      In 2022, I requested Clarke & Rush Mechanical to delete my data (PII), under the **** law for CA residents. We are using the address they have listed in their system where they are still mailing things to us. This request was made to *************** and ***/Operations Manager. We had a very bad experience with this company and the way we were treated when we spoke up about this. Rod in particular was very disparaging toward me and as a bi-racial family, we felt very targeted. The last it was left was the company said they would comply with the **** request and delete the data. However, today several text messages were received by *** the owner of ***************************** trying to get us to do business with them again. I called the company and spoke with a new CSR who said she was only there two weeks but did dig deeper and tell me all my data was still very much in the system, and that it was just "flagged" as "do not contact". The business clearly did not do what they are required to under the **** law nor what they agreed to with the 2022 BBB complaint resolution they agreed to, which was to fully delete from the system. After a very long hold, I finally got passed to a very rude unprofessional "supervisor" who was rambling because she apparently is not aware of the company's retention policy for certain data. She mocked me saying "all the "men" are out of the office". Because I had shared with her my experience dealing with *** and *** two years ago. Rather than saying she would look into this and get it resolved, she went silent and then hung up on us. My husband tried to call back several times but they would just pick up and then hang up. We feel very harassed by this and do not understand why they will not just fully delete the data and leave us alone. We have had zero contact with this company for two years since the BBB complaint resolution they agreed to. Until today when we were texted several times by the owner.

      In 2012 we did a deep-energy retrofit with Clarke and Rush (C&R) taking the lead on and coordinating the project, we spent over $40000 directly to C&R. C&R supplied the ***** added insulation, buried existing ****-era HVAC plastic duct-work in it and installed new windows. Top of the line, split-system Carrier Infinity HVAC installed along with lifetime warranty Cascade windows. C&R HVAC service plan purchased/followed along with fastidious/educated long-time homeowner maintenance/upkeep. Excellent Carrier Infinity HVAC system but it did not stand a chance of acceptable longevity with C&Rs questionable design/oversight.Since the 2012 HVAC install; The furnace combustion blower failed 2015, the air conditioning evaporator coil failed/started leaking 2016, the A/C condenser fan/capacitor both failed 2023 and the ORIGINAL to the house flex HVAC ductwork that was not replaced has sprung various leaks. Plastic flex duct-work only lasts 10 to 20 years. C&R replaced some of the failed HVAC parts under warranty over the years but we paid the replacement labor. Come to find out that our aged return ductwork was too small to adequately supply the high-end HVAC system that C&R specified out in 2012. Not replacing or suggesting that crispy plastic ductwork from **** be replaced in 2012 did us no favors either. As of 2020; 10 of the 21 Cascade brand windows that C&R replaced/installed have failed / failing seals that result in fogged glass and energy inefficiency. Lifetime Warranty through Cascade & 10 year through C&R unfulfilled. We filed a warranty claim in 2021 and have had ONE window replaced so far in 2023. C&R has refused to intervene on this problem with their window vendor. Once the manufacturer warranty was done, suddenly limited HVAC service available (as in weeks for appointments in the slow HVAC season) Contacted *************** (Owner) personally over a month ago. No response.

      On December 8, 2022, I telephoned ****************************** because I did not have any hot water at my house, my toilet was running and my garabage disposal were not working. They sent a plumber over. He told me if I repaired the water heater it would be approximately $ 935, with a 30 day warranty. If I bought a new one it would be $2700. He said don't bother to contact **** Brothers or any other company, because they are charging the same thing. I thought and wondered why they were so expensive. The existing water heater was installed in May 2008 for $ 800. He explained how they were installed now and since you had to build onto the house, it required a building permit from the county. I had him install a new water heater, since the existing one was 14 years old. He tested the garbage disposal it suddenly started working again. He tried to install a rubber flapper, however not him nor his assistant were able to put it in by themselves. I had to help them , because their arms were to large to fit under the counter above the toilet. The plumber told me they would have to take the back out of the toilet for about $ 235 so that they could install the flapper. Since then the toilet is even more noisey. When he came by the house the next day with the permit I spoke to him about the toilet making so much noise. He said then it is something else. I can't remember the name of the part he said. The next day I telephoned the supervisor of the plumbers ***. I told her I paid $2700 for the water heater installation. She sound surprised. She said she would talk to the manager about this. When I spoke to her later she said the only thing he did wrong was he forgot to give me my senior discount of 10% . The inspector came out a few days after the water was installed. He was shocked by how much i was charged. He felt that ************************** could possibly be giving incentives to charge so much. I have tried to reach *** several times, she is not returning or ansering my calls.

      A/C had problems working so I called Clarke &Rush because they said they specialize in Carrier which we have so on 8/9/22 they sent out a tech when he arrived I explained my issue after that he said he knows what it is I told him that I think he needs to go to unit in attic and he said its not the issue $275 later he said its fixed next day its frozen again the next tech says its your blower Moter ok he ordered it $1700 it will be another week when he gets back and goes to swap turns out that its not the motor now its the *** so the order and schedule appointment part comes in and come to install 3 hrs later we have problems not right part be back at 8 tomorrow that doesnt happen now its Wednesday and Im taking time off without pay because they said they were coming now they called and said lets schedule next week I called and demanded an earlier appointment because I have been dealing with this during the extreme heat nothing was offered no portable a/c so as it goes the next technician shows up and says its a txv but again the wrong part the first guy charged me $275 for Freon and caps which was not right now they said its the *** and replaced for $1200 6 hrs later I have same problem air not working and unit freezing up so I call and get 24/7 people no help so I call again at 8am the technician calls back and then comes over to find out its a damper problem so I have been buffaled they have replaced parts that were not the problem and Im $1500 in and still not fixed not happy with this company # still not fixed

      We have contacted ***************************, we believe we do know what the issue is and have scheduled an appointment for 10/4/2022. Hopefully the outcome of this appointment will have him withdrawing his complaint.
