I requested a refund as I did not receive the initial consultation due to scheduling issues on my end unfortunately I do not have time currently to schedule something reliably as a result of that I am requesting that I have my money refunded through this form as having done so in other forms has resulted in nothing

We would like to request a full refund for the charges we incurred at Robinson and Henry for ***** ****** and **** ******* for matter ***** for $6,322.80 and matter ***** for $14,369.88. I will just get straight to the point. We hired ***** ****** back in 2022. During this time **** ******* was supervising the case(s). Things starting getting complex with ******** and our cases were moved to ****** ******* and **** *******. During her two short months she was able to accomplish more than anyone else in the past 2 years. When ****** ******* left, **** ******* and ***** ****** reassured **** and I, that ***** ****** was the best candidate for the case(s). After months and months of getting the runaround, in the beginning of January 2024 **** and I went to ************** of ****************************** to make a complaint against ********. When we spoke with the department they were appalled that the firm had not filed anything in a court of law. We were advised to call the ********************** and make a complaint against the involved attorney with the *****************************. After **** and I filed the complaint against ********, in late January 2024 one week before the response to ******** was due through the ****, ***** ****** email us and stated he was not well diversed in Bad Faith claims and could no longer help us. He stated we needed a new firm to represent us. We had to send a letter to the firm firing the attorneys ***** ****** and **** ******* so we could even speak with Allstate first ******* a result while looking for a new firm for the issue of Legal Malpractice, Breach of Fiduciary Duty, Breach of Contract, Breach of Trust, and Fraud that has come up. We have received a formal denial letter from ******** for our claims. This further makes this issue dire because we can show the firm has caused us to lose our claim. We have now seen ****** review that show this is a pattern for the firm.

Hello Ms. *********************** acknowledge your demand for a full refund, but our formal review compels us to decline your request because it lacks justification. 5-13-24 I hired a lawyer to provide a service. According to their accounting department I paid a total of $17,555.07. After around three weeks the service still hadnt been provided. Originating from a health and safety issue, handling the case in a timely manner was vital for my well being. Another attorney was assigned to my case in an effort to expedite my concerns. The lawyer did not help me and made the situation much worse by providing bad information and requiring me to take out an addition case that was related to the original filing. After my case had been closed I entered a dispute discussion with ***** ******* ****** who told me a full refund had been sent. A full refund is what I requested. I did not receive a full refund, I received a partial refund. Although I did receive checks in the mails two of the four checks had been cancelled by the maker. When I reached back out to ***** on December 11th she claimed a courteously refund had been sent and didn't acknowledge our previous agreement. I do possess recordings and transcriptions of these discussions to highlight the numerous discrepancies. The accounting department made errors. The entire experience with Robinson & Henry felt like I was pulling teeth. After my initial consultation I received texts suggesting that this law firms "helps" clients, not in my experience. I would like a member of the leadership team to resolve my dispute by honoring the full refund that I was orginally told I would be receiving on 11-22-24. I do have a ****** drive file that contain exhibits that support my claims.

Dear ************************************* provided from your Robinson & Henry legal team was the same top-level representation we provide to all of our clients. We worked with you through all aspects of both of your case matters with us. Unfortunately, you chose to disregard recommendations from your legal team, which negatively affected the outcome of your case. We still stood by you until the final resolution of your cases. After our thorough investigation, we find that all work and billing of your case were valid and in accordance with the client agreement that you initially signed when engaging our representation.

Robinson & Henry, P.C. strives to provide the best legal representation to all of our clients. Our goal is to always achieve the best outcome possible for our clients. We are sorry that you feel we fell short.

I am rejecting this response because: During the dispute process I was told a full refund was being issued to me. I agreed with this resolution and was told that the matter was done. The terms of my refund changed at some point without my knowledge or agreement. When questioned about the cancelled checks ***** expressed the law firm wasnt in a position to shovel money. A direct contradiction to our previous discussion. ***** ******* ****** was the person communicating terms of the dispute. Although I did receive a phone call from this law firm 12-6 it was not reviewed or answered. ***** ******* ****** had used verbiage that expressed our dispute was finalized prior to this communication. There are some spelling errors in the transcription. Final resolution discussions took place on the phone . No one was physically standing beside me during that process. On 9-4-24 I signed papers after asking ****** *** to exit. ****** stood next to an empty chair as I distanced myself from his physical presence on 9-4-24.

I did not follow or agree to dangerous advice. Prior to this I did ask my attorney for direction and instructions- I followed those recommendations and communicated when I couldnt. After receiving little input I felt it was necessary to question him directly. Mr *** provided bad information and did not have my best interest in mind , regarding my experience. This information is based on my records, documents, and best knowledge.

    Sincerely,

Hello Mr. ******************************************** & Henry agreed to provide you a $5,000 refund as a result of your formal billing dispute. On November 14, 2024, we processed a check in that amount as well as your trust refund of $3,414.00. On November 22, 2024, you informed us that you had not received the checks, so we stopped payment and reissued the checks on November 25, 2024. Upon receipt of the second check, you deposited it and attempted to deposit the first check, which had been cancelled. Although we acknowledge that your demand was for a full refund, our formal review of your case found that it was not justified, as the work that was done was at your specific request. If you disagree with this resolution to the process, your contract with our firm provides you with the option to seek binding arbitration.

