My husband and I had solar installed on our home in 2019 by Solar Max. We were told before Solar Max put the solar panels on our roof they would need to first evaluate our roof. If our roof was not in good condition Solar Max would need to replace the roof (only where the solar panels were to be installed) at an additional price. This was completely fine by my husband and I & We told Solar Max to go ahead with the evaluation of our roof. After hearing from our Rep we were told that our roof (were the panels would be installed) would need to be replaced. We went ahead with the roof replacement (where panels were going) & installation of the panels. Fast forward to 2022 & it was now time to replace our entire roof. We were told by multiple roofing companies that we had a third layer of roofing shingles under our solar panels. We were told that this was not in code & that all three layers would need to be torn off & than replaced by the new roof. I was stunned to find out a Solar Max, a reputable company, did not install our roof the correct way. And that the roof was not in code & that it could be a potential fire hazard. I have been in contact with Solar Max & now they want me to come out of pocket to fix their error.Business response

We have investigated our customer’s claims. We have agreed to make the changes that were requested, and we are working with our customer to schedule those changes. While we regret the circumstances that led to this complaint, we appreciate the opportunity it provided to reach an amicable resolution.

Solarmax through representative **** ******* sold me a solar system in Aug 2019 which was to provide 100% of my power needs. I informed **** that my Edison Bill that he made me provide would not be accurate as I spent the summer abroad. I was told that this would be taken into consideration but I did not need to be concerned as you would just add a few panels as necessary. I assumed he was telling me the truth. However after year 1 and 2 was complete it was quite obvious the system was under built. Upon contacting SolarMax I was told that a whole new system would need be installed. Upon checking other sources I was told you had the ability to extend my system to meet the promised energy needs. I am more than happy to pay the agreed $.13 /KWH on the panels I need. It appears I will owe in excess of $600 and I was gone 10 summer weeks last year. The system is just inadequate. I am not unhappy with solar I just want what was promised.Business response

We have been in contact with the complainant and we are working to address his concerns and complaints. We are hopeful that we can come to a mutually acceptable resolution.
Solarmax did not sell a system to the customer. Rather, the customer entered into a Sunrun BrightSave Power Purchase Agreement with Sunrun Installation Services Inc. That is the Agreement between the customer and Sunrun. Solarmax was the contractor that installed the system for Sunrun at the customer’s home. The system is owned and maintained by Sunrun. The agreement states the Estimated Production in kWh, and provided an “offset approx. 102% of your current, estimated electricity usage”. The terms of this agreement provide the customer with an established price of $0.13 per kilowatt hour (kWh) during the first year.
Sunrun guarantees the output of the Solar Energy System as expressed in the agreement. The agreement further states:
“Sunrun makes no other representation, warranty or guarantee of any kind regarding the Solar System’s actual or expected output or performance and any other express or implied warranties are hereby disclaimed.
Your initials indicate that you have read, understood, and accepted the provisions set forth in this section”.
After speaking with the complainant, it appears that the statement regarding the customer needing a new system was not from Solarmax or Sunrun, but from another contractor that sells Sunrun products. The original Salesperson mentioned in the complaint is no longer at Solarmax, and is no longer licensed with the Contractors State License Board to do Home Improvement sales.
Our sales management is addressing these issues with the customer, and working to provide him with options to help him with his solar power needs. While we regret the circumstances that prompted this complaint, we appreciate the opportunity it provides to find a resolution.
