      On 09-14-2021 we begin talking with Seek Capital about securing funding. The rep sent over an estimate for their services and we couldn't complete the next steps for id verification. A few weeks later a rep called and we owed them for canceling a service they never started nor completed.

PLEASE NOTE: All records including; signed agreements, phone recordings, emails and system notations have been reviewed to gain an understanding of your file. The agreement you mentioned has clause where we advise we have an early termination fee associated with cancellation after 24-48 hours If you review your copy of the agreement you signed, you'll see the fee is outlined clearly. Per the notes on our file we spoke with you on 10/6/21 and we explained this fee to you based on the signed agreement and you denied signing the agreement that you confirmed you completed on 9/14/21 when you initiated SBC services. At this time the fee stands and is past due. Please reach out to us directly to further discuss options on your file. The client signed his Funding Estimate Agreement on September 14, 2021, then on October 6th 2021 approximately 22 days later the client expressed "he received alternative funding" but didn't formally cancel until October 6th 2021. Seek Business Capital is well within the bi-laws of the client's signed Funding Estimate Agreement (see attached) to assess a $995 Early Termination Fee. The early terminations fee is disclosed in a clause at the top half, of the first page our Funding Estimate agreement, in red print only applicable after you signed a funding estimate agreement. In other words, the fee is only relevant after you signed our agreement and could not be assessed without a signed contract. If you would like another copy please reach out to your account manager or request to speak with management who will be more than willing to provide a copy. We have a reasonable expectation that our clients read and understand the agreement thoroughly. To ensure clients have a full understanding of the agreement.

      I am starting a business which required a minimum loan of $******, I submitted a request to Lending Tree and the first company to contact me was Seek Business Capital, because I needed the fund quickly they assured me they could fund me in a few days. I am going include a response I sent to them based on what they want to charge me for after destroying my credit rating. Please read the following: Report on Seek Business Capital: What I agreed on and what was received and the charges for not received items. Bank negotiations fee ($595.00) MONEY BACK GUARANTEE: Seek Capital to increase of at least 3X in credit limit, currently Seek Capital has not even equaled my previous credit of almost $******. The current limit I am being changed for is $****** in credit card limits, which I have not received a credit card for BofA of $8,000, that puts the total at $******. Upon receiving your complaint, an internal investigation was opened. Below are the findings: PLEASE NOTE: All records including; signed agreements, phone recordings, emails and system notations have been reviewed to gain an understanding of your file. You inquired regarding our services and first spoke to an agent on July 20th, 2021. In your second call with our team, a funding proposal of 40,000-60,000 as presented both verbally and upon your request, was sent to you via email for your review and signing on July 20th, 2021. The agreement was signed by you in 2 separate locations and initialed 22 times alongside each of the terms. A Verification and Compliance call was conducted on a recorded line with yourself and a compliance agent to ensure all data provided was accurate as well as to ensure there was a full understanding of each step of the process. You were then sent another agreement confirming your understanding of the information provided, which you signed twice and initialed, agreeing to 22 key clauses. In the agreement, your desired funding amount was 100,000 with a minimum funding amount of 60,000. As discussed, with your limited time in business, your file was NOT approved for/eligible for an SBA loan, term loan or standard line of credit. Your file was, however, approved for credit card-based financing at 0% APR for the first 12 months. Total funding obtained for you was 33,500 with the option to liquidate funds up to 26,000 as listed in your liquidation plan. At no time did the team promise anything as we cannot control the banks' decisions. If you take a look at your copy of the agreement, right next to your signature is a notice in all-caps, red font that states "NO GUARANTEES: CLIENT UNDERSTANDS THAT CONSULTANT SHALL PROVIDE BEST EFFORTS TO ACHIEVE THE FUNDING AMOUNTS SET FORTH IN THIS DOCUMENT. IT IS UNDERSTOOD THAT CONSULTANT WORKS WITH FINANCIAL INSTITUIONS THAT ARE NOT CONTRACTUALLY COMMITTED TO UPHOLD ESTIMATED FUNDING AMOUNTS. IT IS UNDERSTOOD THAT ANY NUMBER OF VARIABLES CAN IMPACT THE SUCCESS OF ACHIEVING THE FUNDING ESTIMATE. CONSULTATNT MAKES NO WARRANTIES, ASSURANCES OR GUARANTEES IN ACHIVING FUNDING AMOUNTS." We have a reasonable expectation that our clients read and understand the agreement thoroughly. To ensure clients have a full understanding of the agreement, we have a standard verification and compliance call with every single client that lasts approx. 45-60 minutes or longer to walk through the entire agreement. Additionally, we offer custom liquidation plans for any client that wants to purchase this service one once their invoice is paid. In our systems we have noted that you paid your invoice in full and this liquidation plan was presented to you and sent to you. In the contract you also signed and agreed to apply to a mix of standard and personal credit cards. We take great pride in striving and providing amazing service to each and every customer. Though we are not perfect, we are confident in our level of transparency in all critical data points such as fees, time frames, costs etc. adhere to the highest levels of both regulatory requirements as well as what one would consider reasonable. Our commitment to this is evident in our detailed Verification and Compliance call, as well as our agreements being written in a manner that is everyday English, rather than legal jargon. At this stage, the internal investigation has concluded and found that Seek Capital staff performed their duties in full accordance with the agreements signed, as well as Seek Capital policies and procedures.       They asked me for my social, DOB, and address to do a soft pull. They insisted that they needed the info, however I resisted and they said they could not get me a business credit line quote if I didn't provide it to them. So I gave it them the information and a second later, they had an excuse to say I did not qualify and basically just hung up. I immediately knew they stole my personal information and I froze all 3 of my credit bureau reports. Now I am worried about my SSN number and had to get a monitoring service. I had trusted them because they had been recommended by lendingtree and fundingpilot, which both have good reviews. Please have them removed from recommendations on other lending sites as they are committing fraud and stealing people's information.