Hello Mr. ************************ previously relayed to you, our firm refunded $5,000 to you as part of our formal billing dispute process. We have never offered to refund all of your money. If you believe that the $5,000 resolution is unfair, we encourage you to participate in the binding arbitration process outlined in our written contract. We would also like to point out that the firm refunded $3,414, which was the trust balance from your other protection order matter handled by the firm.

Hello Mr. ************************************** & Henry is a full-service, general practice law firm with many attorneys in our eight Colorado offices. However, only a small number of our attorneys practice in the area of law that you retained our firm for.

As you are well aware, you were never promised that your matter would only cost $4,500. In fact, we agreed that your matter would be handled on a refillable retainer with a minimum trust balance of $4,000. We are happy to provide you a copy of that agreement if you no longer have it. The agreement required you to refill the retainer after each invoice (twice a month), which you did for the first three months of representation.

Robinson & Henry only withdrew from your matter after you made it clear that you did not wish for the attorney assigned to your case to continue working on it and informed us that you did not wish to continue paying for representation. Your demands created that situation that we could not resolve for you while continuing representation.

Finally, you were invoiced $12,361 for the work done on your case (including expenses). You paid $12,315. We wrote off a total of $566 worth of work and returned $3,518 to you, which was the balance in your trust after the write-offs.

Although we requested for you to participate in our formal billing dispute process, you refused to do so. The offer to participate in that process is still available to you, and we will provide all of the financial data related to your case to assist you. We strive to treat all of our clients and former clients fairly, and the dispute process is the forum where we can review the work and any evidence that you may present.

I am rejecting this response because:

RH response contains misleading and false claims.

RH did not disclose only a small number of attorneys practice tenant law.  In reality, only 1, located in *****************  RH ****** advertising claims the opposite.

Kayla Benzali verbally agreed that such an easy case should not exceed $4500.

Never asked for or agreed for RH to withdraw from counsel.  Note, attached emails dated 9/12.  I was informed of the termination from the itemized invoice a week before trail.

RH billed over $12,000 for an easy $1300 deposit return case and quit before trial.  This is way out of industry norms.

I participated in billing dispute with *****-******* ******, without resolution.  refer to attached emails.  RH billing dispute process has no intentions for compromise.

I am negotiable to any legitimate resolution process.  But clearly, ***** and her team has taken her billing interests over her clients.

    Business Response

    Date: 07/05/2024

    Dear ****************,

I am writing in response to your recent Better Business Bureau (BBB) complaint. In your complaint, you expressed concern regarding the legal representation as well as the overall amount paid to our firm for the services received. You are requesting a full refund. In our July 2, 2024, telephone discussion, you also explained that you had to borrow money to pay for your legal fees and were unable to continue paying for our legal services.

We have investigated your concerns and found that all legal fees billed to you for the work completed by the legal team to manage your case were valid and in accordance with the client fee agreement that you initially signed with our firm. There was a considerable amount of work completed by the legal team before you asked us to withdraw. We immediately began the process of closing your case when you instructed our firm in writing to immediately close your case because you could no longer afford the legal fees. As I previously stated, all of the charges were valid; however, as a courtesy to resolve your dispute, we have written off the current balance due on your matter. We hope this gesture will assist you in the future should you complete your legal needs with another firm.

We are sorry that Robinson & Henry, P.C. was not a good fit for your legal needs and wish you luck with your continued legal representation search.

    Best regards,

    Hello ********************,

We are responding to your recent complaint to the Better Business Bureau (BBB). Our records show that we did receive your payment in the amount of $250.00 on May 21, 2024; however, you did not complete and sign the client engagement agreement at that time. Please accept our apology for the misunderstanding, and we look forward to working with you on your matter.

I hired *********************************************** to do a job. I was assigned a lawyer after asking for a tough one, I had an associate deal with everything. the lawyer ****************** billed me for meeting with me, didn't happen. after ten months and a complaint she finally gets involved and now I have a guardian. OMG I had an eval that was tainted by a Public Defender, I'm not sure how much ***** had to do with that but it all fits that they both wanted off the case. She is now asking to be released form the case through the courts, where did all my money go. over ********* I spoke more to accounting. Not one thing was filed in time so the complex is suing me now and I've had to pay for their lawyers and mine. $25,000.00 of my disability and now that she's got everyone all stirred into the drama she backs out. so I end this relationship being penniless and my home being taken away for the miscommunication and refusing to let me in on what is happening. A hearing was held a few days ago and I knew nothing about it!!!! No mail no call no e mail...mainly because I have this stalker that I have told everyone about and everyone thinks I'm crazy. How sad that this world has come to this type of business dealings. very dishonest at the cost of my home and my life! after 23 yrs. in my home I will now be homeless and I was only trying to help the others that had already been beaten down by standing up for what I thought was right I have papers to support just not with me.

