking the assistance of a Tax Professional.

Our representative discussed with you that our records indicate that in early June 2023, the *** sent you a CP14 notice; it is not related to an audit but rather the remaining tax balance due according to the tax return you filed. The tax professional assigned to your case discussed the return with you, and you indicated you made an error when preparing your original tax return and that you did not make any payments to the *** for the tax liability as the tax return indicated was due. The tax professional, thus, properly informed you that you could set up a payment plan and then file the required amended tax return. Setting up the payment plan would avoid any further collection procedures while the *** corrected your tax records based on your amended tax return.

In mid-November, you contacted us again and provided additional notices from the *** indicating you still owed taxes for the same tax year. When the representative assigned to your case discussed the new notice with you, he was informed by you at that time that you amended your tax return, and it indicated you would get back $27K next year. However, you were unable to provide any such document for our review.

In your posted statement and the phone call today, you indicated that you had chosen to have a *** prepare an amended tax return for you. Since the *** has filed your amended tax return, the *** should correct your account accordingly and issue you a revised bill. You further indicated that the *** has helped you to set up a payment plan based on the amended return. As this was not an audit, your amended tax return has been filed, and you have a payment plan in place; there is no further action needed at this time by TaxAudit.

You were also informed today that if you are audited in the future, please reach out to us, as your membership with us has not been voided;we would be more than happy to assist you.

I have been Audited for 2018, 2019, & 2020 for my state. For the 2018 & 2019 Audit I was assigned a worker to handle everything. From the beginning of the Audit, I was not impressed with the timeliness of the correspondence. Once things progressed and they submitted everything, I received a response from the state that they were not accepting all of the things I had submitted and that I owed far more money than I had thought. I reached back out to the Auditor and to make a long story short, she did not respond, we missed the deadline and I was out all of that money. Even the supervisor apologized for the lack of follow up, but I was still screwed. I am sure they did not send all that they were supposed to like this... Then I get audited again and once again I reach out. The Taxaudit person contacted me and I sent the power of attorney to them. She spoke to me three hours after I was supposed to have the court date with the state to let me know she had done nothing yet and I had to inform her of the date even though on the letter...so my date was missed...looks great on me...and was highlighted in the future letter from the state. I submitted all that was asked of me and then they submitted to the state. I then get a letter back from the state that they were not accepting a LARGE amount of our deductions. I decided to investigate only to find out that over 40 pages of receipts/paperwork I sent to them, was NOT sent to the state. I was also told 5-6 times that they do not handle any appeals at this point.....even though everything Turbotax says they do. This is NEGLIGENCE and incompetence once again. I spoke with the supervisor and even she was appalled at the mishandling of this. I am currently waiting to hear back but have also contacted an attorney as they have not come close to doing what they are supposed to do. How does an accountant overlook or mishandle that much paperwork. This is absolute negligence and for it to happen twice, shows quite a bit.

We are sorry to hear that our service has not met your expectations.

Regarding the 2020 case file, our company is currently working with you and the state, and if an appeal is necessary, we are ready to assist you.

As to the 2018 & 2019 combined audit, prior to submitting your documents, we prepared the best- and worst-case scenarios for the tax assessment (not including penalties and interest) based on the documents you provided. The 2018 tax assessment, while more than our best-case estimate, was less than the worst-case. In the 2019 tax year, the assessment was less than our best-case estimate. The combined tax assessment (not including penalties and interest) was slightly higher than we estimated for 2019 alone. Our records indicate that we shared those best and worst-case analyses with you before responding to the state. Our records indicate that you conceded to the assessment, having sent payment to the state before the appeals deadline. After reading our closing instructions provided by your representative, you changed your mind a few days later and just days before the deadline to file the appeal. There is no doubt it is stressful being audited back-to-back. However, for the 2018 and 2019 audits, our review indicates that we did provide the services requested, and there was no negligence in handling your audit. As noted, we continue to represent you on the 2020 audit as the state has not made any final determinations. Please get in touch with your representative and immediately provide us with a copy of the next notice. Remember, your state will not send us a copy even though you have authorized us to represent you.

