      There is absolutely no record of any request for information made to Financial Network Recovery by the maker of this complaint. Financial Network Recovery is a licensed full service Collection Agency that represents several various lenders who place unpaid consumer and commercial matters to perform debt recovery services. Primarily, none of the obligants will have a "contaract" with Financial Network Recovery as noted in the complaint. A lender has the legal right to employ the third party services of a Collection Agency or Collection Law Firm to perform debt collection services on their behalf when obligations go unpaid. Financial Network Recovery can, does and will provide whatever reasonable documentation that is requested by an obligant. In this case, we simply have not been asked.

      I am not liable for this debt with Credit Union of Southern California. I do not have a contract with Financial Network Recovery, they did not provide me with the original contract as I requested. This is a fraudulent account. Someone stole my personal information to obtain an account in my name.

      The support documentation already provided includes the signed Agreement, Proof of Address, California issued Drivers License, Paystub, Soc Sec Card which were all provided to the Credit Union when establishing the accounts that lead to the related debts along with copies of the standard bank statements that the Credit Union mailed thereafter. Further, contrary to what these BBB Complaints state, there does not have to be a contractual relationship by and between the borrower and the third party collection agency and/or collection law firm providing collection services to it’s clients being the original lender. This is a simple google search that would easily expose that lenders can employ the services of  third party collection agencies and/or collection law firms to effectuate debt recovery when the borrower fails to meet their contractual obligation to repay their debts. Please contact the original lender or our office as we only wish to work together to resolve whatever matters we are impacting. Thank you.

      I am rejecting this response because:

      I've read the collection agencies response trying to justify their position in this matter.  I never ever in my life did any business with the company their collecting on behalf of.  This collection agency does not have any of my personal information except what they can retrieve from public records.  They have nothing with my signatures from the original company nor themselves.  I've been a victim of ID theft for many years now and this is another such occurrence which I am once again a victim of ID theft, but what's interesting, this collection agency is claiming they have such evidence, but I've never been presented with anything.  Because they have nothing solid except for what they were able to retrieve from public records about myself.

      At the end of the day, as per the Fair Credit Reporting Act, (FCRA), it is important 

      to note that a collection agency, (Financial Network Recovery), cannot collect on behalf of another company without a contractual agreement in place between myself and the collection agency.  

      Therefore, I request that Financial Network Recovery provide proof of such an agreement before proceeding with any further collection attempts.  Please be advised that failure to provide this documentation may result in legal action being taken against your agency.  If you cannot provide me with any of what I requested above, I ask that you permanently delete this fraudulent account from my Experian Credit Report immediately.

      I look forward to a speedy resolution.

      We can only “soft reply” in this forum and will do so herein: Claimant states  that our organization processes “nothing with my signatures from the original company nor themselves” which would leave one to only assume that Claimant did not read the reply that he “rejects” because our previous reply emphatically states that we are in possession of multiple supporting documentation provided to us by the original creditor that not only bears his signature but could have only been obtain by the original lender from the claimant including his pay-stub. These documents have already been sent to Claimant and we are happy to send them again.

      Lastly, there is no such requirement as a Contract/Agreement that would exist between the borrower and the third party collection agency nor third party collection law firm. No such thing exists because if what Claimant is professing were true regarding “contractual agreement in place between myself and the collection agency” there would be no third party collection agencies nor third party collection law firms. No consumer would sign an agreement empowering a third party to collect or litigate against them. Our previous reply even suggested simply googling this topic leaving us to again, assume that the claimant didn’t read what he “rejects.” Therefore, in response to : “Please be advised that failure to provide this documentation may result in legal action being taken against your agency.” Consumers are entitled to representation and should seek counsel to assist in their understanding and interpretations of applicable laws and requirements relating to the FDCPA and FCRA.

      I am rejecting this response because:

      First of all, what I stated to the third party collection agency collecting in behalf of the original credit is facts. It’s in the FCRA, which is what this said collection agency is supposed to follow. It’s just funny how this collection agency is skating around this fact. 
      another thing, I don’t have pay check stubs. I’m an owner. When I apply for anything, I have to provide tax returns. 
      This is why I filed the ID Theft Police Report and FTC ID Theft Affidavit form. My identity was stolen. I never applied for anything with the credit union this collection agency bought the debt from for Pennie’s on the dollar. 
      But instead, this collection agency is doing nothing but gaslighting acting like they have evidence and acting like they’ve sent me information for me to verify. They have no information for me to verify that is actually mine because my Identiyy was stolen!!!  Again, I’m no employee. I’m an owner and have been one for many years and have the proof to back up everything I’m saying. 
      Bottom line, their argument is like pitching straws hoping something is going to stick. 
      This has been going on for far too long at this point. Their trying to make a case trying to justify their actions and their position in this matter when clearly they have none. 
      Whomever wrote this response from said collection agency never stated that what I found in the FCRA, which is what all creditors and collection agencies are supposed to be following is not factual.  Their doing nothing but gaslighting acting like their the original creditor with my signatures on something when clearly they don’t have my signature, they don’t have my paycheck stubs because I’m no employee, they have nothing but my ID Theft Police Report, FTC Affidavit form, and yes, they now have in possession my ID because I sent it to this company. 
      Again, this is all gaslighting. 
      REMOVE YOUT COMPANY FROM MY EXPERIAN CREDIT REPORT, PLEASE AND STOP ALL THIS GASLIGHTING.

      I am not aware of this account. I have reached out to 3 Bureaus and FINANCIAL NETWOK RECORD to have this account removed from my file and they are always saying the same excuse, which is no longer acceptable. I have filed an FTC complaint because I believed this is an outcome of Identity Theft. Regardless of all actions done on my end, there was no action from 3 Bureaus. Thus, I am reaching out to seek assistance to have FINANCIAL NETWOK RECORD confirm that I have no account with them and Equifax and Transunion Bureaus can simply remove it from my credit report.

      As a full service Collection Agency that prides itself on a verifiably flawless record paying acute attention to detail and compliance standards, we cannot confirm of deny, in an open forum such as this, if there is or is not an active file or files in our office due to third part disclosure concerns. However, this complaint is clearly expressing dissatisfaction with the various credit reporting agencies and their lack of response to concerns allegedly raised with them.

      Generally, when a dispute is levied with any of the credit reporting entities, the reporting party is notified and required to respond or any such reporting must be removed. Financial Network Recovery (we are not “FINANCIAL NETWOK RECORD” as noted in this complaint) has never received any such communication from the author of this complaint nor any of the credit reporting entities mentioned therein. Based on the named company, which again is not our name, it appears that this matter is misdirected at our company. Note: when a third party collection entity such as ours and/or the collection law firms we employ, submit credit reporting, right below our names, the original creditor is noted quite clearly. Therefore, given that we are not “FINANCIAL NETWOK RECORD”, there is no mention of the original creditor that companies like ours would be reporting on behalf of and that we have never received a call, letter nor dispute notification from any of the credit reporting entities concerning Mr. Kay, we can only offer to contact Mr. Kay to see if we can assist further. That attempt will be made today using the contact information provided by him in this complaint.
