    Paid for a statement of work contract stipulating that Nationwide Professionals would:- File lein holds for the duration of the contract - Prepare and File multiple years of tax returns - Prepare and file Tax penalty abatement requests - Prepare and file payment plan with the *** for outstanding ********** of 1/20/2024, Nationwide Professionals has not delivered or provided any evidence of delivery of any items on the contract. I have asked multiple times to provide evidence.Nationwide Professionals is now asking for additional fees of $6950 to continue the contract.

    The client was provided with services as outlined in the attached contract. Numerous phone calls and email exchanges transpired between the client and me regarding the transfer of documents and the review of returns. These communications required significant time and effort on our part to address the clients needs and ensure their returns were accurately prepared.
    All tax returns have been drafted and submitted to the *** despite substantial delays caused by the clients failure to promptly return signed tax returns. As stipulated in the contract, the client was required to provide all necessary documentation within 10 days. The clients failure to meet this obligation constitutes a breach of contract.
    Additionally, I have documented email correspondence detailing repeated delays in the clients review and signing of the tax returns, which were necessary to meet *** deadlines. These delays required us to secure multiple extensions and enforcement collection holds to prevent the client from being levied. To date, the client has not been subjected to an *** levy, solely due to the holds we successfully obtained on their behalf. A copy of the *** Notice of Intent to ****, dated August 2024, is attached to demonstrate the importance of these interventions.
    Given the clients delays and the resulting increased effort required on our part, we requested an additional work agreement fee to continue addressing their resolution. This fee also reflects the increased tax liability resulting from the preparation and filing of all missing returns. The client will require additional holds while the *** processes their outstanding returns and further assistance in managing the increased balances that now place them in a different tax threshold.
    Wherefore, we have fully complied with the terms of the original contract and have provided the agreed-upon services. However, due to the additional work necessitated by the clients delays, an additional fee is required for the continued work necessary to resolve the clients tax matters. If further information is required, please don't hesitate to contact our office. Thank you for your time and consideration in this matter.

    The contract outlines specific deliverables as a statement of work, which include:

    Preparation, submission, and negotiation of an Installment Agreement (IA)
    Preparation, submission, and negotiation of an abatement of penalty request
    Obtaining a Stay of Enforced Collections on the client's account
    Filing ********* IRS and State of California tax returns
    Tax planning/structuring

    However, there is no explicit language specifying that failure to meet a 10-day turnaround time for client documentation constitutes a breach of contract. The relevant clause states: "Client agrees to provide all documentation within 10 business days of request, unless *** or State requests it sooner." This provision does not explicitly indicate the presence of additional fees or contractual consequences in the event of delayed submission.

    Furthermore, there was no prior notification or communication from the company regarding a breach of contract after the initial 10-day window expired. It was only upon returning all requested documentation that the company sought additional fees.

    Additionally, there is no record of the company demonstrating urgency in addressing delays or providing updates during our communication, despite multiple phone calls and emails. The errors in preparation of tax documents and back and forth to resolve said errors added to the additional time it took to progress the contract to it's current state.

    In light of these issues, I expect a higher standard of performance from a specialized service provider like yours. The failure to meet these expectations, coupled with the imposition of additional fees outside of the contract, suggests predatory behavior on your part.

    BBB,

    This correspondence refers to the above-mentioned BBB complaint ID ********. Attached is the original contract as well as email correspondence with the client regarding the tax matter. These documents were giving me errors in attaching to the response to the complaint. We also have tax documents that have been drafted and filed on the clients behalf however, due to personal information on the returns they are not able to upload as well. However, if any further information is required or explained further, please dont hesitate to contact our office. The invoice provided with the response also does not include any for the most recent work done on the clients behalf. We hope that this information clarifies that we have fulfilled our obligation per the original contract and that the complaint is warrantless as all services have been provided to resolve the clients tax matters which has proved difficult due to the delays. Thank you for your time and consideration in this matter and look forward to your response.
