• Advertising Review:

  On October 8, 2024, BBB Serving LosAngeles and Silicon Valley requested that the business substantiate, modify, ordiscontinue claims advertised on their website, https://bwjagents.com/.In particular, the business advertises “#1" claims, “Top-Rated” claims, "Best"claims, award claims, and a statement indicating that they have been inbusiness for “30+ years.” The business also advertises result claims such as “HighestCommission Rates in the Industry!” and “You earn $280 more to your pocket onthis one booking using BWJ. It would take you 2 bookings with competitors toearn the same amount of commission as you would on this 1 trip.” BBB alsonoted that the business advertises negative option plans withouta clear and conspicuous disclosure of all material terms.

   

  The BBB Code of Advertising statesthat, "1.1 The primary responsibility for truthful and non-deceptiveadvertising rests with the advertiser. Advertisers should be prepared tosubstantiate any objective claims or offers made before publication or broadcast.Upon request, they should present such substantiation promptly to theadvertising medium or BBB.”

   

  The BBB Code of Advertising alsostates, “34. Claims relating to performance, energy savings, safety, efficacyor results for a product or service should be based on recent and competenttesting or other objective data.”

   

  The BBBCodes of Advertising also states, “18.1 Any advertisement for a product orservice that includes an offer to sell or provide consumers with additionalgoods or services under a negative option feature must include a clear andconspicuous disclosure of all material terms of the negative option feature.18.2 Such material terms include: 18.2.1 The existence of the negative optionfeature; 18.2.2 The cost of the additional goods or services; 18.2.3 Howconsumers can cancel and avoid future shipments and charges; and 18.2.4 Howconsumers can return items that they do not want. 18.3 Advertisers must avoidmaking disclosures that are vague, unnecessarily long or which containcontradictory language. 18.4 Advertisers must not interpret the consumer’ssilence, failure to take an affirmative action to reject goods or services, orfailure to cancel the agreement, as consent to enroll the consumer in thenegative option feature. Instead, they must ensure that the consumeraffirmatively consents (either online, over the phone, or in person) to thenegative option feature before enrolling the consumer in the plan.”

   

  As of November 8, 2024, the businesshas failed to respond to our request for substantiation, modification, ordiscontinuation of the advertised claims.
