      Lifescaping contracted to install a fence at my residence on 9/13/2021. The work began 9/13 and on 9/14/21 when I got home from work the crew was wrapping up the job. I immediately noticed a big chunk was missing from my newly poured concrete. I pointed this out to one of the workers, I think his name was **** and he just blew me off. I reached out to the repair team to address multiple issues which included the damaged concrete. They did come back to repair everything except the concrete to my satisfaction. When I followed up with the repair coordinator via email regarding the outstanding concrete issue she replied with "Unfortunately sir we will not be doing any concrete work besides what is needed for the fence we are not contracted to do more than that". This was complete negligence that resulted in damage to concrete that I paid to have poured a couple of months prior to the fence install.

      Good afternoon,  Unfortunately concrete is quite often disturbed during fence installations. While we are as careful as possible, the use of heavy equipment and dislodged material can cause unavoidable damage to concrete pads,walks, driveways, etc. Under the General Terms and conditions on the contract, it states, "You (the customer) agree that ********************** holds no liability for property lines, easements, landscaping.....driveways, walks, curbs, concrete...."  We are glad we were able to address your other concerns, but we are unable and not licensed to perform concrete repairs.

      I am rejecting this response because: *********** hardly has the right to exempt themselves from any liability resulting from their employees negligence. They have a duty to take care when working on peoples property. I have had many fences replaced during the course of my lifetime and I have NEVER seen such blatant disregard for someone elses property. This was completely avoidable had they shown the slightest care. I do not accept this response. The concrete was only months old, clearly care should have been taken and was not.

      I have had my fence replace around my entire property. Well over $10000 for my project. I have called several times. No answer or call back. My lock on my gate wont close, my gate door os getting constantly jammed where it wont open. I have go kick it open. I have gaps on my fence and my wood is rotting already.

      Fence was quoted in May and installed in August. Since installation, the fence boards have been falling off due to poor installation. Many nail missing stingers completely. Now, fence is warping and large gaps are appearing. I have attempted to resolve this with the company, but they have been slow to react. Initially, I held back payment, but was threatened with collection action if not paid. So, I paid the invoice and have been pretty much ignored since about my complaints. This needs to be completely replaced.

      I am rejecting this response because: The work is NOT complete. While the cosmetic portion is fixed, the underlying issue remains. We were sold a product that does not meet the standards the company set forth. We were given  inferior materials for the fence and we will continue to have problems until a middle ******** is installed that will help control the warping that will inevitably continue to occur. 

      Also, I called the company back when I was left a voicemail about the date for repair and left a return message (because nobody answers the phones there) and let them know that the date would not work for me.  However, a repeat team arrived and climbed over our locked fence into our yard  I believe that is trespassing.

      We called the company in response to their repairs and sent an email with pictures they requested on the 29th and have yet to hear from them.

      I will consider this matter closed when the above repairs are complete at Lifescapings expense or we receive a partial refund to complete the work ourselves

      I have attached the customer's contract. **************** contracted for a 7' tall 2 rail Dog Ear (DE) fence with a 2x12 inch pressure treated kickboard.  The Dog Ear fence boards are 6' long.  2 rails are standard for 6' tall boards. While a 3rd rail will definitely strengthen the fence and prevent future warping of the fence boards, that is not what he paid for.  If the customer would like, we can reach out to his sales representative for a paid Change Order to add the 3rd rail.