      Seek Capital, LLC., ("SBC") represented that it will get $**************** in business funding for my company. SBC was to get paid $795.00 conditions handling fee. plus 11.99% from the total credit obtained. SBC uses a "spaghetti on the wall" method wherein they submit applications to multiple random banks in hope of getting them approved. In early August, I was approved for two personal credit cards for a total of $********., and SBC invoiced me $********; $795 for conditions handling fee and $969.20 which I paid in full. About mid-August, SBC ceased all communication and abandoned the process altogether. I served a demand letter and tried to justify my position that SBC 's actions constitute false representations and deceit, dishonesty and not limited to possible violation of Unfair Business Practices §§*****, ***** and Consumers Legal Remedies Act §****. I offered SBC a settlement opportunity, however SBC advised me that it had completed all work and refused to issue a refund.

A Verification and Compliance call was conducted on a recorded line with yourself and a compliance agent to ensure all data provided was accurate as well as to ensure there was a full understanding of each step of the process. You were then sent another agreement confirming your understanding of the information provided, which you signed twice and initialed, agreeing to 22 key clauses. SBC was completely transparent regarding our services and serviced your file as outlined in your agreement. At this time we have concluded the investigation. The complaint was about Seek Capital LLC's "Seek" breach of contract, specifically Seek's failure to produce promised results which were verbally and in written form represented by Seek's personnel and documented throughout the application process. While Seek's response makes reference to documents signed by the applicant, conveniently ignores to address applicant's assertions that Seek failed to complete services as contracted and without notice abandoned the process when applicant brought legitimate concerns to Seek's attention. The Internal Investigation story is an "Alice in Wonderland" sequel with zero credibility to it. In its response Seek did not provide any specific details in connection to the performed investigation, and failed to produce any document(s) in support of its position. Throughout the application process, all telephone conversations between the applicant and Seek representatives were recorded by Seek and can easily set the record straight had Seek produced transcripts thereof in its response; but evidently, this is not going to happen. All documents executed by the applicant during the application process were signed in full reliance on the credibility and trustworthiness of representations made by Seek personnel. Regretfully, many of the representations were falsely made with intent to benefit from the applicant regardless of the outcome of the process. And it delivered - NOTHING. And on top of "NOTHING", Seek Capital, LLC. run numerous inquiries on my personal credit report which significantly decreased my FICO rating. Seek Capital, LLC. promised to secure BUSINESS CAPITAL for my company. Conclusively, the company received $0.00 capital, I received 3 personal cards whereby 1 card was closed by lender because Seek Capital, LLC submitted false information on my behalf, and another card with a $***** credit limit, 24.99% interest rate and $99 annual fee. As soon as Seek Capital, LLC. collected payment from me, it discontinued furhter communication... Total ****** !!!!!

