      The loan/lien approved by Home Run Financing through the ****************************** (PACE) program on 01/23/2024 was unauthorized. The lack of due diligence performed to approve this loan failed to identify and understand that the person the loan was given to, residing in my property, committed a fraudulent act by presenting herself as the sole and rightful property owner. She is merely a Life Tenant of a *********** based on a third party, 94-year-old woman who had been moved to a nursing home. The life tenant had NO authorization to take such a loan against my property behind my back. Upon discovering a quit claim transfer of the life estate, then finding the home had been painted and a 25-year lien placed on my property, paid back through an assessment to the property taxes, the life tenant was served my complaint on 3/2024. On 10/2024 I received an Orange County Superior Court Judgement confirming my fee simple ownership of this property as the Remainderman on this ***** Deed, since 2006. Based on current accumulated unpaid debts of $47,000 from the time of transfer 5/23 to today, the life tenant is being evicted as she is unwilling or unable to pay any of the debts that she is responsible for as a life tenant and as a direct result of this unauthorized lien and utter lack of due diligence on the part of HRF. This home has been in my family since 1969 and never has there been any issues with property tax payment until this lien was issued, without my knowledge, as a result of the life tenant fraudulently presenting herself as the sole and rightful property owner, which my court judgement confirms is untrue, combined with the lack of due diligence performed by *** which failed to recognize the clear encumbrance. I have been in contact with HRF multiple times (Web form, phone, chat) with no response. The accumulated debt on my property is a direct result of this loan being approved without proper title search or authorization from the rightful owner.

      I am rejecting this response because:

      I cannot close this complaint as satisfactorily answered by Pace Funding Group, LLC dba *** for the following reasons. I first initiated contact with *** regarding my issue on or about 01/07/2025 and today, 02/13/2025, is the very first acknowledgement from ***, in any form, that I have received about my complaint, or that it was even received and under review by ***.  There was no follow-up contact to confirm,inquire or clarify anything.
      My initial contact in January was via the Contact Uswebform on **** website. I requested a loan representative contact me with regard to a property lien. I provided the Job number and the Assessor parcel number in my request for a representative to contact me- I did this twice with no response.

      I called the support number and spoke with a representative,******. Shortly into our conversation he refused to discuss the job with me any further but told me he would submit a case to his internal compliance department. ****** provided me with no case number, nor did he take any further information from me but told me that they would be in touch with me. Until receiving the **** one sentence response to my case complaint submitted through the BBB, I had not received any contact or acknowledgement from Pace Funding Group, LLC dba Home Run Financing, their Compliance Manager, ***** ***** or their Agent, ******* D. *****.

      I followed up my phone contact with representative ****** over the *** webchat and inquired how long it would take for initial contact from the compliance department to review a submitted complaint. I was told by the chat ******* that review can take up to 30 days and apologized for any inconvenience this may cause. Again, no further information was taken or provided.

      I ultimately filed my complaint with the *************************************************** (****) which was followed by a complaint filed to the State Attorney General and finally the Better Business Bureau regarding my issue.According to the **** website, my complaint now seems to be under review as far as I can tell with the limited transparency provided. The status of my case complaint to the **** has moved from closed to now showing in process.

      So based on the experience I have had with Pace Funding Group, LLC dba Home Run Finance, I cannot say that my complaint has been satisfactorily addressed. When can I expect direct acknowledgement of my valid complaint from *** and their resolution response to this issue?

Home Run Financing formally responded to the **** regarding your allegations on  February 13, 2025.       I am rejecting this response because:

      I reject PACE Funding Group, LLC, dba Home Run Financing formal response dated 02/13/2025 to my complaint.

      PACE/*** response claims that they understand the life tenant could legally encumber the property. This understanding is the fundamental core of the issue. A holder of a life estate is Qualified but not Absolute as defined in California Civil Code - CIV DIVISION 2. PROPERTY IN GENERAL CHAPTER 2. ARTICLE 1.Interests in property 680 which specifies these roles.

      The encumbrance on my property was enabled by PACE/***s flawed assessment, via whatever shallow due diligence performed, that the life tenant had an Absolute interest in the property. Additionally, the life tenant as a valid Qualified holder of a life estate, per the California Civil Code, is restricted from encumbering the property as defined in CIVIL CODE CIV DIVISION 2. PROPERTY CHAPTER 1.ARTICLE 1. Incidents of Ownership, 818. The owner of a life estate may use the land in the same manner as the owner of a fee simple, except that he must do no act to the injury of the inheritance.

