Hello Everyone this is ******* Jean ***** now Everyone since I've gotten this truck from **************** ****************************************** ************* the check engine light comes a week after I driven off the lot now remind you I ******************* about this truck having this issue also I had a certified diesel mechanic ******* it as well no I did. My due diligence. 2 issue this with mister ***** wish he fixed a couple of things on it. Didn't really fixed engine light because. I told him about it in. He just never really wanted to take care of it. So at this point, I'm thinking about bringing Detroit back to Mr *****. Because I spent $15000 of maintenance on this truck. It doesn't make sense. That I spent all this money now and I've been dealing with the same issue ever since. We appreciate the opportunity to respond to Mr. **** ***** complaint regarding his experience with the above-referenced truck and loan agreement.
Maxim Commercial Capital provided financing to ******* JEAN *****, with the contract signed in March 23rd, 2024 for the purchase of a 2019 Kenworth T680, VIN: *****************. The dealership referenced in ******************* is not affiliated with Maxim, and we did not participate in the sale, inspection, or delivery of the vehicle.Mr. ***** states that the truck presented mechanical issues, including a persistent check engine light and several repairs shortly after delivery. While we empathize with his frustration, mechanical concerns are a matter between the customer and the selling dealership. All of our contracts clearly state that vehicles are FINANCED AS IS WHERE IS WITH ALL FAULTS... (Section 3, EFA TR11788), and all our debtors agree to "Maintain the Collateral, at Debtor's expense, in good working order, repair and condition..." (Section 3, EFA TR11788).
It is our understanding, based on customer emails and calls, that Mr. ***** attempted to work with the dealership and spent a reported $15,000 in maintenance. We were not provided receipts validating the full amount, but partial documentation was submitted and reviewed.
Despite the issues reported with the vehicle, Maxim made every effort to assist the customer:
- Offered a two-month deferment, contingent upon a payment and receipt of updated insurance, bank statements, and repair documentation.
- Accepted partial payments in good faith, despite several broken payment arrangements and one non-sufficient funds (NSF) payment on the very first installment.
- Repeatedly advised the customer to take the vehicle to a Paccar-certified repair center for diagnosis and provided flexibility for coordination with the repair shop.
- Attempted to help the customer avoid repossession by discussing settlement options and repair timelines.Unfortunately, Mr. ***** was unable to bring the account current, missed multiple commitments, and failed to provide updated insurance documentation. The unit became severely delinquent, and the vehicle was ultimately repossessed on 10/29/2024
It is important to note that Maxim Commercial Capital is not responsible for the truck's mechanical condition. Our role is limited to financing, and the loan contractwhich was signed by Mr. ************ outlines borrower responsibilities. The complaint appears to center on the dealerships actions. We encourage Mr. ***** to resolve those concerns directly with the selling dealer.
Conclusion
Maxim acted in good faith, provided multiple accommodations, and remained communicative throughout. We regret the customer's dissatisfaction with the truck, but our financing agreement was honored according to standard practice.

I want to inform you that this company is charging me an interest rate that is too high, exceeding the usury rate allowed in *****************, on my credit for a truck. This rate is *****%, which was never mentioned in my contract. I realize that because I lost my truck in Hurricane ****** in ************** last September 2024, instead of helping me, they accelerated my credit for a total payment of three times more than what was borrowed, taking into account that even though my truck was under repair, I was trying to solve this loss because the insurance did not respond to me, they did not help and I continued paying the monthly payments. Right now they are telling me that the interest rate is *****% and I was never notified and it is not specified in the contract either. Many think they are helping but it is not like that, because even when I spoke with several people notifying them of my problem and requesting help, they threatened to take my house away and act in an irregular manner.Business Response

Mr. ****************** a commercial finance company specializing in non-prime credit, our rates are structured based on risk factors such as credit history, financial profile, and collateral value. When you signed our financial agreement, the contract clearly outlined the number of payments and payment amounts. These terms were agreed upon before funding, ensuring transparency in the financing arrangement.
Regarding your claim that we provided no assistance, we respectfully disagree. Our records indicate that we have extended significant support, including a due date change request in March 2024 and a two-month deferment in December 2024. This deferment was granted after you informed us on October 3, 2024, about the impact of Hurricane ****** on your situation.
We continued to provide excellent service to you account despite the following:1) You repeatedly failed to meet contractual obligations, including multiple missed payments and NSF returns on 10/30/2024, 11/1/2024, 11/19/2024, and 12/2/2024.
2) Despite being approved for a deferment, you failed to sign the necessary documents between 1/22/2025 and 2/10/2025, leading to a notice of default and acceleration of balance issued on 1/30/2025 for $39,010.33.
3) You also failed to maintain the required insurance, canceling your Progressive policy on 10/3/2024 without notifying the lender, and later admitted your new insurer did not provide physical damage coverage.
4) Additionally, you provided conflicting statements about the trucks condition, first claiming hurricane damage caused a total loss in October 2024, then stating it was repairable by 10/28/2024 but failing to provide proof.
To this day, we continue to service your account given your ongoing non-cooperation. We remain committed to providing you with the same dedicated service and support that we have upheld to this day.