      02/14/2023

I am rejecting this response because: Although the response is partially accurate.. it is not the full story and let me paint the picture of what happened, so that when I use the term negligence, It is an accurate assessment.. meaning. 1. Yes...they are continuing to work on the 2020 audit that they clearly neglected and I had to follow up with and investigate to find their errors and the documents they received but did not send. Was told by their "Tax Professional" that anything moving forward as an appeal, they would not handle, although that was corrected by resource manager. 2. For the 2018, 2019, under the advice of their "tax professional" I did pay the fines to close out the audit. After this was done, I was then told that I would also have to pay the **** which should have been shared before by the "tax professional."  I should have looked everything over and not just trusted their "tax professionals". I just assumed and trusted that Intuit/Turbo Tax who specializes in ********************, would handle this as you would expect an accountant and financial institution to do. That is definitely not the case for any of the three years of audits.    Regardless of the time frame in which I got back to them in for appeal with the 2018/2019, I responded and sent documents to them on 5/10/22, I did not hear ANYTHING from them until 9/2/22 and that was from the resource manager trying to close out the case.  I had reached out several times after 5/10/22 on 5/17/22 & 6/2/22 as well and ZERO RESPONSE OR ACTION for almost 4 months, so obviously any sort of deadline had long since passed. As I have looked more into the 2018, 2019 filings, there were documents left out of 2018 that I clearly sent. I am still looking into 2019 and comparing.  For 2018 & 2019 I did send many documents in before any "final Deadline" and received no response or action, costing me thousands of dollars. I appreciate that the resource manager was honest enough to own the many mistakes, even via email, and has been kind and forthcoming.  Also the person who responds to the BBB and other organizations that handle reviews and situations has been very nice and kind. I truly do appreciate that they are looking into all of this but the reality is that I have been audited and it has been handled by two different "tax professionals."  Both of them have been 100% negligent in handling my audit and I imagine that I am not the only person out there. It has cost me money and more importantly lots of my time to follow up with this and help them do their job.

      Business response

We are sorry to hear that you continue to be dissatisfied after speaking with our representatives regarding your 2020 ongoing audit and your closed audits for 2018 and 2019. Our records indicate we are waiting on the state report to determine the next course of action for 2020. Regarding the 2018 and 2019 audits; on May 4, 2022, our records show that you and your representative discussed the preliminary assessment notice. At that point, you were going to wait to hear from your representative regarding the possibility of appealing. However, on May 8, 2022, you sent a message to your representative indicating you had submitted the full payment to the state just to get it over. This was not on the instruction of your representative. Thus, we would like to respectfully refer you to the Preliminary Assessment Appeal Rights included with the notice which indicated the following statement: If you do not wish to appeal this preliminary assessment, your payment should be attached and forwarded by mail to the address shown on the assessment. Once you chose to submit the full payment to the state, your payment would be viewed as your concession to any appeals rights.

      Customer response

      02/20/2023

I am rejecting this response because:Things are not completed and they continue to not take ownership.  You said "Once you chose to submit the full payment to the state, your payment would be viewed as your concession to any appeals rights. " Again, In speaking with the "Tax Professional" her advice was to consider this.  Yes I did submit full payment under the advice of the "tax professional" because she did not convey everything to me.  If it is true that it was "concession to any appeals rights," Then why was I asked to submit other documents after this fact and told that they would do the appeal? Where is the communication that their would be no appeal?  Also, if that was the case, then why was their ZERO communication about this lie/change?  Does this also change the fact that I was not asked for certain documents that would have made a difference from the beginning? I thought tax professionals would see those things and ask for them if they were diligent.  I get that you want to justify this as that is what big companies try to do, but the facts are the facts and you all did not handle this professionally or with integrity. In these responses, I don't see any ownership but reasons and rationale.  There is a humility that comes in ownership but I am not seeing that.