      I contacted Seek Capital in May of 2020. I repeatedly told them I was wanting to build my business credit. When I finally found out that was not the case, I repeatedly told them I didn't want to move forward. I never did the Verification and Compliance Call or Verification and Compliance Questionnaire. I had constant contact with them through phone calls and email. On 6/1/20, I received another email saying I owed a cancellation fee. I responded on 6/2/20 and said I was not moving forward. I never heard another thing until 9/24/20. I received an email saying I am approved for a loan. On 9/25/20 I received an email with an invoice saying I owe ***** Again on ******* I received an email saying invoice paid in full. Then I received a letter in the mail dated ******* saying FINAL NOTICE and I had 30 days to pay ***** I forwarded the email to them that said paid in full and I received an email back saying I tampered with email. They won't let me speak to anyone with authority.

After reviewing your file we did send you the early termination fee based off the signed funding estimate signed on 5-6-2021, you then completed limited power of attorney on 5-8-21 giving us permission to get funding on your behalf. Although we did not complete the funding process per the funding estimate agreement you are required to pay an early termination fee of $995. The agreement sates you are required to pay the fee of $495 if cancelled within 24 hours and $995 if after 48 hours. Per our record on your file we have reached out to you and spoken to you on multiple occasions to assist you with your file the last conversation was with one of our managers regarding your file on 9/17/21. We are more than willing to assist you with your file to avoid sending file to collections. At this time the fee is still pending payment and past due. I will notate your file to discount the fee to $495.00 in lieu of your dissatisfaction. Please reach out to us directly if you would like us to assist. I didn't hear anything back from them for months after I sent an email telling them that the funding was not going to work because it wasn't at all what they told me it would be. The major issue I had was they said it would be business funding and not go on my personal credit. I didn't need any kind of personal funding whatsoever and I told them that time and time again. After going round and round with them about the fee they were trying to charge me and after multiple emails and phone calls, I received an email on 9/25/20 from ***ela Price stating: Hi ******, Thank you for paying your cancellation invoice in full. Your cooperation is greatly appreciated. It is unfortunate that we were unable to work together. We wish you the best in your business endeavors. Thank you for your time. Then on 9/28/21 I started receiving invoices again. I sent an email asking why I was receiving invoices again and **** ***** responded saying: "The email you sent me is tampered. *** verified it." I repeatedly called and requested for a manager with higher authority contact me and never, ever did anyone contact me. I even sent a letter to their corporate office and no one contacted me. This company is fraudulent and they completely manipulate and lie to people to at least get the outrageous fees they charge.       IN APRIL OF THIS YEAR I GOT ON LENDING TREE FOR A LOAN. THEY SENT MY INFORMAITON TO MANY LENDERS. SEEK BUSINES CAPITAL CALLED ME LITERALLY WITHIN MINUETS., I TALKED WITH A LOAN OFFICER NAMED ****, WE WENT THROUGH THROUGH ABOUT AN HOUR LONG APPLICATION PROCESS AND THEN PULLS MY CREDIT AND TELLS ME I HAVE TOO MANY HARD INQUIRIES. I KNEW THAT I DID BECAUSE I AM A VICTIM OF FRAUD. I TOLD HER IT'S BEING WORKED ON. SHE INSISTED I USE ********* LAW. *** LAW WANTED TO CHARGE ME WAY TOO MUCH MONEY TO DO WHAT I ALREADY WAS DOING. SHE TOLD ME ONCE THEY THE INQUIRIES WERE GONE I COULD GET THE LOAN. AS PROMISED