    My parents, in their 80s located in ******, ** in San Diego County, have a termite issue & so they called DAV Termite & Pest Inc. They suggested a TimBor treatment that came with either a 1-year warranty for $925 or 3-year warranty for $1,500. My parents opted for the 3-year warranty but the rep didn't have an agreement for the 3-year warranty he was offering. Instead, he took the 1-year agrmt., scratched through parts of the document and changed 1 year to 3 years. My parents thought everything was fine & so they made a $100 dep., however they couldn't read the fine print at the bottom because at their age the text was too small. A couple of days later a tech came over to do the ************** brother came by. He noticed that the fine print all related to a 1-year warranty & that it did not include what was promised with the 3-year warranty. My mom called the company office to pay by credit card but asked that they first bring over an addendum to the agreement. that included everything verbally promised since it wasn't in the 1-year agreement. they had been given. When someone called back, my mom was treated rudely, threatened with a lien against their property, & hung up on. My mom wanted to make payment & all she was asking for was an agrmt. that matched what she had been promised verbally.After my mom was treated rudely, ******** dad decided they did not want to do any more business with them & wanted to change the 3-year warranty to a 1-year warranty. They'd still pay for the service in full but for only a 1-year warranty. They wanted to talk but my parents are older & this is very stressful on them & so they asked that I handle it for them. My mom called to give them permission to talk to me but they tried to get her to talk about the situation but my mom reiterated, "please talk to my son, his number is 818," and then the company rep interrupted & said "we're just going to turn this over to a 3rd party to handle" and they haven't talked to us since.

    Better Business Bureau:

    I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution would be satisfactory to me.  *********** decided to void the contract and refund the $100 deposit without pursuing their threats of liens and collections. We did not ask them for the refund because we were willing to pay for the service and the one year warranty, but since they are very difficult to deal with and they were not willing to find a reasonable solution, we have decided to accept their offer and we consider this complaint resolved.

    However, this whole thing started because they did not have an agreement for the three year warranty they sold my parents. They gave a lot of verbal promises and asked my parents to trust them. As the BBB knows, that is not how legit businesses operate, and so please tell them that they need to create a three year warranty agreement if they're going to continue selling that option. Both the ***************************** and the Contractors ******************* require everything be in writing and that nothing is just verbally promised, and so I'm not sure why they've been operating like this.