I purchased audit defense when filing my 2020 taxes on February 27, 2021. I received notice from the *** that I was being audited in October 2021. I was connected with an agent to represent my case. Through the course of the year I provided all the documents that she requested on more than one occasion, through two different software systems. On October 6, 2022 she informed me that she would provide the official response back to the *** to clear the account no later than the end of the following day. I never received this from the agent. I attempted to follow up by booking appointments with her for the following dates, where she did not show up for the appointment, or send me a message. Oct 21, Oct 27, Oct 28. On Oct 31 I called and was told by a representative she would call me back, she didn't: ID#********** I attempted to book additional meetings with her for the following dates where she again did not show up or send a message: Nov 9 A 10am, Nov 9 @2pm, Nov 17.I then called on the following dates, and was told that it was being escalated and that I would be contacted back - I have not been. Since purchasing this service to provide audit defense they've done nothing but increase my tax debt and provided zero of there promises with terrible excuses. They claim the documentation that they asked for I provided wasn't actually good enough, even though they were the ones asking for it. The refused to present in court, even though they're service offers it. They refused to do anything but occasionally reply to my emails in a round about way that did nothing but increase my tax debt and then closed my case without warning or help. I am worse off with there service then had I never purchased their "protection". Its a complete scam and they will do nothing to help should you be faced with an audit. Any consuming purchasing from them is throwing their money away.

      Business response

      11/03/2022

We are sorry to hear that our service did not meet your expectations. We pride ourselves on our service and availability to our members. Taxing agencies can and do request various levels of verification for income and deductions reported on a filed tax return. These requests for documentation are part of the agencys responsibility to ensure tax compliance. Each taxpayer is responsible for retaining and submitting (if requested) the proper verification to support items reported on their tax return. We work with our members to respond to the appropriate taxing agency with documentation per the agencys requirements. Our representatives explain every issue and what each taxing agency requires as substantiation. Without the proper documentation from the taxpayers records to support the deductions claimed, the agencies will adjust and disallow the items previously allowed.

As part of our services, we utilize phone contact and messaging via our secure portal to facilitate communication with our members and maintain the contact history (including notification of case closures). A review of your case indicates that the taxing agency did review the limited documentation you could provide and did not accept them as proof of the deductions claimed. As such, they increased your tax debt accordingly. A tax court filing is considered to lack merit when a taxpayers records fail to provide the required details to support items claimed. A case lacking merit can result in significant penalties for the tax professional bringing suit. Thus, you were advised to continue on your own if you wished to do so.

We have provided hundreds of thousands of successful responses in our 30 years in business. We appreciate all our members and look forward to providing excellent customer service and audit representation in the years to come. Our records indicate that you purchased a product directly from a software provider that bundled our services into several benefits of their package. As such, we cannot tender a refund to you for the services provided by our company. Information has been sent to you on contacting the software provider regarding the product you purchased.

I am rejecting this response because: limited documentation? It was literally everything you asked for. Your company is a joke, you dont provide the service you promise and then you blame the user for doing exactly what you asked for. This is a terrible business that only exists to steal money from the user.

      Business response

      11/14/2022

We understand that you are not satisfied with the ***s decision not to accept your documentation. However, we did provide the services per our membership agreement with you. We submitted the documentation you provided to the *** for their review, after explaining to you exactly what is needed. You have stated, and I quote, Its not up to the ***. If its a business trip, its tax deductible . However, the determination of whether you have substantiated that the expense is business related is up to the ***. They have the authority to accept or reject a taxpayers documentation.

