      Hello BBB,

This complaint is bothersome and I would like to dispute it what in your experience has been the best route to do so.

I have all conversations with this customer agreeing that WE have completed all work agreed upon and do not have any requests for repairs or issues for the past couple of months.

The referral bonus issue I agreed to give her one for 250$ but as explained to her the work has not been finialed yet so the bonus will wait till all work is finished.

I have insurance if work wasn't completed correctly but I have yet to be given an opportunity to correct any issues.

I find the trespassing troubling as well due to the fact I was stopping in on an active job site where tools and materials were. I did not come after normal business hours I was within business hours always.

      Thank you

      11/28/2023

      Hello ****,

      Hello BBB,

Attached are three messages time stamped and dated where the customers partner threatened to *** me prior. Escalating the situation.

I attempted to offer to fix is***s and walk through the scope of work and work with the customer at that time. I would like to add this was an insurance claim job where the scope of work was decided by the insurance company.

The customer stressed money and we worked on doing items that were needed immediately so the customer could stagger the expenses.

I would also like to add insurance will typically not cover items like wood rot due to it being damage that is caused over a long period of time due to lack of maintenance or neglect.(thats what most insurance companies would say)

We painted more of the house than what was covered by insurance.

We upgraded the gutters that were originally plastic in areas to aluminum.

We also have a free class 4 upgrade to to the customer that was not covered by the insurance.

We as a company stood behind all work completed as long as the customer gave us the opportunity too and we still will.

we also completed all contractual obligations and I would be happy to provide the BBB documentation directly if requested. Due to some of the information being private to the customer I will not post that in this response.

This customer pulled the number $1000 out of nowhere. I would be curious to see how she got this number all referral bonuses Ive offered were $250 and only one referral she sent me followed through as the requirements state.

The customer has told me multiple times that we as a company have completed all items agreed upon in the contact and I can provide those messages as well.

Sadly This customer chose to berate and insult me and my company multiple times. Upon request I can also share those email.

We are a locally owned and operated business and we are people too. Thank you for your time and we look forward to working toward a resolution on this is***.

      To Whom It May ********************* style="color: rgb(33, 37, 41); margin-top: 0px; margin-bottom: 1rem; font-size: 13px; font-family: "Proxima Nova", sans-serif;">

I am sorry for the delay in my response, but I wanted to be thorough and I did not realize I was supposed to respond.

I am NOT satisfied with F&P Roofing/ Austins response to me, personally, or to you, as it is a very incomplete snapshot of what has actually been happening over the past several months. Also, in his personal response to me, he threatened to *** me for my very real and valid complaints (A49). I have every conversation we have ever had saved, and would be happy to share the whole thing so you can read it in full. For now, I am just going to attach messages that directly go to my point. I am sorry there are so many of them, but they are labed and sited in this letter.

Now, to be clear, I do not wish to pur*** any legal action with this man. In fact, I would like nothing more than to be completely done with him and his company, as I have stated many times before. However, I do have valid complaints, and my opinions may have been hurtful, but they were earned. Please, first read the letter in which I sent to ****** on 9/20/23. This letter is a laundry list of complaints, with time stamps, and will show you why we feel the way we do.

      ******,

I would like to go over a few things so that we can be on the same page. I have admitted in writing/text that the facia, exterior paint, and vent trim were not in the written contract. I would have paid for the work to be done, if I would have known about it. It was only once we realized that nobody was going to come back that I hired my friend to complete the work. Payment was given to him upon completion.

From a novices point of view, this is how the situation occurred pertaining the facia. My partner noticed the warped piece of wood on June 12th. I messaged you about the is*** at 7:11am. You came over and looked at it the same day and confirmed the piece was warped and needed to be replaced. You quoted me $150 to replace the piece. I verbally accepted the quote and was told one of your associates would fix the is***. When the associate arrived, he did not have the needed materials in his possession. I was told he would be back to compete the work. After waiting 6 weeks, I reached out to my friend to help me fix the facia and the siding of the house on July 23rd. While he was replacing the piece of facia, he realized the project was a larger is*** than we imagined, which was a bit different than your quote. All in all, the facia is completely fixed now.

My is*** with the facia was; we were not notified about the damaged facia before your associates placed the new gutters onto the clearly damaged facia. We couldnt tell them to fix it while they were there, because we were out of town. Due to my head injury, I have a very hard time being around noise, which is why we had your guys do the work that particular week.

As far as the paint goes, as I said before, we are totally fine taking on that job since it is in our abilities to do that task. I have always stood by the verbal agreement that was made about sanding the bad areas, with a quick coat of paint, because it was no problem for your guy. Unfortunately, there was no written agreement.

