      6/6/2024 Our next door neighbor hired this company to replace their fence, without our permission they removed part of our fencing, damaged it without leaving at least a note. Replaced the fence/boards with cheap nails, split one of the boards. We have attempted to contact this company, was informed as of 6/8 that a repair Crew would be on Monday 6/10, no one one has been out. I have since called, emailed to no avail. We would just like our fence repaired. There is no reason why our fence should have been removed without our permission.

      Good Morning,

      I have included the email from our customer's neighbor as well as the civil code for neighbor contracts agreement. As we are contracted with one party it is upon the homeowner to send the 30 day notice. We had created a repair report immediately upon receiving word of repair needing to be completed. As the our repair crews have multiple appointment per day unfortunately the earlier repair need more time than expected to and crew was unable to make it to the appointment. We wanted to reschedule the appointment to be able to repair the items needing ( replace roughly 5 boards) but customer sent an email that we can not be on the property, which has left our hands tied.

      I am rejecting this response because: This is total fabrication. I have made several attempts via texts,  telephone, email. The last response I received was that someone would be out on Monday following the date that the damage was done. I have have yet to received anything but the attached email stating that they were working to get the repairs schedule, that it would be a few weeks or so. I one of my emails I stated that they should have never accessed our property without our knowledge when they were doing work on our neighbors house. Which is in the attached email. I can't get anyone to return my calls so I have no idea why this false information was reported. We want our fence repaired so it makes absolutely no sense for me to in turn say "you can't come on our property". That stated only applied to them accessing our property without our permission, to replaced boards without our consent is totally wrong, unacceptable. Very unprofessional. I have emails, text to support my claims. It's not allowing me to attach my emails (files too large) so I have copied/paste the last email sent.

       

      On Saturday I was informed that someone would be out on Monday. We did not request any services from your company so there is NO reason why our property should have been touched by your Crew. This matter needs to be addressed ASAP. This is the last time I will reach out to you regarding this matter.

      Once we received the email of work to be repair we immediately responded and sent that email that was copy and pasted in the the response of rejection. This was not a fabrication of any sort, I have included the email that is time stamped. We were told after that fact the customer did not want us to on her property we will not trespass after receiving any type of message of the sort. We will be more than happy to complete repair as previously stated we will go back to replace roughly 5 boards.

      This company owner was told never to come onto our property after damage done last year on a fence job for a neighbor. Regardless of this warning, they trespassed criminally trespassed onto our property again without proper notice as required by CCC 841, did not **** utilities per 811 hotline, removed 3 expensive trellaces and mature trellaced trees and destroyed/disposed of them or sold them for scrap. Cut all mature shrubs at ground level and killed them. Ripped out drip system and lighting system; removed/damaged/destroyed metal and wood artwork in back hanging on side fence.

      I do not see a contract under this name or address, we did contact **** though she was driving and was unable to speak. We do **** for utilities and our contract do state that we need to have everything cleared from the fence line at least two feet clearance including anything resting against fence line.

      I am rejecting this response because:

      1. The address of the fence work is **********************************************. We are the neighbor at 2023 Petruchio Way that shares this fence.

      2. We were not given the required 30 day written notice of the fence removal/replacement as required by California Civil Code Section 841. We were not in agreement to removal or replacement of this fence. In fact, we specifially stated that we did not want this fence removed or replaced for aesthetic reasons as desired by the neighbor and we advised Lifescapes owner of this a year ago when this same neighbor replaced another section of this fence and did significant damage to our backyard landscaping and lighting.

      3. I spoke with *************************** the *** Lead at ******************* Alert (811) in ******* and she stated, in writing dated 3/25 that " After some research I could not find an active ticket request in our database for or near address ***************************************." As required by law 811 must come to mark utility lines. The fence company did not get this job marked. There are significant utilities running along this fence as evidenced by ****************** box at the corner of this fence. Our electricity lines, gas line, and main water line run along this narrow area between the fence and our house. All utility companies have been notified and they all need to come to the property do do inspections to ensure no damage to these lines have happened. Appropriate complaints have been filed.

