    I signed my initial visit on an iPad and wasn’t provided any print out of my contract. I leave Fresno in Oct and go back home to Wyoming. Just now February 4, 2023 I finally discover they have been billing me monthly $89 so they billed me for Oct, Nov, Dec, Jan & Feb for a total of $445 Now they won’t refund my money! By having me sign a contract on an iPad and not providing me a copy in which I still don’t have a copy of the contract, I feel that this business is using deceptive business practices! Come to find out if I’m in Wyoming and I’m not in California that if I don’t use the monthly service of 4 visits then I must forfeit those visits! Where was the curtesy call between a doctor and his patient back last Oct or Nov saying *** when are you going to come back and use your visits that you paid for? Very Dishonest Doctor & Staff Very Deceptive Business Practices!! Total Rip-Off I want a refund of my $445

    Just to let you know, we received your notification today that the BBB had received a complaint regarding our business practices.

    Attached is a document that was sent home with the individual who filed the complaint that we scanned and entered into his file. He did sign a contract on a tablet, but this document was sent home with him. His name is at the top of the document, he initialed each line that was explained to him as he initialed each statement, and he signed and dated the document.

    This individual used his visits over a three-month period. So it is clear that he knew that he was being charged beyond the two-month minimum. Once he stopped coming in, our system lets us know when a patient has not been in for two weeks, and we called him at this time, leaving a voicemail, encouraging him to come back in and letting him know that he was still on the plan. We followed up with several more calls over the next two months with no response.

    We did receive a call from this individual recently complaining about being charged. At that time, we emailed him a copy of his contract again, and let him know that we had already been charged fees associated with his account and would not be able to refund him based on this and the contract that he signed. This is why we make it very clear to our patients that there are no refunds after they receive a charge.

     I am rejecting this response because:

    Everything he said is complete lies!
    1) I never received no copy or print out of any contract.
    2) I was never read or given instruction to initial anything.
    3) there was 1 receptionist handling 2-3 patients at the same time!
    4) I was in pain and under duress to complete the IPad agreement ASAP so I could just get treated by a chiropractor!
    5) the only time I got a copy of the documents I had initialed was sent to me on an email I received Feb 6, 2023
    6) it looks like I will have to contact my attorney because these people run a very shady business lying to their patients or should I say customers!
    7) my first visit proves they are lying because I agreed to a special wellness bundle that included 10 visits loaded onto a barcode key fob!
    8) my first payment was August 4 for $118 for this special offer.
    9) I went through August with like 6 visits and September  I went maybe twice but I never did use my total 10 visits.
    10) I was not billed in September!
    11) The automatic billing began in October after I had already gone back home to Wyoming.
    12) The problem was I locked my Citi Card and so I was very unaware of the continued billing for Oct, Nov, Dec, Jan finally catching it in Feb.
    13) I can also prove they are lying about phone calls with my phone records, as I can clearly show no missed calls for either ***iel *** or The Joint.
    I guess I will just have to proceed in court because these people are very greedy and they aren’t going to refund the money!
    The judge will see through their lies after he reviews their response to this complaint, and my phone records!
