I am submitting a complaint against Advantage Credit for failing to provide accurate information to lenders with regard to my credit file. There was a fraudulent collection on my credit file, once I was aware of it, I took the necessary steps to have it removed from the three major consumer reporting agencies, Equifax, TransUnion, and Experian. ALL three consumer reporting agencies removed the fraudulent collection within the 1st week of June 2024. However, Advantage Credit is still reflecting this fraudulent collection for Equifax and is refusing to remove it, although they are aware that Equifax no longer shows a collection on my credit file. There are multiple recorded conversations with Equifax and myself (06/13/2024, 06/23/2024, and 07/05/2024) where the customer service representatives all state that the collection is no longer on my credit file. Equifax also provided me with my updated credit report that shows that there isn't a collection on my credit file. Additionally, I received the dispute results documentation from Equifax via postal mail, that were dated 06/13/2024, and stated "that the collection was no longer on my credit file." This information was also provided to Advantage Credit, but they still refuse to remove the inaccurate information. I even pulled my credit report again on 07/02/2024 from annualcreditreport.com and there isn't a collection on my credit file on Equifax, Transunion, or Experian. So, Advantage Credit is knowingly "reselling" inaccurate credit information to lenders. Their incompetency is adversely affecting me, and I hope that the BBB would be prompt with determining a resolution for this case. I have included supporting documentation. Thank you.Business Response

I am rejecting this response because: I filed a formal complaint against Advantage Credit on 07/06/2024 after numerous attempts to resolve an ongoing issue. Advantage Credit is refusing to remove a fraudulent collection from my credit file although documentation has been provided to them on 06/25/2024 that was directly from Equifax showing that the collection was already deleted (see attached dispute results). This was sent to Advantage Credit along with my updated Equifax credit report from 06/16/2024 and 06/23/2024, where no collection is reporting on my credit reports. Advantage Credit responded to my complaint and was completely dishonest with their response. Advantage Credit stated that the complaint was the first-time hearing about my situation, however my loan officer and I have spoken to a few Advantage Credit employees regarding this same issue for over a month now: the timeline and representatives involved are below. My loan ******** ************ has been corresponding via email with ************************* from Advantage Credit since the beginning of June 2024. ******* stated in her email that Advantage Credit would not delete the fraudulent collection from the borrower's report unless they receive documentation from the collector even though they were given the documents from ******* where it shows that the fraudulent collection was disputed and removed by ******* already. ******* then stated in her email with ************ that we could have a conference call to verify that the collection is in dispute and that it still could not be deleted unless they receive documentation from the collector, and per ******* anything else would be a cosmetic update and would not affect automatic underwriting. ************************* was the representative from Advantage Credit that received the dispute results documentation from Equifax confirming that the collection was deleted, and she responded by saying, per her email, the collection cannot be removed with the document provided by *******. I even called Advantage Credit myself on 07/01/2024 and spoke to ******* (the call was recorded). I explained the ongoing problem with *******, who then states that since I was not his client (Cornerstone First Mortgage is), he could not advise me on any of the questions that I asked. So, this is not the first time, or second time that Advantage Credit was made aware of this ongoing issue. On 07/05/2024, I was on a conference call with my loan ******** ******** and *********************** from Advantage Credit discussing the same ongoing issue (the call was also recorded) and it was confirmed once more by Equifax that the collection had already been deleted from my credit file. It seems as if Advantage Credit did not even bother to read the actual complaint or review the attached documents. This is an Advantage Credit issue and NOT AN EQUIFAX ISSUE, as Equifax removed the fraudulent collection almost a month ago now. As previously stated, the documents from Equifax were forwarded to Advantage Credit, who refuses to correct THEIR records. Advantage Credit claims to be a middleman between the big three consumer reporting agencies but doesn't even pull directly from the big three consumer reporting agencies (Experian, TransUnion, and Equifax). If Advantage Credit actually pulled directly from the big three consumer reporting agencies, Equifax in this case, then they would have accurate, verifiable, updated information in my credit file, which is required by law, and THEY DO NOT. My loan officer also requested to know who Advantage Credit pulls their credit information from, but they refused to give him (their client) this information also. Advantage Credit does not seem to want to resolve this issue, based on their responses and lack of action. It has been made clear that Advantage Credit wants to continue to be in violation of the Fair Credit Reporting Act, 15 U.S. Code 1681 e(b) which was put in place to protect consumers like myself, from situations such as these. Who does Advantage Credit actually pull their credit information from? Why do they feel the need to include this disclaimer on their documents to indemnify themselves (see Advantage Credit -***** Report attachment and below): --- "The information is furnished in response to an inquiry for the purpose of evaluating credit risks. It has been obtained from sources deemed reliable, the accuracy of which this organization does not guarantee. The inquirer has agreed to indemnify that reporting bureau for any damage arising from misuse of this information, and this report is furnished in reliance upon that indemnity. It must be held in strict confidence and complies with the provisions of Public Law ******, the Fair Credit Reporting Act. Reporting bureau certifies that all Residential Mortgage Credit Reports meet the standards prescribed by FNMA, FHMC, FHA, ** and the ********************************* Advantage Credit is in clear violation of the Fair Credit Reporting Act, as they are ACTING as a consumer reporting agency and intentionally leaving inaccurate information on my credit file, then providing this information to lenders. According to the Fair Credit Reporting Act, whenever a consumer reporting agency, or those companies ACTING AS SUCH prepares a consumer report it shall follow reasonable procedures to assure MAXIMUM POSSIBLE ACCURACY. Consumer reporting agencies assume a vital role and have a responsibility to report consumer's information to the best of their ability. However, Advantage Credit continues to leave this unverified, inaccurate, fraudulent information on my credit report, which is adversely affecting me, and is grossly negligent on their part. Advantage Credit also mentioned in their response that a dispute request could be sent to Equifax. Advantage Credit needs to REVIEW THE ALREADY ATTACHED DOCUMENTS IN THIS COMPLAINT, WHERE IT SHOWS THAT EQUIFAX RESOLVED THE DISPUTE PRIOR TO 06/13/2024 AND THE FRAUDULENT COLLECTION WAS ALREADY REMOVED/DELETED, SO THERE IS NOTHING TO DISPUTE WITH *******. -----YOU are the problem Advantage Credit, knowingly providing false information to lenders even after receiving documentation that a fraudulent collection has already been deleted from Equifax. Advantage Credit is currently impairing my ability to obtain credit. I demand that Advantage Credit remove this inaccurate and erroneous information from my credit file immediately and I request to be compensated for the injuries and damages that I have endured as a result of Advantage Credit violating the ***** whatever the consumer statues allow.
Sincerely,
***********************Initial Complaint