      4. The company trespassed onto our property and removed expensive trellaces and mature plants, as well as metal and wood artwork on a section of our back fence they replaced. They damaged our lighting and sprinkler drip system. It has been recommended by the utility company that they come out to inspect area and also for us to file a criminal trespass complaint, which we will do with **************************** Trellaces and artwork were not only removed from the fence, but removed from our property. Expensive, 10-year mature trellacing plants were cut to the ground level and killed. Substantial repair of our lighting and drip systems will need to occur, as well as removal of substantial time removing root system of plants cut to the ground so new trellacing and plants can be replaced. 

      5. Fence company did not have our permission to come onto our property, remove our expensive landscaping and trellacing and replace this fence. Had we been given the required 30 day notice under CCC Section 841, we would have vehamently rejected any replacement of this fence and removal and destruction of our property.

      If this matter is not settled immediately, we will proceed to file a police report and small claims action for said damage and request punitive damages. Last year when another section of the fence was replaced without our permission and damage was done (same property address on *********), we notified owner of Lifescapes we did not want him ever coming onto our property again for any reason. This was totally disregarded resulting in significant damage to our property and fence (see photos).

      We understand the neighbor's frustration, thier neighbor should have notified them with proper notice. As a contractor we are in communication with contract holder only. After speaking with our USA team (underground service alerts) as this contract was for a back fence line it was not necessary to mark as there are not any major line running from behind properties. The majority of concerns are coming from the street to the homes feeding the pipes from the front of homes. I have included the Civil code that was mention by property owner ;these are for property owner to property owner not including for a contractor.

      I am rejecting this response because: There are 2 erroneous statements:

      1. With respect to notice. Though it was not given by ANYONE in violation of this section, it does not excuse the fact this company came (criminally trespassed) on our property wthout our consent and committed intentional property damage by cutting to the dirt line and killing multiple mature, trellaced trees, removing expensive trelleces and metal/wood artwork, destroying landscaping lights and a drip system by ripping them out. This makes the trespass criminal in nature. Filing complaint with ********* PD to turn in to the bond company along with our complaint/request for damages that has already been submitted unless company agrees to settle itself for the damages.

      2. Though the fence replaced was the neighbor's back fence; it was our side yard fence that has our water lines, sewer line and gas line along the fence footprint. So it WAS required to have this marked, as the lines went from the street alongside our property along the fenceline into our side yard/kitchen area.

      We did have a crew sent out on 10/9 for repair we had not closed repair bc crew was unable to complete all parts of repair, we plan on sending a crew back asap. We will be replacing the 1 gate post, possible 1-2 end post and we will be taking a vinyl kit for the damaged boards. We should be able to have a crew out within a few business days.

      On May 9th, a neighbor (************************) and I contracted with Lifescapes (also dba Natco ********** Ca Lic # *******) to build a back fence. A few days later, ************************* from Lifescapes visited to bid on an adjoining side fence shared with another neighbor. I asked for the fence to match in style, material, and height to the back (**********) fence. On May 20, I received the proposal (Attachment 1).On May 23, I responded to the proposal asking, "is this fence the same style you are building on the ********** shared fence?" ************** responded, "Yes it is (Attachment 2).On May 26, I emailed ************** asking for a photo of the style. He emailed a picture matching the style of fence built on the ********** side. (Attachment 3).Unfortunately, on Jul ***** Lifescapes built a fence that does not match in style or height to the Leonadini side nor the picture ************** sent. Also, the work was sloppy - a plank fell off, site left messy. (Attachments 4a-e)On Jul 28, I called Lifescapes to discuss these issues. I was asked to send pics (Attachment 5). ************** asked "*******" to "schedule ... the repairs. (Attachment 6). On Aug 5 and Aug 13, I reminded the team I was waiting for a call to schedule. (Attachments 7-8). No response. On Aug 14, ********************* at Natco ***** called requesting payment. I explained the work was not completed. Finally, on Aug 15, ******* emailed they would NOT rebuild the fence to match the style because There were not specifications that we were matching any existing lines. (Attachment 9). I called ******* and informed her ************** sent two emails confirming the fence would match the style on the ********** side. She asked me to send her those emails, which I did (Attachment 9). I then received an email from a ****************** confirming they would schedule an inspection (Attachment 10). I am still waiting. I am asking Lifescape to rebuild the fence to match the style and height as they committed and to replace any missing planks.