      PACE/***'s policies, processes, and procedures granted and administered this loan to place a 25-year PACE Assessment lien on my property. There was zero consideration of the California Civil Codes sited above.

      Per the *** website PACE/*** offers both traditional and property assessed financing to provide contractors with a single source for their clients to obtain home improvement financing, choosing either unsecured loans or, if it is a better fit, PACE financing, which is tied to the equity in their home.

      The life tenantschoice of PACE financing makes the intentions clearer.  How did PACE/*** assess exactly how much equity a qualified holder of a life tenancy had in the property when based on the life of another individual who is 94-year-old when the property ownership is (1) shared (by the remainderman), (2) the time of use of the property is limited, and (3) the use is restricted?

      The life tenant claims she has not been billed for the loan approved by *** on 01/18/2024.Additionally, the life tenant claims ignorance to the fact the loan was assessed to the property taxes and further claims no receipt of property tax bills from the Orange County Treasurer.

      What is being claimed by PACE/***s compliance department is that PACE/*** takes zero accountability in the flawed determination that a life tenant is the sole and rightful owner with full unencumbered equity in said property and the tenants eligibility to pay the **** assessed increase in property taxes was based on the propertys assessed value, not income. I outright reject PACE/HRS claim in their response to my complaint that, the current PACE assessment then seems to be valid.

      PACE/***'s policies, processes, and procedures granted and administered this loan and placed a 25-year PACE Assessment lien on my property with no consideration of my previous court Judgement or the California Civil Codes sited above.

      As a result of the lack of due diligence and disregard for consumer protections, my family and I are now suffering financial damage as a direct result of this loan, as unpaid PACE Assessed property taxes, delinquencies, penalties and fees accrue.Therefore, PACE/*** must be held accountable for clearing this unauthorized debt put upon my property, not me or my family. If PACE/*** needs to pursue this matter directly with the life tenant which they negligently granted this loan to, then that burden should also be on them not my family.

      I cannot present my case any more clearly that this PACE Assessed loan, approved by Home Run Financing, was negligent, verging on predatory, when you look at all the information surrounding this lien.

      I got funding by Home Run financing and after completion of the job and final contracts being signed they are now no longer wanting to fund the project. I was denied a conversation with a manager so I will be speaking to a consumer advocate attorney **** if this does not get *********** this is straight up fraud.

      I worked with a local contractor to complete some energy efficient improvements to my home. The contractor told me I can have the work completed under the PACE program. The way it was explained to me, and the impression I got was the PACE program was a program that the government sponsored to promote energy efficient improvements, while assisting homeowners financially, to complete these projects. My contractor put me in contact with a representative at PACE Funding (now known as Home Run Financial). I decided to move forward with the project. The total for the improvements I did was quoted at $48,910. I completed the contract via a version of a DocuSign program on my phone. The contract was not very clear to understand and hard to read from the phone, but the big things I was looking for was the finance amount, and interest rate of 3.99% as per the conversations with my contractor and the representative from Pace Funding. I was not made aware of, nor was it said to me of the additional fees that was going to be included with the loan. After the work was done, I received an email with the Completion Certificate, showing I owed $61,479.57. $48,910 was for the improvements, $10,092.55 is allocable to incidental expenses and $2,477.02 is allocable to capitalized interest. The terms are for a 25-year period at 3.99% interest equaling to a 6.02 APR with the extra fees. According to the Completion Certificate, the $10,092.55 was to account for the total administrative fees, recording fees and other fees and costs. Expecting to owe around $48,910, then jumping to $61,479.57 is an increase of over 20%. I was extremely upset and felt taken advantaged of because I couldn't afford to do the work unless I had a means of financing. I was only sold on the PACE program initially because it seemed there was some level of government requirements that needed to be met and would not allow for homeowners to be taken advantage of consumers. I would leave negative stars if I could.

      This company said that my light bill would be $80 a month with the installation of a new AC unit. The monthly payment for the AC unit would be $104. It has been over 4 months, they have started deducting the $104 from my bank account and my light bill is $400 a month. I have tried calling and texting and still nothing. They claim they are looking into it and will provide me with an update and still nothing.