I also understand that the vent trim in the laundry room was not in the original contact. As a professional courtesy, your associate should have given us the opportunity to retrieve or pay for new undamaged trim before he put up the clearly damaged pieces from the water damaged area. The vent trim was not noticed until Aug 9th when my partner, ****, messaged you. The reason this was not noticed until now is because of the inconspisicious location of the vent in the room.

Next, I would like to reference the quality of the storm door and its installation, as noted in the pictures that I sent on June 28th. The door is warped at the window junction, which was immediately noticed upon installation, but it is still usable. There are several locations where the associate missed the wood trim with the screws, due to the uneveness of the door frame. He removed the screws and filled the holes with wood filler. There were many, and still multiple areas, where daylight is visible through the door frame. Also, the areas where he missed the screws are noticable. The caulking around the doorframe doesn't cover the junction fully, and it is aesthetically displeasing.

As the homeowners, we made it very clear to you and your associate we were not ok with a child being on the construction site. At one point, we noticed the child actually installed a s**** or two and was helping him out. I even messaged you asking this man not to come back to my house, to which I received no response.

There has never been a vendetta against any person, per se, just a displeasure with poor craftsmanship and blatant disregard for my personal space and wishes.

I fully understand that to completely fix the storm door would be very costly, to which, I do not believe it is worth the cost nor the headache since the door is functional.

Again, as a professional courtesy, the associate should have informed us of the is***s with the door before installing, especially since the front door was open and we were home.

All of these is***s could have been rectified by clearly communicating with us.

I understand that we talked about doing the projects on a limited budget, but I also made it abundantly clear that I wanted things done correctly. The house will be on the market as soon as its ready. That means everything needs to be done to code and look good. We had extensive conversations about the house being listed at some point.

I was happy with you, which is why I referred 2 people to you. I even talked to you about doing the inspection on the house once it went on the market. In a matter of a few months, you could have easily made over $100,000 in projects based on my referrals alone. And now, you are refusing to give me my measly little referral bonus.

On August 11th, you informed me of your referral processes. The payout will be given when the work is completed or the contract is signed.

I accepted this condition, which excludes me from the first referral I gave to you, my friend ******* total bathroom remodel. Your associate forgot to email the bid until over a month later. So even though I met my end of the agreement, and you met with her and saw this $40,000 + project was real, she was desperate to start. But your man messed up not me.

The second referral was to the house which is basically across the street from my house. I waited several days after completion to message you. According to you, the only condition to this referral was the signing of a contract or the completion of the project. The project is now complete, as I saw the work get done.

When your associate came to pick up the greenhouse pieces, he wasnt told by you that he would not be able to back his truck into my backyard, as it is a very narrow driveway. In a pinch, my partner, found him a wheelbarrel and helped him load up his truck, because he had no tools and was by himself. Again, communication would have been a huge help here.

You showed up 2 times and walked into the backyard without warning, nor permission. I even messaged you the second time it happened on June 17th, to which, I received no response.

When we returned home from our trip, not only was the work not done, but there was a huge mess. We had to clean up as soon as we got home, because the dog could not reach her dog door, and there was dust and trash everywhere. The mess and dust was very surprising to us, as the only work in the kitchen, the sky tunnel, had not yet been done, nor any other interior work. We were not notified by you that the work wouldnt be completed while we were away, as we had planned.

We had you come while we were out of town because I cannot be around while the work is being done. Planning ahead is very important to me, as I do not drive, and transportation/ places that I can go by myself are limited here in this small town. Having to leave last minute, was a problem that I had with all of the workers except for the one who worked on the bathroom vent. Despite how clear we tried to be about the importance of communication and planning ahead, we were willing to work on their schedule. We only asked to be informed of it.

While we were out of town, my mom was your contact person. You had her come over on the first day, she met with the people doing the interior, and agreed upon a time to come over the next morning. The associate came early, and instead of waiting, you all broke into my house. You did replace that screen. My mom woke up early and drove 15 minutes to be here at the agreed upon time.  Her time and energy was wasted, and since they didnt even do the work, my house got broken into for not reason at all.

You tried collecting payment before the project was complete.

On Aug 9th, you told my partner and I that you would no longer communicate with him. Despite the fact that many is***s and scheduling had already been handled between the 2 of you. The main reason for the previous communication between you two existed is because I have trouble communicating and get very easily flustered, due to my head injury. You knew this fact. On Aug 11th, you state (correctly) that I communicate better in text, which is why most of my communication is done by text. By forcing me to be the only person who can communicate, you put me in a vulnerable position, and you keep asking me to put myself into another vulnerable position with you. I told you on Sept 12th, that I do not feel comfortable signing anything because I didnt trust that you wouldnt use that signature against me. Especially, since with my injury, I get confused and disoriented easily.