      I am rejecting this response because: Matter is still unresolved. On Monday August 28th, I met at the property with **** from Lifescapes.  As mentioned in my original complaint to BBB, prior to signing the contract, Lifescapes confirmed twice by email that the fence would match the good neighbor style and height of the fence they built for myself and neighbor ********** a month prior. **** acknowledged it did not match in height or style and said he would let the office know it needed to be rebuilt to match.  A couple hours later, I received a call from ******* to schedule the work.  Given the circumstances, I asked if Lifescapes could write up a work order or description of the repair/rebuild work that needed to be done before we schedule the work.  Under the circumstances, I believe this is best for both parties so there is no further confusion about the work that needed to be done to resolve the matter.  ******* agreed to do this. I sent the Lifescaping team a summary of our conversation (see attached).  Three days later, on the morning of Thursday August 31st, I had not yet received that work order, so I called ******* back but she was on the phone. So I left a message on her voicemail. As of Friday, Sept 1st, I have not a received call back or, more importantly, the work order/description from Lifescapes as promised. As we are reaching the end of my opportunity to respond to Lifescapes response to the original complaint, and I am once again getting no response from the company, I am rejecting their response although I am hopeful we are moving closer to resolution.  I ask that Lifescapes send me that work order as they agreed and then call me to schedule that work. Once that work is completed, I will acknowledge that this matter is resolved with the BBB, pay for the work, and close this complaint.

      I am rejecting this response because: The repairs are not yet complete. On a positive note, we are making progress. Lifescaping has now agreed to rebuild the fence in the style and height of the adjacent (**********) fence as we originally discussed. I am waiting for them to call me back to schedule the work. As soon as the work is completed to match the style and height of the ********** side, I will accept and close this complaint.  I look forward to that being done.

      fence placed on May 25, 2023. At time fence was placed. Spoke with workers and called company and spoke to ******* informing her that fence was not per contract stepped or at different heights and large gaps between the ground and the bottom of the fence. ******* told me to let the workers go on that date and the repairs would be done in the future. At that time ******* arranged to send out contract writer ******* who on May 31 took pictures and agreed fence needed correction. Called and emailed company multiple times, requesting a repair date and repair plan in writing or adjustment to contract for fencing place versus ordered and broken sprinkler lines. documented by sprinkler company. No information came in writing and then I received a phone call July 5, threatening me and yelling at me from *******. He stated he was a supervisor. Multiple emails went back-and-forth and ******* stated if I did not make full payment by Friday, they would lien my house and send me to collection although I sent pictures of the contract was not complete and fence was not per contract. Per the contract also they would've needed to provide me with a preliminary notice 20 days after the work which they did not do . Family member heard phone call with ******* threatening me and multiple emails can be provided as well stating that he would not fix the fence and would kick dirt up to the fence if needed. I made payment today which they adjusted minus the sprinkler line, but the contract was still broken and I only made payment as I felt. I was being threatened and bullied.

