On April 11, 2023, Juul entered into a $462M multi-state settlement with the Attorneys General of California, Colorado, the District of Columbia, Illinois, Massachusetts, New Mexico, and New York in addition to the DOJ, the Los Angeles County District Attorney's Office, and the County of Los Angeles.
The settlement stems from allegations that JUUL targeted young people through advertising and failed to give warnings about the product’s chemical exposure and risk for cancer, birth defects, and reproductive harm. The complaint also alleges that JUUL unlawfully failed to verify the age of California consumers and then violated privacy rights of minors by keeping the personal email addresses of underage individuals who failed age verification on their website and using those emails addresses to send them marketing materials.
As part of the settlement Juul is prohibited from targeting youth in any of their advertising or from using social media influencers to promote products. In addition, Juul can no longer sell Juul Pods at a nominal price and must limit the number of online purchases an individual can make. On December 6, 2022, JUUL Labs entered into consent agreement (MER-L-002088-22) brought against the company by the Attorney General of New Jersey and 33 other states.
The consent order stems from allegations that the company’s marketing and sales practices were aimed directly at children by engaging in advertising campaigns that appealed to youth, marketed younger users on social media, sold flavored products known to appeal to younger users, and relied on an age verification technique that was known to be ineffective.
In addition to JUUL Labs paying over $434.5 million to resolve the matter, the company has also agreed to refrain from the following:
- Youth marketing
- Funding education programs
- Depicting persons under age 35 in any marketing
- Use of cartoons
- Paid product placement
- Sale of brand name merchandise
- Sale of flavors not approved by FDA
- Allowing access to websites without age verification on landing page
- Representations about nicotine not approved by FDA
- Misleading representations about nicotine content
- Sponsorships/naming rights
- Advertising in outlets unless 85 percent audience is adult
- Advertising on billboards near schools or playgrounds
- Public transportation advertising
- Social media advertising (other than testimonials by individuals over the age of 35, with no health claims)
- Use of paid influencers
- Direct-to-consumer ads unless age-verified, and
- Free samples.

On December 4, 2019, the Minnesota Attorney General’s Office filed a complaint against JUUL Labs, Inc., Case #: 27-CV-19-19888. The complaint alleges that JUUL violated multiple state consumer protection laws, breached its duty of reasonable care and created a public nuisance.
The complaint also alleges that JUUL was negligent in its duty to correctly verify its customers’ ages, as required by Minnesota Law, and turned a blind eye to the fact that its controls were not working and underage Minnesotans were purchasing JUUL products.
The case is currently pending.