You keep offering to go over the contract with me, but since I am the only one who could be there, I dont see what good could possibly come from that situation. I will be completely overwhelmed and then I would feel forced to sign a contract. I don't really see the point in going over a contract that I am clearly not fighting.

On Aug 10th, I reassured you that we had no desire to *** you, after you brought a lawsuit up to me. The conversation went on to be very unprofessional and at one point even personally offensive. I even asked that, unless it is to apologize or do anything to make it sort of ok dont contact me. You responded without apology nor any solution. You have not gone above and beyond, or I would not be trying to have this conversation with you. Once payment was received, your attitude completely changed. Looking back, I now realize how many is***s we had throughout the whole project. My wishes and needs were not considered, even when brought to your attention. Just because you don't like my partner and myself, doesn't mean you can hold a referral bonus hostage. And by creating a list of demands, that is exactly what happened.

No apologies will be given nor received. Please send the referral bonus to my mailing address. After that, please do not contact me again.

      Sincerely,

      *******************************

As you can see, this is a very long list of grievances. ****** replied See if you had voiced these opinions/statements calm and collected, well worded and diplomatic I would have been a lot eaiser to deal with. I believe we were nothing if not calm and diplomatic for the months prior to this letter. But since he also stated had no arguments with what I said, and that he would soon have the check in the mail for ******************** style="font-weight: bolder;">(A47) I had no reason to respond as I have stated I do wish to be done with this man. However, he never sent the check, and as you can see in the next picture (A48), he clearly blocked me. As this is the only time my message was green, and not marked as read, but only sent as a text message. Then the next message  that I sent, was the same day in which I wrote my review and complaint to the BBB. He clearly unblocked me just so he could send me this response, including a threat of lawsuit for my reviews (**********)

And as of now, he is claiming that he is still not done with my neigbors house. But I messaged him on 9/1/23 telling him that I could see they were clearly done with the work (A31). He never once mentioned then, that the project was still on going, and again he did say he would send the check in the mail and that a contract only needs to be signed OR completed. Both of which are clearly done.

He also goes on to state that his referral bonus is clearly $250 but my partner and I were both under the impression it was $500 each. But,I honestly dont know what difference the amount is for, when he clearly never had any intent on giving me either bonus, which is evident by all of his past and current behavior.

As for the second referral I mentioned it is their fault that contract was never signed and my friend would be willing to write/talk to you about the incident if you would like. As would my mom about them breaking into my house as she was there shortly after to let them in.

On  8/9/23, my partner contacted ****** about the latest is*** we noticed with the work that was done, the vent in the laundry room (A87-90). ****** refused to take responsiblity or show any desire to fix the problem. The only thing he kept telling my partner, was that the trim for the vent was not in the contract. Then ****** sent a picture of the contract, and come to find out, there were actually multiple items they did not do. So my partner pointed that out to him and said, if he wanted to be that way about the contract, then we could *** ****************************** style="color: rgb(33, 37, 41); margin-top: 0px; margin-bottom: 1rem; font-size: 13px; font-family: "Proxima Nova", sans-serif;">

Austins response to ******************** style="font-weight: bolder;">(A23) $6000+ kept by you would be for line items not completed. But we were not given this list of items that would not be covered. So it would be really hard to go over the contact as the gold templet of what the job should have been.  Plus it couldnt have been more then $6000 as we have a $7000 insurance premium and we put $1000 down before work started. And as we were never given the change to pay for anything out of pocket it could only be a *** of $6000. Just another incomplete truth I thought I would point out. Not trying to get any money.  The letter above was my response to this conversation as he kept escalating and becoming more unprofessional.

Later, ****** would say Quite frankly your partner was up set and I understand that but the second he threatened to *** ******************** style="background: yellow;">I mentally checked out(A 47) This is unfortunate, because he was still representing a busniness and he behaved terribly. I tried to stay calm and respectful, but also explain that we did feel as though he was taking advantage of us, aka being screwed with. I told him how hopeless he made us (A24 &A29), I gave him plenty of opportunities to stop and walk away telling him I wanted to be done with him (A24, A25, A29). I even asked him not to contact me except for the referral bonus or an apology (A30). I wouldnt be sitting here writing this, if he had done either of those things. But instead, he tried to bully me again and is still only offering the contract line by line negotiations one on one with me. Depsite the fact I told him I felt like he was trying to force me to sign something going against my best interest and I did not trust him (A)

I should at this point bring up my disability. I susstained a head injury while working in the OR as a nurse over 3 years ago and am currently receiving long term disability for the effects of my injury. The only reason I bring this up is that I have some very specific limitations. I get very easily flustered and overwhelmed. Dealing with things like this are very hard for me to manage. ****** was/is very aware of my disability and several of my limitations. So when he told my partner and me he would only deal with me one on one this put me in a very vulnerable spot.  Which is what I tried to explain to him multiple times (see above paragraph). It was also at this point that he started behaving in what I felt was an aggressive and in a bulling manor.

