    This management company is in charge of the ************** *** in *******, **. ***************************, their manager, admitted over the phone the neighborhood has been neglected by the *** they manage for years. There is over two years of documentation from residents requesting accounting information showing where there money has gone. Residents have been stonewalled, ignored, and no documents have been provided. Each residence pays $80/month. This, multiplied by the number of residents and and the number of months and years we have been forced to pay without receiving any services, is thousands of dollars.Attached below are just a few of the emails sent in attempts to request refunds and accounting documents. I also have a screenshot of all emails sent to the *** to show the extent to which I have attempted this on my own. I am a teacher with moderate income, and they are stealing from me at this point.

    The Association shares no contractual relationship with the person who filed the complaint.  The complainant does not pay assessments directly to the Association.  Elevation Community Land Trust (ECLT) is the recorded owner of your Lot and ECLT pays assessments directly to the Association.  ECLT likely then charges that assessment to the complainant,as the owner of the improvement on the Lot (the townhouse). 

    The Association Declaration requires that in order to qualify as an Owner, that person must own a fee simple interest in the Lot.  The Lot is defined in the Declaration as any plat of land shown upon any recorded subdivision map of the Properties with the exception of the Common Area.  As ECLT owns the fee simple interest in the Lot, ECLT is the recognized Owner and Member of the Association.  The complainant does not own the Lot and is not an Owner or Member of the Association so any refund requests should be directed to ECLT, not the Association.  As the Association is not the correct party to seek reimbursement from, this is not a valid legal claim against the Association.