    Business Response

Hello, first, we believe that ******************** has misstated some of the facts.  Foremost among them is that she has paid our firm less than $8,000 to represent her in a dispute that *** go to trial. We are happy to provide her with a full accounting.  Additionally, I am unaware of any order in the matter we are handling for this client which requires her to pay the attorney fees of the opposing party. Finally, our firm has not missed any filing deadlines, and the lawsuit against her was filed prior to the client retaining our services. As ******************** has pointed out, there have been complicating circumstances that have caused the representation to last longer than originally expected.  We have had multiple discussions with ******************** related to her representation, and the way forward. We still represent her in this matter. We have a formal billing dispute process, and have offered our client to participate it in, but she has not taken the opportunity to do so.  We have also informed her that once our representation is concluded we can discuss the overall billing and try to come to a mutual agreement on how to deal with her concerns over the cost of representation. We always want to treat our clients fairly, and ******************** is no exception.

I have been trying for months to get the retainer returned to me. They have mailed it to the wrong address twice. When I spoke to ****** on the phone he said he would mail the check to the correct address and my name. But then I received a check made payable to Protect Spring Valley. Since we were a group of people they had us name out group when we signed up with them. They did not tell us that they would not refund the retainer to the person paying them, but rather to the name of the group of people. So now in order receive a refund of my retainer that I paid them directly I have to set up an LLC and a bank account? I don't even know the time or expense of such a project, but I get different answers every time I call them and no calls back. Just a horrible end to an otherwise disappointing experience.

    Dear ****************,

We are writing in response to your recent complaint to the Better Business Bureau (BBB). Please accept our apology for the delay in having the funds refunded to you. The funds were initially refunded in a timely manner, and the check was made payable and sent to Protect ********************* which was listed as our client. You later contacted us and stated that the funds should have been refunded to you directly because you were the person who made all of the payments. Generally, when an organization is the client, that organization pays all fees, and any refunded amounts go back to that same organization. However, after confirming that the funds were paid by you and not the association, we have immediately processed the refund as you requested.

Again, please accept our apology for any inconvenience this matter may have caused you. You may contact me with any additional questions or concerns.

    Best Regards,

We contracted *********************************************** in June 2023 after a dispute with a contractor over a flawed basement renovation. Our initial interactions were informative and pleasant. Then, the case was assigned out and things took a turn for the worse. We had incorrect demand letter ***s, were provided incorrect CDARA deadline dates, and had poor communication. We escalated and our case was internally reviewed. To date weve paid $5,928, with one outstanding invoice of $426 totaling $6,354 in legal bills - for a demand letter. After reviewing our case, *********************************************** offered $3,000 in compensation which we feel is not nearly enough due to the severity of our grievances. Please go to BBB and Yelp and review before engaging. Lack of communication asked for total *** of damages but didnt update CDARA letter.Missed a known new contractor deadline - and ultimately ended up losing a good contractor despite this being known from the beginning + multiple follow ***.Multiple follow *** went unanswered. Emails tend to be super short with very little information - and then when we follow up with questions - and then get charged double when it should have been in the first email.****** provided incorrect dates. Demand Letter was incorrect ***. There are two teams one for litigation, one for the demand letter. The litigation team let us know the actual demand ***, asked us to calculate, but then never updated the demand letter. We have multiple instances where we, the client, referenced the $45K to our legal team without letting us know it was actually an incorrect $20K in the demand letter.

    Business Response

Hello, Robinson & Henry strives to provide clients with the best legal services. We appreciate this client's business and are dismayed that they believe that they received no value from their representation.  We do disagree with their characterization of the services provided and are dismayed that they chose to reach out to the BBB rather than contacting the firm directly to attempt to resolve their concerns. Our communications with the clients related to our representation remains confidential, but we believe that our efforts helped to move their legal matter along.  We previously offered for our clients to participate in our formal billing dispute process. Although they ultimately did not participate in the formal process, our Customer Relations Manager met with them and they agreed that a credit and return of $3,000 would be appropriate and our former clients indicated that they felt that they had been treated fairly in this regard. We also believe that the client's have significantly misstated the amount that they ultimately paid our firm and we would be happy to provide them a complete accounting from their two matters upon request. We strive to treat all of our clients fairly, and always offer to resolve these types of disputes amicably.

I am rejecting this response because:

If they believed they offered sound legal advice - why was the demand letter not the correct **** or the dates provided the correct dates?  Why did we, the client, have to inform them of their errors?   There were multiple internal mtgs that we were charged for that should have caught any/all errors that transpired.

We have never agreed to the $3K compensation.  Please see documentation where we've indicated our disappointment on multiple occasions.

    Sincerely,

There is nothing more we want to address with Robinson & Henry beyond what is stated.  We are highly disappointed in the services we received from them - every step of the way we got bad or incorrect information.  While they recognized an issue, they did not refund us.  There has been zero benefit in hiring them - moreover, they hurt our case with the construction company vs. helped.