Now we do have a high deductible and we did talk about how he would be able to save us some money, which was/is great. But we also talked about how we were going to be selling the house and everything had to be up to code and be ready to put on the market. ****** keeps mentioning there was a budget, and we did want to stay on budget, everyone does, but, we also need and expected things to be done properly. If for some reason they were to run into any is***s, I assumed I would be notified immediatly and we could come up with the best solution for each problem. This never happened once with any is***. We had to discover it after the fact (A12, A19, +). I am not sure how the budget can be an excuse for poor craftsmanship and incomplete jobs.

There was never a talk about staggering expenses. We were never notified of any except the $150 which we would have paid immediately had his man showed up with the piece or ever bothered to return. And staggering the expenses would imply that we would still want the work to be done which again, was never really an option. Paying for work done is implied with any service provided, this is what is expected of every consumer and I do not believe I am exempt.

We painted more of the house than what was covered by insurance. I honestly dont know if this is true or not, but, please see the pictures below to show the level of painting that was not done (******). The area 2 spots Austins man did paint were well done and he seemed very professional. No issuses with the work done, only that again I was told by ***************** was going to be done. This point is only being made as it goes to the overall theme of over promise and under deliver. Again he mentions it not being covered by insurance but we were never given the option of paying.

We upgraded the gutters that were originally plastic in areas to aluminum. But then put those gutters onto rotted and unpainted wood. Please see messages of us notifying him (A12) and the pictures of our new beautiful gutters (A71).

We also have a free cass 4 upgrade to the customer that was not covered by insurance, This obviously sounds great. I dont know what it means or what it pertains to. The roof? Why would you take the liberty to upgrade me on my roof for free and never mention it until now but refuses to help me fix my real problems? My insurance does cover code improvements, Im not sure if that is what he is talking about or not.

We as a company stood behind all work completed as long as the customer fave us the opportunity too and we still will. Again we reached out right away every time a problem came up he just refused to fix any of them. I have repeatedly stated that I am not happy with the work! He has had ample opportunity to fix it but instead has come up with every excuse not too.

The only thing I was offer that I denied paying for was redoing my entire front door frame as it did not seem necessary and at that point I did not trust him or his hired workers to work on one more thing on my house or give him one more dollar.  Plus the main door has never had an is*** just the new crooked storm door (72-86). I notified ****** of the is***s with the door immediatly after installation (A19) The pictues I listed above are now after he came over and fixed it and told us it was fine. Another example of him not understanding the project itself or what is needed to fix it.

In Austins message me after I posted my complaint and stated he never received any recent complaint on the door and he is right. The last time I complained about it was in the letter and he did not respond to that or any other complaint.  I have learned my lession and am not asking anything more of him as he will only refuse and cause me frustration (A29). But he would have no way of knowing that since he blocked ******************** style="font-weight: bolder;">(A48).

I will say it again we are not satisfied with the level of craftsmanship that was done on our home, that any of the work was done properly, with the way we were treated by the business and individuals who represent the business. We are not satisfied with them breaking into our home or tresspassing into out backyard while the window is open and our pants are down going potty just to then watch him run to his truck parked behind the neighbors tree. We are not satisfied with being bullied around or being blatantly lied too. We are not ok with children working on our house or even being invited over by crew members after it was known we werent of with this child there. We are not not satified with being told we should be happy with what we got. We are not happy we are not satisfied and I have a right to tell people they should not use this company because I dont think they will be satisfied either.

Unfornuanity I did become hostel at the end. I have to admit it is not my finest hour. I do have to defend though that I felt I was backed into a corner by an aggressive bully. I am sorry for my behavior as I want to hold myself to a higher standard.  But I am not sorry for what I said as it was the truth. He was rude and he bullied me and stole my money. I do not want other people to be bullied and taken advantage of. That is why I submitted my complaint and why I wrote a ****** review. It why I have taken so much time to respond to you so you can see it is not as simple as he has made things out to be. But this company does not deserve to be in good standing with the BBB

As I said before I do not wish to do anything else. I would like to be done with the whole thing. I just wanted to report him. And to be fair items were not so much resolved as I gave up. But I am done. I believe he deserves a poor rating with you but that is up to you as I do not want anything more to do with this. Sorry for any confusion or inconvenience I may have caused