Hi this company is a total fraud they wanted me to pay my first month note on a truck that I didn't request and couldn't drive then didn't even want to admened the date of the swap truck they tried to swap it out for That I never received I paid for the first month of ******** and they cancelled they contract and won't refund me my money until I sing a bogus settlement if they cancelled the fiance which they breach of contract with out any writing notice without me singing anything then my money should be refunded with out me singing anything please BBB look into this fraudulent company ********************* ******************************** Is a very rude individual and think he's racist and doesn't not know how to conduct business and is a fraud and should be fired and license suspended from doing any business and this company needs to pay for my truck insurance since they cancelled my commercial fiance. I paid for the truck insurance on December the 20th 2023 and January 2024 they cancelled my commercial fiance in February 4 2024 shouldn't they pay me for my down payment and January payment I paid on my insurance since they told me the insurance was mandatory on the truck plus refund me my monthly note I paid of ******** as well and will notify fox 2 news to put you in the hall of ShameBusiness Response

I reached out to file a complaint in regards to an employee and have been given a fake email and promises that management *** would reach out. That didnt happen then asking for someone above *** and was told the ** would be calling after meeting and nothing. This has went on for months and Im tired. On 5/28/2020, Maxim received a Notice of Seizure from the U.S. Border Patrol. The ************************** was seized ************* due to unlawful transportation of undocumented individuals. Maxim's security interest in the asset was subject to forfeiture. This was an event of default under Mr. *************'s *** contract. Mr. ************* explained that this was his driver's fault and he promised to fire the driver. We worked with Mr. ************* and his attorney to regain possession of the truck for Mr. *************, and we gave Mr. ************* a second chance to perform under the *** contract with Maxim. The first monthly payment under Mr. *************' *** fell due on May 15, 2020. Mr. ************* bounced this first monthly *** payment to Maxim. All subsequent monthly payments he made to Maxim have also been received late. Since the contract term began, Maxim collectors have placed numerous phone calls to Mr. ************* to collect past due payments, resulting in 10 pages of collection notes. In many of these cases, Mr. ************* promised to pay his delinquent monthly payments by a certain date, but then he failed to make those payments as promised. By 8/4/2022, Mr. *************' account was 51 days past due. Mr. ************* had not paid the June and the July monthly payments, and the August payment would be due in a few days, on 8/15/2022. The account was also past due for $2,917.08 in fees that Mr. ************* incurred since the start of the term (mostly late fees). And we did not have his required proof of insurance to cover physical damage on the collateral. The most recent Certificate of Insurance had expired 1/11/2022. We had advised Mr. ************* that, to avoid a repossession of the collateral, he would have to pay $5,858.16 to bring his account completely current by the end of the business day 8/4/2022. Mr. ****** tried to pay with a credit card, but it was declined for the $5,858.16 amount. The card was approved for a smaller amount of $2,941.08 and Mr. ************* promised to call Maxim back before the end of the business day to pay the shortfall of $2,917.08 or to otherwise promptly notify us that the payment had been made in a different manner. Maxim did not receive another a phone call or payment from Mr. ************* on 8/4/2022. The next day on 8/5/2022, Mr. ************* initiated a payment of $2,917.08 though the Maxim customer online portal. His credit card was approved for that payment. The transaction's effective date was 8/5/2022, a day late. Even so. when we learned that Mr. ************* had made the payment, we promptly called our repo agent to suspend the repo order. However, our agent informed us that the truck had already been repossessed by that time. The screen shots provided by Mr. ************* for this *** complaint are not dated, but we know they do not reflect the account status on 8/4/2022. They show the account status after Mr. ************* paid $2,917.08 on 8/5/2022, and the truck was repossessed. As is our policy at Maxim, after the repossession, we sent a demand letter to Mr. ************* requesting payment of the full accelerated account balance of $30,756 due by 8/22/2022. The amount includes expenses we incurred in connection with the repossession. To facilitate the resolution of Mr. *************' *** complaint, Maxim will agree to lower this amount to $25,835.20, due by 8/22/2022, provided that no payments ever received by Maxim from Mr. ************* are disputed, reversed, charged-back or in any way invalidated. -*********************************************************************
