Hello, I am filing a formal complaint against Tricolor Auto and Ganas Auto on the basis of deceitful business practices, lack of structure on internal and external procedures and withholding relevant information from customers with malicious intent. On April 24th, 2023, I voluntarily returned a vehicle I had financed with them under voluntary repossession. The car had issues with the brake pads as well as a broken trunk, details which were not disclosed to me at any point during the purchase. Not to mention it was horrible on gas consumption. Prior to April 24th, I called and explained what was happening and my interest in doing a voluntary repossession, asked what the process was and the consequences, specifically in terms of credit impact and any out-of-pocket balance. I was reassured on two different calls that the process was simple and there would be no consequences of any kind, not even to my credit which I was a bit skeptical of. On the day of, the person at the dealership explained it would be reported as a repossession, regardless of it being voluntary and that there will indeed be an impact on my credit of around 100 points and that I wouldn’t have to pay any other balance on the car. I was asked to sign a paper called “Voluntary Repossession and Waiver of Mandatory Disposition Agreement” and left the vehicle on their premises. I logged into the account on May 1st and found out it was still active so I called and was told the account should be closed within two weeks of April 24th. Almost two weeks after returning the car on May 5th upon receiving texts reminding me of an upcoming payment, I decided to call back and ask what has happening only to be told extremely confusing and contradicting information after asking why I was being told to continue making payments on a car I no longer had possession of since almost two weeks prior. Call 1: Person told me the account would remain open and basically threatened me that late payments will be reported on my credit if I didn’t continue to make payments and that the only way to avoid this was to return to the dealership and retake possession of the car. This person was incredibly rude and not willing to help at all merely attempting to force me to retrieve the vehicle and continue making payments. I requested to speak to a supervisor and got denied “because you’re no longer our customer”. Ultimately the representative informed me he had put in a request for a supervisor to call me back within 48 hours. Person hung up and no callback was ever given to me. Call 2: Person informed my account was still active and they had no idea why. After a hold, they come back to tell me that I didn’t have to make any payments and that they don’t know when the account will be closed because “it takes some time”. This person transferred me over to a different department. Call 3: I get told “we will close your account in a few days”. This person claimed they were sending an email to expedite the process. I was clear I wasn’t planning on making a payment on a car I don’t have and asked if they would report that as late payments to my credit to which they replied that the company doesn’t do that and that they would only report the repossession. On May 6th, I called and was told that the account would be closed in no longer than 21 days and that the only thing reported to my credit would be the voluntary repossession with the date of April 24th. The supervisor comes to the line and tells me that late payments will be reported and upon being questioned why and being unable to explain any reason, they retracted the original statement and said nothing will be reported except for the repossession. I made sure to note that none of these threats and consequences were told to me when I called before April 24th to ask about the process and consequences. On June 5th, I called again as I received a letter in the mail saying this company has purchased insurance for that vehicle in my name. The representative told me he doesn’t know why they purchased the insurance because obviously they have the car in the procession not me and they don’t need any insurance. Now suddenly the time frame for the account to be closed changed again and is no longer 21 days, but an undefined timeframe until they determine what they will do with the vehicle. This person goes on to say that people who I spoke to before blatantly lied to me about multiple things and that he doesn’t know why they were lying when they know the process to be different. I asked to be told what policy they have on the contract that allows them to purchase insurance on a car that’s not supposed to be in use on my name and again, they didn’t know the policy and couldn’t point me to anywhere in the contract where this is stated. Once again, I asked what would be reported to my credit and was told only the repossession would be reported, nothing else. Callback was promised and never happened. Over 2 months after on July 17th, I called back upon receiving alerts from my credit that late payments were being reported on my file from this company. Call 1: the representative authenticates my account and immediately hangs up the call. Call 2: the representative tells me that they don’t know what’s happening or when the account will be closed but now all of a sudden it turns out that there is a form called a “ mutual release form” which I should’ve signed the day I returned the vehicle and that would have helped the process be finalized faster but yet nobody informed me of this supposed form. When I asked why this wasn’t mentioned beforehand and how come if they knew that’s the process why wasn’t I asked to sign it months ago. The response was that they were not sure, and they didn’t know what was happening and the dealership should have told me about this new document and that’s actually what is delaying the process. This person also stated they expected me to continue to make payments on a car I don’t have any more or else they would continue to report these false late payments. Representative hangs up the call. Call 3 and 4: representative authenticate my account and immediately hangs up the call. Call 5: the representative says there is no need for me to sign any new form and that the new time frame for the account to be closed is 120 days. I made the person aware I would be filing these formal complaints and causally a supervisor became available. Supervisor says they don’t have a clue what’s going on and magically there is no longer a need for me to sign the form they were trying to tell me was the reason the process was taking so long. Upon asking what is happening with these reports to my credit and why are they reporting late payments on a car I haven’t had for months as opposed to reporting the actual voluntary repossession, the supervisor confessed he doesn’t know why and said he would email the person in charge of credit reports to get more information and promised me a call back once he received an answer from this person. Now, two weeks after this callback was promised to me, nobody has reached out. Every time I have interacted with this company, they have gone out of their way to lie to me, tell me completely different processes and stories, promise callbacks that never happen, hang up calls without helping me and withhold key information about things like the car condition, time frames, processes and procedures. I have made sure to document every single call and have all the specific details on them including representatives’ first and last name, date and time, department they are at, specific information they gave me on processes, timeframes, and contracts, and supervisors’ names. I am prepared to proceed with a formal complaint against this business with the CA Attorney General Office and the DCA/FTC if no adequate resolution is given to my case, including correcting the false reports and crippling impact on my credit score. I will also pursue legal action, if necessary.Initial Complaint

I purchased this Vehicle last year and have had problems with this car since the day I left the lot. They said the problem would be solved once they fixed the engine. So pepboys, which is contracted witb Ganas was going to fix the engine but Ganas said their price was too expensive and they found another mechanic to do the job for cheaper. First they told me the mechanic was going to pick my car up with a tow truck because my vehicle was not in driving condition and when he showed ip to pick up my vehicle he was just dropped off by a young lady and he drove my car instead. I asked him about the yow truck and he stated that he couldn't find a tow truck to come to my area but that one was meeting him in another location. When he dropped off my vehicl,, same thing he didn't come in a town truck. But he brought me car back and I thought, for once I finally have my car back and it's going to be working. But no, that was not the case. I have had this car in and out of the mechanic since i got it back. They first told me that it was their problem and that it was a alternator problem which wasn't covered by my warranty. So I went ahead and fixed that. And the car still didn't work. So I called Ganas & they sent the car back to Pepboys for another diagnostic. They found that electric harness to the engine was damaged because who ever replaced the engine pinched the wires and damaged the harness. Ganas was going to have the mechanic who fixed the engine fix that problem but that mechanic wanted to send his own technician out to review the problem. Once they got there they immediately started to get upset with the pepboys mechanic & stated that this was not their problem & they refused to fix it. They took pictures & left. Ivone from Tricolor/ganas said he was going to call me once he reviewed the case. It's been weeks I haven't heard nothing. I have called & more than once I was hung up on, left on hold for more than 1 hr & then again hung up on.This has been a nightmareInitial Complaint

My car is overheating and not drivable. Ganas wanted me to drive from Pacoima to El Monte which is a 30 mile drive. I explained the risks that could come from driving a car that’s overheating. They didn’t help. I had to find a way to get my car towed and now I’m with a car. No loaner vehicles to offer my family of 7 to get around while my car is in the shop. I was lied to when I signed my contract and all they could say is you should have read the contract. Ganas is a scam and I want my money back.
