      I set up automatic payments through Grain technology. Their application had some bugs and kept disconnecting my account. As a result, they reported 1 late payment on my account. I had reached out to customer service via email, and no one would help. They kept saying if my account disconnected, I need to reconnect it. At the time there was no way to make payments outside of a connected bank account, so it was not my fault that the payment came late. Their app was faulty. I would like this corrected. I have the email chain with customer service to prove this.

      We have made the one time exception to update the late reporting on the customer account, while the late payments were accurate and we do provide alternative means to pay by check or money order or at that time via an external payment link. We have opted to do a good will deletion for the customer.

      Grain reported late payments on my account three months in a row after they failed to provide information regarding payment change due to banking error. I have tried to reach out to their customer support team and have not received any help. The account is now closed and I am still making payments. As a creditor they are not taking responsibility for the fact that the delay in customer support is the reason for the late payments and I would like them removed as a courtesy.

      Business response

      07/22/2024

      There is no record of the customer reaching out since April, 2023. Several notifications were sent regarding a bank connection issue and late/missed payments. The reported late payments are accurate. Furthermore, the account is not closed, it is charged-off. If the customer wishes to settle the account, they reach out to our support team by email for assistance.

      Due to a transfer of credit reporting the previous credit line was marked as transferred and may for some users show as closed. However the account is still open and the customers can still make payments as normal.

      o open an account through **********************, a user must first acknowledge and agree with the Terms of Service, Partner Credit Agreement, and Account Opening Disclosure. After that, the user can refer to their Account Opening Disclosures and Credit Agreement at any time on the Grain Application or refer to the copies sent to the email address the account holder used to sign-up to Grain.
      In agreeing to our terms of service when opening your account, you agreed to these terms to allow us to report to the credit bureaus. To make sure you know, we do not report individual transactions as outlined in the Fair Credit Act; however, we do report your balance and payment history. This would only be a violation of the Fair Credit act if we reported without your consent, which we did get.

       If you no longer want to be reported to the credit bureaus or would like to opt out, you can pay your balance in full and close your account.

      I've outlined the law you mentioned below, specifically the section that covers exclusions. No consumer report would include that information solely, and it does not fall under what is currently being reported on your credit report by Grain.

      The term consumer report means any written, oral, or other communication of any information by a consumer reporting agency bearing on a consumer's creditworthiness, credit standing, credit capacity, character, general reputation, personal characteristics, or mode of living, which is used or expected to be used or collected in whole or in part to serve as a factor in establishing the consumer's eligibility for--
      (A) credit or insurance to be used primarily for personal, family, or household purposes;
      (B) employment purposes; ?or
      (C) any other purpose authorized under section 1681b of this title.

      (2) Exclusions.
      Except as provided in paragraph (3), the term consumer report does not include--
      (A) subject to section 1681s-3 of this title, any--
      (i) report containing information solely as to transactions or experiences between the consumer and the person making the report;

      I am not liable for this debt with GRAIN TECHNOLOGY **** I do not have a contract with this Credit system. They did not provide me with the original contract as I requested.

      At the outset, it is important to note that Grain is not a Debt Collector but rather the first-party servicer for creditor partners. By definition, creditors and first-party servicers are excluded from the debt validation requirements because they are not debt collectors under The Fair Debt Collection Practices Act (*****). As such, its important to note that under the ****** debt validation is not required of a first-party servicer.

      To open an account through **********************, a user must first acknowledge and agree with the Grain Terms of Service, Partner Credit Agreement, and Account Opening Disclosure. After that, the user can refer to their Account Opening Disclosures and Credit Agreement at any time on the Grain Application or refer to the copies sent to the email address the account holder used to sign-up to Grain.
      During the life of the customers credit account, that account is serviced by Grain, including the provision of monthly statements and, through Grains technology, the payment of monthly minimum fees to the associated creditor partner. If the user misses a payment, they will receive notices via the Grain application and/or the email used at sign-up. In doing so, Grain is not a Debt Collector as defined under the ***** but rather a first-party servicer.

      If a customer seeks to report that an account was opened without their consent via identity theft or otherwise, a case is opened with Grains compliance department, and an investigation is conducted.

      This company is the worst ever! Not only did they lower my credit line for no reason, they also severely affected my credit score due to a so called missed payment when yet I have a perfect payment history since the very beginning which is around 2020! The customer support department is very poor due to this financial institution not being properly funded or managed what so ever! Im still waiting for this company to correct the errors on my credit report and who knows how long that process will be when dealing with this very poorly funded and managed financial institution! I do not recommend doing business with this financial institution!

      I am filing this complaint against Grain Technology **** due to their refusal to remove fraudulent information from my credit report, despite clear evidence of identity theft and my status as a victim of ongoing federal fraud.For several months, I have been diligently trying to rectify a fraudulent account on my credit report that was opened without my consent or knowledge. Grain Technology **** has been uncooperative and has demanded a police report to proceed with the removal of this account. However, my local police department has explicitly stated that they cannot provide a police report due to the ongoing federal fraud investigation concerning this identity theft case.I have provided Grain Technology **** with an FTC Identity Theft Affidavit and a letter from the ********** of ***** confirming my identity theft situation. Despite these documents clearly indicating that I am a victim of identity theft, Grain Technology **** has failed to comply with the law, which mandates that fraudulent accounts be blocked from the credit reports of identity theft victims. This is a clear violation of the Fair Credit Reporting Act (FCRA).This situation has had severe repercussions on my life, affecting my financial stability and causing immense emotional distress. I have made numerous attempts to resolve this issue amicably with Grain Technology ****, but they have continuously disregarded my rights as a victim of identity theft.

      Complaint: 21856815

      I am writing to reject the response provided by Grain Technology, Inc. regarding my complaint. Despite my diligent efforts to comply with their requests, including the submission of my FTC report and a letter from the ********** of ***** confirming my status as a victim of identity theft, Grain Technology, Inc. has persistently denied the validity of my claim.

      The situation is particularly distressing as it involves my own father, who has stolen my identity and has been impersonating me. This personal betrayal and criminal act have had a profound impact on my life and financial well-being.
      Grain Technology, Inc. claims to have conducted an investigation into the fraud claim associated with the credit account in question and found no evidence of fraudulent activity. This assertion is not only inaccurate but also contradicts the evidence I have submitted multiple times.

      I have diligently cooperated with Grain Technology, Inc. by promptly submitting all requested documentation. Their repeated denial of receiving this evidence is both misleading and concerning, particularly given the severity of the identity theft I have endured.
      Additionally, I have escalated this matter to the ************************************ (CFPB), providing them with comprehensive documentation and communications exchanged with Grain Technology, Inc. As a victim of identity theft, especially by a family member, I am entitled to protection under federal law.

      Therefore, I reject Grain Technology, Inc.'s response and urge the BBB to reconsider its decision in light of the documented evidence provided and the deeply personal nature of this identity theft. I trust that upon review, you will advocate for a fair and compassionate resolution to this matter.

      Thank you for your attention to this critical issue. I look forward to your prompt response.

      Sincerely,

      *******************************

      We completed the investigation, if the customer would like to pursue criminal prosecution for the alleged ID theft we recommend reaching out to their local police department. Baring a conclusive police investigation we can re-open our investigation again.