In addressing the statement, we made about the limited documentation you provided for the year under audit; you claimed items connected to what you called Freelancework. The *** requested records to support the car & truck expenses, business travel, and other expenses reported on your return. By your own admission, many of the expenses you claimed were related to your work as an employee, not the Schedule C business. Therefore these expenses are not deductible, and you incorrectly claimed them on your tax return. To prove the claim, the *** requested a mileage log for car & truck expenses. We explained the log must contain all of the following:

      1. Date of business travel
      2. The complete address of where the business trip started and ended should be included. (***************************, and Zip Code).
      3. The total miles traveled for each business-related trip.
      4. If meeting clients, the details should include the name of whom you met with on the business travel and/or the purpose of the travel. (Business purpose defines the nature of the expense and how it relates to actual business conducted).

You were asked to provide the above information; you indicated that you did not know that specific clients had to be listed with the mileage log, it seems intentionally difficult. Additionally, you indicated, I can pay the tax since it seems like theyve intentionally made it more trouble then its worth, even with all the necessary documents they requested, they can still say thats not good enough.Unfortunately these documents are required under the Internal Revenue Code for the above items to be deductible.

As stated, we cannot tender a refund, as you did not purchase our services from us directly;you must contact the software provider. We have confirmed that the information on how to reach the software provider was sent directly to the email address you provided to our company.

I am rejecting this response because:most of what you said are out right lies too bold be misinformation. I said no such thing that they were related to me being an employee and I gave them the spreadsheet you asked for with all the information you asked. The first time you asked me to remove most of the information because it wouldnt fit on one page which I thought was nonesense. I then resubmitted it with all the information when asked.

You failed to represent me in court for some nonsense reason. You did nothing to correct my audit and its obvious youre on the irs side, not my own. Youre a complete scam and as I pointed out will blame the customer when you havent held up your end of the bargain.

Once again, we are sorry that our services did not meet your expectations. We notified you before the Tax Court Petition due date expired that we would not file a petition on your behalf since we did not believe your case had the merit to go to court. We provided instructions on filing a petition on your own if you wanted to pursue that option. As a courtesy, we offered to submit an Audit Reconsideration to the *** on your behalf. Since the *** deemed your previous documents insufficient, new information was required from you. However, you failed to provide any new information as requested. Instead, you have requested a refund for services provided because you are unhappy with the results.

I purchased audit defense through turbo tax. I received an audit letter at the end of February. Called and was given a tax professional to represent me. I sent in every thing the *** was requesting to prove I was allowed to claim the credits I claimed. 90 days plus went by with little to no communication from the lady after she submitted everything to the ***. Upon me requesting an update, she informs me that the *** never received the information she sent. She had to send it all over again. About a month later I receive a notice from the *** saying I owe **** when I'm supposed to get back *****. I email and call this representative several times, to which she does not reply. I then reach out to the supervisor, who also brushes me off for about a week or 2. Finally get transferred to the supervisor one day and she realizes and admitted they dropped the ball and apologized profusely. Well, it's September not. The *** is still saying they haven't reviewed my response. Now we have to appeal the tax court. Which will take several more months. I paid for this service. I've used turbo tax as a paying customer for over 10 years, but I never will be again after this experience.

I have reviewed the response made by the business in reference to my concern, and find that this resolution is satisfactory to me, only because there are literally no other options.  Had they done their job correctly in the beginning,  it would never have gone this far,  to have to appeal.  But because the tax attorney that I was assigned failed to follow up with the irs for over 90 days from her original response, my case has been severely overlooked.  They dropped the ball several times.  After using turbo tax for over 10 years,  I will never use them again after this.

I purchased tax audit when i filed my taxes. I received a letter saying that i owed the state of indiana money. I called Turbo tax who referred me to tax audit. I talked the representative, received a case number and uploaded everything requested of me. When i didn't hear back after 5 days, i called tax audit again as I was told I would receive a call in ********************************************************************************************************************* and did not seem to know what she was talking about, requesting that I send prove of my military employment, which was already on my tax forms. I was told to have turbo tax send a .tax file. I called turbo tax who told me that they are not allowed to release that file and tax audit should know that. I have told tax audit this several times and they keep insisting on receiving that file. It is now two months later. I have called and file complaints and requested a refund back and all i receive is sporadic messages telling me they are working hard on my case but not resolution on the issue. Meanwhile, i am accumulating interest from the state for not paying my bill. this is poor service on tax audit's part.