      Our supervisor and I had done a three-way call with customer to go over issue and create a plan to move forward. I have attached the copy of contract for your reference, We do include in our contract on page 6 subsection 2 that we do not cover sprinklers line if damaged on installation day. Customer sent bill for repairs to sprinklers lines but we did agree and deducted that amount off her bill as curtesy. As for the conversation we has there was not any yelling unfortunately when discussing a plan to move forward customer was defensive and we did ask for her to make payment toward her project for us to complete repairs that Friday but customer made a payments of $2,000 then refused for us to complete repair. The customer wanted for us to slope and step her fence differently from how we installed. As customer solely want for us to do a price deduction to move forward ,we can not approve any more discounts at this time.

      I am rejecting this response because: the fence is not sloped and there are gaps larger than standards. I assume it is the same person responding that threatened me with a lien and collections. I have paid them in full because of these threats. Please see pictures and contract for sloped fence and I can send emails stating I  can "push dirt up to fill gaps and /or they would "kick dirt ".   I did not have them come and replace the "damaged boards"  that Friday as I am a single woman and could not have a company come do work in my back yard again when I felt management were being hostile. There were multiple texts and emails. This is not a 5 star company !!  No woman should have to pay in full  for a fence not done per contract.  

      I will proceed with the **** to show contract violations as well.

      I have see this had not been closed out, Customer wanted overall resolution for a price deduction. Our contact does include that we are not responsible for sprinkler damages but due to other issue we did cover cost of sprinkler damages attached to this response for total of $730. As well as sending a supervisor over to take a look on site for inspections of all repairs needed to be fixed we did try to come to a resolution. The account has since been closed out, if there is anything pending we will do our part to resolve issue asap.

      I am rejecting this response because:

      they did pay for the damage sprinklers, but would not come and repair the fence and threatened me with a lien on my house and sending me to collections. They refused to have somebody come out except to "kick dirt after the fence line to cover gaps . Fence was never done as promised per contract, and again I only paid as I felt threatened.I've sent multiple pictures showing that the fence was not stepped as per the contract, and they were large gaps, not up to industry standards.

      We hired Lifescaping through *********** THEY BROKE OUR SPRINKLER SYSTEM when installing our iron fence!Their estimator was very subpar, first didn't notice where our sprinklers might be, made us lose a lot of time. Then he filed a change order and made us spend extra money for special material promising no damage to our sprinklers but still broke our pipes.They knew there were sprinkler pipes in the area, and they know they broke those pipes but made every effort to use the contract fine print to walk away from the claim. I shown the sprinkler lines live to their crew many times, that's why there was a change order for special material.When I pushed more, their director of administrative operations sent me a cold and cocky email to shut me up. They acknowledge the presence of sprinkler pipes, but they don't own the damage. They claim the pipes broke themselves, coincidentally, after their fence work.I regret my decision to choose this company.

      We have completed section A on the contract, which is the only section the customer wanted to move forward with when we verbally confirmed the contract with him.  This is why we color code all contracts.  Section A is complete. 

      $1624.00 is due.  If the customer would like to complete the rest of the contract, we would be happy to proceed with section B and C once we have received payment for section A.

      I am rejecting this response because:

       

      The project is one project. This A,B,C stuff is a nomenclature invented by the business for their purposes. It is one agreement! Section A is not even the most important component of the project. I never expressed that I was only interested in Section A! In fact if I was prioritizing the order in which the work should have been done it would have been B then A and then C.

      Lifescaping said that work would start ibn **** weeks. It actually was about 15 elapsed weeks before work started.

      I don't understand why they are refusing to complete the project.

      It is critical that the gate on the other side of the house (what they call section B) be completed ASAP!

      A by itself is of no value to me!

      Based on my schedule they need to complete the remaining work between April 20th and April 22. I also am requesting that they install the keypad locks that I purchased. When I showed these locks to their sales person he said that it would not be a problem.

