- Pending Government Action:Government Action: BBB reports on known government actions involving business’ marketplace conduct:FDA v Prime Vitality, Inc.
On December 10, 2024 the US Food and Drug Administration (FDA) issued a warning to letter to this company. The letter informed the company that the FDA had reviewed their website and social media sites which direct people to the company's website to purchase products such as Semaglutide and Retatrutide. These products unapproved new drugs introduced or delivered for introduction into interstate commerce in violation of sections 505(a) and 301(d) of the Federal Food, Drug, and Cosmetic Act (FD&C Act), 21 U.S.C. 355(a) and 331(d).
Despite statements on their product labeling marketing their products for “research purposes only” and “not for human consumption or clinical use,” evidence obtained from their website establishes that the products are intended to be drugs for human use.
