Since the summer of 2024, I have been receiving phone calls, daily, about various rental properties associated with Big Bear Properties. I have left voicemails with the business, I left messages with whoever was working frontdesk. I have even talked with the owner to try and resolve the issue, which she said would be taken care of. I still receive numerous calls from people asking about their properties. I am unsure what my next steps would be.Business response

This is absolutely not the experience we want anyone to have, and we regret that it has continued despite your efforts to bring it to our attention.
After a thorough review, we identified an error on our website that inadvertently led to your phone number being associated with our rental inquiries. We have corrected this mistake to ensure you no longer receive these unwanted calls.

I moved into my rental and have continued issues the property regarding maintenance and them not fixing issues in a timely manner or refusing to return calls. Two weeks ago all the smoke detectors were going off for hours and I had to call fire dept because maintenance refused to come out. The fire dept stated they were all out of compliance because they were 20 years old. They have since been fixed but not until the fire dept got involved. Most recently my basement flooded becuase they had a broken sump pump. The basement is finished and my sons room and living area is down there and now has to stay at his dads house for 3 weeks as it’s inhabitable. They have reported it Woolf be finished a week ago. Nothing. They said carpet people would come out Sunday. They didn’t. I have left multiple messages they aren’t retuned calls and were very on Friday when I called the office questioning why the basement needed to be fixed. I’m paying for w finished basement which is part of my 2800 rent. They have been unresponsive and rude refusing to finish the work. I want the job fixed, a reduction in rent and the owners to know big bear is not performing their obligations that they are paying them for around maintenance and taking care of the home.Initial Complaint

So to make a long story short I had lived in one of Big Bear Properties properties for about a year and in the recent states I have to give you 60 days to let you know that they do not want to resign your lease with you, which in one text message she states that it was 45 days which is also not true but even if it was it is still not abiding by the lease she gave me two weeks as a single mom to move all of my stuff out of there knowing I don’t have anywhere to go or put my stuff so now me and my son are living in my car. She is aware of the situation and I had it for a couple more weeks but she’d already sold the place which is absolutely morally wrong to me. She is the owner. Kim knew what she was doing and would constantly judge the way I chose to be a mother and my age because I’m 19 years old. I had a situation happened with my baby daddy and I couldn’t afford rent so I was making smaller payments instead of larger payments but rent was still getting paid they did not like the fact of making smaller payments. I had given them an extra thousand dollars to cover any damages or anything like that just so I can get out of there and they had promised me my security deposit back within that week and they did not give it to me it’s been almost a month and are still waiting and what’s the times they either hang up on me block my calls or just a flat out rude and scream at me. This is absolutely ridiculous Kim said to me “well you should’ve had a plan” they are no good and all about money. Very greedy I do not recommend you go here at all -100 out of 10. so what I’m asking is I get my $2700 security deposit back like I was promised.Business response

Please see below for Big Bear Properties of Union Colony Brokers, LLC response to the complaint filed by ****** ********* (case #********). If you need anything further, please let me know.
To address the complaint filed by ******, Big Bear Properties would like to first address the issue of the notice that was given to ****** stating her lease will not be renewed. On January 9th, Big Bear Properties posted a legal notice of non-renewal of lease and notice to vacate premises. Theis was due to the resident having an outstanding rent balance in the amount of $2,935.59; additionally, the other resident on the lease moved out causing the remaining resident, ******, to not qualify financially. Since she did not answer the door, Big Bear Properties posted this notice with four pieces of tape in a conspicuous place upon the premises, on the front door, as is the accepted industry standard and practice. Big Bear Properties took photographic evidence of the posting to ******'s front door. When Big Bear Properties made contact to verify progress of moving out, the tenant claimed to never receive the notice. Big Bear Properties was able to provide a timestamped photo of the posting and notice. This occurred on February 16, 2023. Big Bear Properties abided by all laws and regulations when providing the resident notice that the lease would not be renewed.
Big Bear Properties would then like to address the second complaint, the security deposit. The resident moved out on February 27th, 2023, with an outstanding balance of $4,352.58 in unpaid rent. The tenant provided to Big Bear Properties a check in the amount of $5000. Upon depositing into the bank, Big Bear Properties was contacted by the local law enforcement, the business the check was drawn from, and our local banking authority that it was fraudulent. The check had been stolen and drafted from an account of no relationship to the tenant. Due to these circumstances the check was returned for nonpayment and not applied to the tenant’s balance. ****** claimed that because she supplied Big Bear Properties with payment, she should receive her deposit and that it was not her fault the check was stolen, and she should not be held accountable for the check not clearing.
We are unable to refund the requested security deposit of $2700 as the tenants outstanding balance far exceeds the deposit on file. Additionally, pursuant to per CO Rev Stat § 38-12-103, all landlords have until 60 days after the residents move out to return the security deposit. As of the date of the complaint filed by ******, Big Bear Properties is still within that period to provide accounting of how the deposit was applied against her account as well as the collection efforts against the difference.
Big Bear Properties has the lease, ledgers and all conversations between the resident and us to back our statements. Big Bear Properties has attempted to explain all of this to the resident; however, she has been nothing but rude, and disrespectful, including threatening to appear at the office and physically assault the staff.