I GOT THEM OFF AND ALL OF A SUDDEN SHE WOULD NOT ACCEPT MY CALLS AFTER LEAVING MESASAGES FOR A MONTH. I lost a large amount of money. I have never had to ask a lender or anyone for capital. My last transaction with a bank was over 20 years ago for my house which is paid off. I go online seeking capiltal to get my buisness the fuel it needs to survive and instead Lending Tree sent me to a new genration of hungry lenders that can't fullfill their promises. ***** and I went through an hour of questioning. She aksed everything but my blood type. She gets all the end and runs my credit only to tell me that there are too many hard inquiries. I explaind to her about the fraud and that it was being taken care of. I have not looked at my crdit in years and I found out someone was using my information to get credit a year or so back. She insisted that I talk to ********* Law so thay may help my credit. I told her that it was already being worked on. There is nothing LL could do. I have no bankrupcies, no derogatory marks no missed payments and score of ***. I obliged her and talk to LL. THey wanted to charge me a price that I was NOT willing to pay when I already had someone working on the situation. However, only because she told me that if the inquiries were gone, I would get the loan. A few weeks later, Experian, Equifax and ***** bank did their own investigations and concluded it was fraud. I was excited to call ***** back and for an entire month the associates would say she on another line and she would call me back. No one would help me because my file was under her name. While this is all going on, I am loosing out on opportunities because I didn't have the funding. If I wasn't promised the loan from Seek Capital, I would had spent that time entertaining other offers. U decided to give up on Seek Capital and got back on Lending Tree and sure enough Seek Capital called within minuets of me completing my applicaiton. To my surprise, it was *****.I dont think she knew who shes calling because once I stated who I was, I could hear the suprise in her voice. I was born at night, but not last night. I proceeded to tell her that I got the inquiries removed and she asked me if ********* helped and I told her that I didnt use LL. That is when the conversation changed. I could tell she was not happy that I didn't use LL. Which makes me wonder if your employees are getting kickbacks from LL for every client you send. Anyway, I asked her if we could proceed with loan and she said sorry but it's declined. My score went up because of the inquiries being removed so I didn't understand. By this time I am not happy and was just ready to end the call. I said ***** you all called me I didn't call you. Then she asked me if I ever heard the term "All roads lead to Rome", I said yes, then she says well we're ROME! and hangs up on me. if you have the chat log, you will here that exact scenario. I have no reason to make that up. I could not believe that a company that says the give all their customers "amazing service" make promises they can't keep, be bait and switched, and then hung up on! I family and mouths to feed you need to tell your staff that when people are looking for loans that time is of the essence and they need help. Not one of your associates decided to help me after I repeatedly called telling them my situation. They would always say ***** has your file. The day she hung up on me I wrote a letter to Seek Capital to NEVER CONTACT ME AGAIN and that very same day and still today, I am getting texts and calls from your company. I WANT MY FILE RE OPNED AND THE LOAN I WAS PROMISED. I DONT WANT A CALL FROM YOU ALL VIA EMAIL WHICH YOU HAVE. YOU HAVE MY NUMBER BECAUSE i STILL GETIING TEXTS. BECAUSE OF YOUR PROMISES, MY BUSINESS IS ON IT;S LAST LEG. I AM WORKING ON GETTING IN TOUCH WIT ROY FERMAN TO LET HIM KNOW OF THE BUSINESS MODEL HIS COMPANY IS GOING BY AS WELL.

