    ****** Asphalt was contracted to pave the driveway on my newly built home, with a 1 year warranty included. Within a month of moving in, there was a significant crack and depression formed at the edge of the driveway. I immediately contacted **** to inspect and repair the work, which they did. However, at the time of the repair, which was done at no cost, there was an attempt to upsell me on a sealing coat - I declined this offer due to other workmanship concerns.I must say that I am happy I declined the sealant, as less than a month later a large divit appeared near the original damage, along with a noticeable depression across the width of my driveway much like an inverted speed bump. I again asked for the damage to be inspected.To make a long story short, between grading and asphalt during the build, the utility company trenched equipment across my driveway. And rather than inspect the surface before completing the work, *********** simply decided to place asphalt over any and any surface without any apparent methodology or or QC. Even with my 1 year warranty, the owner's son explained that he would need to charge me to correct the job that was not done properly the first time and was only 2 months into the 12 month warranty.I would like for my brand new driveway to be repaired and free of significant workmanship defects

    "****'s Asphalt was contracted to pave the driveway on my newly built home" That is not true. The complainant did not own the home when I paved it. I was contracted to pave someone else home never contracted to pave his home.   So there is his first lie in the first line of his complaint. I have never met the complainant. And I have never entered into a contract with him. I choose clients and he is not someone I would work for. The depression he is referring to was caused by a pluming line that was run under the driveway not by me but by the builder and not properly compacted. I was not informed of the trench nor was I contacted to fill it. I was contracted by the previous owner to lay the Hot Mix Asphalt only and not the base or subbase or trenching. The failure of the trench is not my responsibility same as if the house sat on a sinkhole. The only part of the asphalt that has a problem is the failed trenching job.

" How can the complainant even make such an assumption let alone such a statement when he was not there? So there is his second lie.

    In his complaint he stated that his desired outcome was to "have the job finished" That too is misleading and implies the job was not finished, a lie also.

    My desired out come is to pursue legal action against the complainant for this and other fictional reviews on the internet causing damage to my business.

    In addition to my responses listed below, I would like expand on our phone conversation before and clarify that ****'s Asphault was the original and only company that performed asphault services at my residence.  A claim that another company or trade performed work on the "base or subbase" has to do with the grading, which is a different category of work completed all together.  Let me know if you have any questions

    ---To be clear, I never indicated that I contracted ****'s to do the work.  I feel that I have been clear in that ****'s was contracted by the builder of the home, and that I have been the only occupant of the residence since it was constructed.  With that said, **** is correct in that the water utility was rerun through the area designated to be the driveway.  However, by this logic, **** then also performed his paving work over a defective surface.  Had ****'s performed a proper inspection of the surface they were contracted (by the builder) to cover, this would have been identified by a reasonable professional.  The fact is that this oversight is now significantly more difficult to correct with a layer of hardened asphault covering the defect. ---

    --- ****'s statement above confirms this issue that is being disputed here: "The depression he is referring to was caused by a pluming line that was run under the driveway not by me but by the builder and not properly compacted".  This statement ABSOLUTELY confirms what is being contested here.  The logic and history of events should not be changed based on the framing of an individual question or statement poised to ****'s ---

     

    In his complaint he stated that his desired outcome was to "have the job finished" That too is misleading and implies the job was not finished, a lie also.

    --- As mentioned in an earlier call with you Aja'Dae, I do not wish to have **** nor any representative from the company on my property.  The lack of professionalism and aparent disregard for quality workmanship is palpable.  At this point, I will address the oversight and poor workmanship of ****'s myself, and really wish to record my poor experience with the organization ---

     

    My desired out come is to pursue legal action against the complainant for this and other fictional reviews on the internet causing damage to my business.