Thank you for providing us with this feedback on your experience. We are sorry to hear that it has not met your expectations thus far. We apologize for the delayed response times in your case and any confusion regarding obtaining tax files. For self-prepared tax returns with your consent,we generally receive those files to aid audit representation. In your case, you did not have a self-prepared return, and we could not obtain the file. A review of your file indicates you recently spoke with one of our managers. In your case, an amended tax return was recommended, and our audit defense does not include amending tax returns. We want to inform you that your membership is valid as long as the tax agencies can request an audit. Thus, in the future, please do not hesitate to contact us if you receive any audit notices for the year in question.

I am rejecting this response because:

communication was poor and not timely.  I am fine with needing to have an amended tax return, my complaint is that it took over two months to receive that information when i am being charged interest for late payments to the state.  This is a poor business model and I won't recommend anyone use your service again.

I had TaxAudit through a MaxDefense through turbotax for a year in case I was audited. I got audited and they said they would do nothing to assist me in the case. Their reason was that because I needed to mail them the notice 14 days after I receive it and the notice was dated March 15th of 2021. They could have provided representation and tried to represent it like the case was closed, even though the *** told me it was not closed. They then closed my case and provided no further assistance or communication.I have the phone call recorded where they basically just say we're not going to help you because you mis-stated earnings, there seems to be an error in how much earnings were reported and they didn't bother looking into it. Now I need to call the companies and figure everything out myself and the process in how to report corrections to ***.I am requesting a refund of $150.Deceptive and lazy. Business should be shut down.

We are sorry to hear your experience was not to your expectations.  We see a new Representative has reached out to you and discussed your case and has given you options you can take to resolve the issue with the IRS.  If you still feel you want a refund, you will need to contact TurboTax and request a refund from them as the Max ****** is their product purchased directly from them.

I contacted TaxAudit in January of '22 because I purchased their coverage/service when filling my taxes with TurboTax (2021 year - The *** wanted my expense receipts and my T2200). This process should take no more than a week.I was redirected to the "********" division and was connected with someone by the name of ******. She was not very clear or friendly, and she left me confused more than ever. I am supposed to verify expense receipts and a T2200 form to the ***, and she was talking about how I claimed "Tutoring" expense when I did not. I thought this was a scam, as they weren't very knowledgeable. She told me I could book a meeting with her anytime, so I did just that and forgot about the meeting. I was under the gun at work to complete a prototype accounting software, or else we would have to call it quits if I was not successful (I was working very long hours, up to 16 hours a day). The meeting date comes up, and I receive a call from a 1 800 number. It's not labelled; I think it's another scammer (mind you, I was deep into a complex block of code at the time). I picked up first, unsure who it was, and it took me a hot second to remember I scheduled in the first place (long work hours, right). Before I could say anything, ****** was yelling at me and being aggressive. It wasn't polite, and eventually, she calmed down, and we went about the call. I submitted everything to them in January, and I've had to call the *** to extend the due date (which they missed anyway). It doesn't make sense; I paid for them to take care of it, so they should be calling on my behalf. They keep telling me they will send a draft to me today or tomorrow, but it doesn't happen (I've been told this fix-six times over the last four months). ****** is very unprofessional every phone call and has even gone out of her way to tell me that I don't want to end up on a list with the *** if not done right. Occasionally what she is saying doesn't make sense. It feels like a HUGE red flag!

We are sorry to hear of this experience, however we no longer provide Audit Defense for TurboTax ******** users nor do we have a representative named ******. We believe the poster was dealing with a company other than TaxAudit.