      This company falsely promoted & promised that they would help me obtain business funding from a bank for a loan or revolving line of credit. However, they just bulk sent out standard credit card applications for personal & business cards. This was done in violation of the "funding agreement" that was signed that explicitly states only business funding will be pursued. Additionally, in all our written & verbal communication, I made it clear that I only wanted business funding. They further violated the agreement by contacting banks I already had a relationship with, which I expressly told them not to do. As a result, my personal credit was destroyed & I was forced to file claims with banks, credit cards, and credit agencies to close the fraudulently opened applications. After I expressed my outrage, one of their representatives called me to apologize and said they will be invalidating the invoice. However, they are still harassing and threatening me to pay the original invoice

Upon receiving your complaint, an internal investigation was opened. Below are the findings: PLEASE NOTE: All records including; signed agreements, phone recordings, emails and system notations have been reviewed to gain an understanding of your file. *As discussed, with your limited time in business, your file was NOT approved for term loan or standard line of credit. Your file was, however, approved for credit card-based financing at 0% APR for the first 12 months. After speaking our senior funding advisor and agreeing to continue with funding, The agreement was signed by you in 2 separate locations and initialed 22 times alongside each of the terms. If you review your copy of the agreement you signed, you'll see the words "credit cards" appear 4 times on the first page of the agreement and several times on the following pages. The agreement also clearly states that a combination of personal and business credit cards would be pursued. Additionally, the fee structure is listed in detail on the first page of the agreement and once again on the second page of the agreement, including a section which you personally initialed and signed. *A Verification and Compliance call was conducted on a recorded line with yourself and a compliance agent to ensure all data provided was accurate as well as to ensure there was a full understanding of each step of the process. You were then sent another agreement confirming your understanding of the information provided, which you signed twice and initialed, agreeing to 22 key clauses. After signing documents we proceeded with funding on your file. At this time the investigation is closed and the amount due is pending payment on your behalf. We are willing to work with you regarding your invoice options, feel free to contact your account manager to discuss details. In particular, the claim that "The agreement also clearly states that a combination of personal and business credit cards would be pursue" is demonstrably false. In both signed documents that were referenced, "the funding estimate agreement" clearly states in bold text that only "unsecured business credit cards" will be pursued. There is no mention of personal funding as that was not what was agreed to. Furthermore, in the verification call questionnaire, the funding estimate for business credit cards is the only one listed with a monetary value. The line right below it, says N/A for standard credit cards. Based upon these two documents in combination with the multiple phone calls confirming that only business funding would be pursued, Seek Capital violated and breached the contract resulting in severe personal damages to my credit. Lastly, the claim that "your file was NOT approved for term loan or standard line of credit" is also demonstrably false. I was never notified that I was not approved for this and in fact, the first line item in the funding agreement, states "1. Unsecured Credit Cards With Line Of Credit Capability" Business Response /* (4000, 10, 2021/10/10) */ Thank you for your response, I believe there is some confusion regarding the agreement and we are happy to assist. All of our agreements mention multiple times that we will be going for both business and personal/standard cards. We also advise during the recorded verification call that we will try for business and personal funding but make no guarantees and if one is favoring the other we will proceed with that option to achieve the funding for our clients. We make this very clear to ALL of our clients regarding our funding practices. If you would like to further discuss we would be happy to speak with you to further discuss.       I hired Seek Capital to help me get funding for my new business. I was told that all of the credit would report to my business credit and that they would set up a Dun and Bradstreet account for me...this never happened. I ended up finding out how to do it myself and realized that non of the funding was showing up on my business credit. My personal credit score dropped tremendously and I still have no business credit.

Based off the review we did make multiple attempts to get business funding approved on your behalf, unfortunately they were all declined. As outlined in the agreement we cannot make any guarantees regarding approvals even with our best efforts. The agreement and the verification call also advises we will be applying for both business and personal funding on your behalf and the banks favored your personal profile vs the business. We do understand your frustration and wish there was more we could do regarding this matter. At this time the investigation has been closed, we wish you the best of luck in your future endeavors.