      We contracted with Lifescaping to build a fence for us in April 2021. Install dates kept getting pushed out because of no materials, and because they kept putting the wrong dates on their calendars. Scheduling was like pulling teeth. They agreed to a 10% discount for our trouble (which they now have no record of), and we finally had the main fence built on the 15th (after more discussions on whether this was the correct date). They could not do the post-replacement for one side because it wouldn't work, so they agreed to deduct that price from the contract. For the full fence on the other side, they didn't provide the builder enough lumber, and we have large gaps under a few sections as well as some very chewed boards on the top cap. They also got stain everywhere on our home and belongings and on our neighbor's. We took photos that day and sent emails that day to start the process of having this fixed. We got no response. For months. We tried and tried and tried. I was passed to a lot of different people in the months that followed. Finally we scheduled the repair for December 3rd. My husband stayed home all day and they never showed up. (They did call the day before to confirm.) We then got rescheduled to January 20th, and they neither confirmed nor showed up that time. I just got another email asking me to pay them, and I have reminded them - again - that they need to finish the job. We are at the point where we have to do it ourselves, and I want to deduct whatever we have to pay to fix it ourselves from what we owe them. I just got another email asking when I'd pay and what repairs are needed if any. I've been around and around and around with this company since July, and we cannot get them to finish the job. Can you help? We can provide many more details if necessary.

      ****************** original contract was for $7558.00.  When we were unable to install line item D1 (post Replacements) we removed that line item from her Sales order and reduced the contract price by $990.
      New contract price was $6568.  In an effort to thank her for her patience with the delays and rescheduling which occurred with her job due material shortages,Covid cases among install crews and supply chain issues, we credited her job by 10% which is reflected on the Sales order (-$656.80).  Bringing the balance to $5911.20. The complaint was issued on 2/2/22.  On 2/7/22 a crew was dispatched to complete the repair.  To the best of our knowledge, this job is complete.

      Lifescaping partially completed a fence project when they admittedly struck and broke a water pipe. They refused to repair it and left my residence without water for a full day. It also cost me a full days work as I had no running water and had to resolve the issue. They told me I had to pay to have a plumber come out to complete the expensive repair because they werent liable for sprinkler lines. The line actually feeds my hot tub and is not a sprinkler line. I spoke to ******* and **** who were both completely unprofessional, discourteous, and refused to take any accountability for the damage caused by their employee. **** also advised, after I mentioned that I would file a complaint with the contractors licensing board, that if I did so, they would not complete the front portion of the contracted project (the non-neighbor portion of the fence). He also refused to provide the names of the employees on site (required by the state licensing board). I made arrangements to have a plumber come out to make the repairs and will be forwarding the invoice to Lifescaping for payment. Neither **** or ******* came to the site to inspect the damage.

      I have attached our contract with *** & ******************* of 100 *************** in ******, ** 95630.  There are several spots on the document which require initials and signatures.  I have highlighted the relevant areas as well as their initials accepting the conditions.

      In particular the Installation Overview.  Item 2.

       

      The General Terms and condition ( which require a Customer Initial) as well as the Installation Overview speaks to releasing Lifescaping's liability for any underground lines (non major utility lines which require *** ******************** Alerts)

      The Installation Overview Section 2 state:  " There are some underground items that only the homeowner can identify.  The utility companies do not **** these, and Lifescaping is not responsible for damage to them......locations of:"

      We have a couple of issues with a fence that was installed at our little league field. We have tried reaching out to Lifescaping many times and we have not heard back from them since we paid the ****. We would have liked to work with Lifescaping without making this a public issue but here we are.I apologize beforehand if I do not use the proper terms. The chain link fabric appears to be installed upsidedown compared to the existing fencing. The **** (sharp pointy) part of the fabric is sticking up above the pole by more than an inch in spots. This is a safety issue in my opinion because this is a little league field where kids play. There is also a minor issue with the gates. There also appears there MAY be a broken pipe. I know what you said in the contract, that you are not responsible. But IF you did break a pipe, it would have been nice to tell us so we can make arrangements to fix it. I would love to work this out with the contractor.
