Please read the Repair Terms and Conditions carefully. By submittingyour product to Precision Camera & Video Repair, Inc., you agreethat these Repair Terms and Conditions will govern the repair of yourproduct by Precision Camera & Video Repair, Inc. If you do not agreeto these terms and conditions, do not submit your product to PrecisionCamera & Video Repair, Inc.

Repair Service: Precision Camera & Video Repair, Inc. willrepair your product as described and for the estimated charges shown onour estimate form, email message, repair form or our online printedreceipt page (unless such estimated charges are subsequently revisedwith your written or oral consent). When the product is covered bywarranty or an extended service contract, Precision Camera & VideoRepair, Inc. will perform repairs under the terms of such warranty orextended service, provided that you have presented satisfactory proof ofthe product’s eligibility for such repairs. You will be responsible forany additional charges applicable under or beyond your product’swarranty or extended service contract, including any applicable tax.

Subcontractors: Precision Camera & Video Repair, Inc. may subcontract with other service providers for the repair of your product.

Payment: Unless your product is repaired under warranty orextended service contract without any charge, you will promptly payPrecision Camera & Video Repair, Inc. the repair charges identifiedon any estimate form, email message, repair form or our online printedreceipt page plus any additional charges subsequently agreed to by you.Your payment is due prior to the product being returned to you byPrecision Camera & Video Repair, Inc. Unless specified otherwise,the estimated amount includes all parts, labor, any transportationrequired for the repair of the product, and any applicable tax. You may,in Precision Camera & Video Repair, Inc.’s sole discretion, beresponsible for a diagnostic fee and/or return shipping charges, plusany applicable tax, if Precision Camera & Video Repair, Inc.inspects your product, provides an estimate for you, and you do notauthorize Precision Camera & Video Repair, Inc. to undertake therepairs for the estimated charges. If Precision Camera & VideoRepair, Inc. determines, while inspecting your product, that repairs areneeded due to failures of parts that are neither supplied by thedistributor nor distributor branded or are needed due to damage causedby abuse, misuse or misapplications, Precision Camera & VideoRepair, Inc. reserves the right to return the product to you withoutrepairing it, and may hold you responsible for a diagnostic fee andreturn shipping charges, plus any applicable tax.

Unanticipated Labor/Parts: If the requested repairs requirelabor and/or parts not specified on our estimate form, email message,repair form or our online printed receipt page Precision Camera &Video Repair, Inc. may seek your approval to revise the estimate. If youdo not agree that Precision Camera & Video Repair, Inc. may revisethe charges, Precision Camera & Video Repair, Inc. may return yourproduct and hold you responsible for a diagnostic fee and/or returnshipping charges, plus any applicable tax.

Parts: In repairing your product under your product’s warrantyor extended service contract, Precision Camera & Video Repair, Inc.may use new, used or reconditioned parts, as permitted by the terms ofsuch warranty or extended service contract. If repairing parts outsideof the warranty or extended service contract, Precision Camera &Video Repair, Inc. may use new, used or reconditioned parts. PrecisionCamera & Video Repair, Inc. will retain any replaced part as itsproperty, and the replacement part will be your property. Replaced partsmay be repairable and are exchanged or repaired by Precision Camera& Video Repair, Inc. for value. To the extent permitted byapplicable law, you hereby waive any right you may have to receive anyreplaced parts. If applicable law requires Precision Camera & VideoRepair, Inc. to return a replaced part to you, you agree to payPrecision Camera & Video Repair, Inc. the additional cost of thereplacement item.

Disclaimer of Warranty: If Precision Camera & Video Repair,Inc. repairs your product under warranty or extended service contract,the repairs will be covered solely by the terms of the warranty orextended service contract and any applicable provisions of law. If yourproduct is repaired outside of warranty and experiences the same defectas the original repair, Precision Camera & Video Repair, Inc.warrants (1) that repairs will be performed in a competent andworkmanlike manner and (2) that all parts used to repair your productwill be free from defects in materials and workmanship for a period ofninety (90) days from the date of the original repair, unless otherwisespecified by Precision Camera & Video Repair, Inc. If the samedefect exists in the product or a replacement part during the part’swarranty period as identified in the preceding sentence, in its solediscretion, Precision Camera & Video Repair, Inc. will (1) repairthe product, using new, used or reconditioned parts, (2) replace theproduct with a new, used or reconditioned equivalent, or (3) refund theoriginal repair charges. PRECISION CAMERA & VIDEO REPAIR, INC.’SLIABILITY FOR ANY AND ALL WARRANTY CLAIMS SHALL IN NO EVENT EXCEED THEPAYMENTS RECEIVED BY PRECISION CAMERA & VIDEO REPAIR, INC. FORSERVICES PROVIDED ON THE ORIGINAL REPAIR. THIS WARRANTY AND REMEDY AREEXCLUSIVE IN LIEU OF ALL OTHER WARRANTIES, REMEDIES, AND CONDITIONS,WHETHER ORAL OR WRITTEN, EXPRESSED OR IMPLIED, WITH RESPECT TO THEREPAIR PARTS. PRECISION CAMERA & VIDEO REPAIR, INC. SPECIFICALLYDISCLAIMS ANY AND ALL IMPLIED WARRANTIES WITH RESPECT TO THE REPAIRPARTS, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY ANDFITNESS FOR PARTICULAR PURPOSE. IF PRECISION CAMERA & VIDEO REPAIR,INC. CANNOT LAWFULLY DISCLAIM IMPLIED WARRANTIES UNDER THIS LIMITEDWARRANTY, ALL SUCH WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITYAND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED TO THE DURATION OF THEEXPRESS LIMITED WARRANTY.

Limitation of Liability: PRECISION CAMERA & VIDEO REPAIR,INC. IS NOT RESPONSIBLE FOR ANY FAILURES OR DELAYS IN PERFORMING UNDERTHIS AGREEMENT THAT ARE DUE TO EVENTS OUTSIDE OF ITS REASONABLE CONTROL.TO THE MAXIMUM EXTENT PERMITTED BY THE LAW, THE STATE OF CONNECTICUT,THE BOARD OF DIRECTORS OF PRECISION CAMERA & VIDEO REPAIR, INC. ANDTHEIR OFFICERS, AGENTS, AND EMPLOYEES WILL UNDER NO CIRCUMSTANCES BELIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGESRESULTING FROM THE PERFORMANCE OR OMISSION OF ANY REPAIR SERVICES,INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE; LOSS OF ACTUAL ORANTICIPATED PROFIT (INCLUDING LOSS OF PROFITS ON CONTRACTS); LOSS OFREPUTATION; LOSS OF OPPORTUNITY; LOSS OF USE OF MONEY; LOSS OFANTICIPATED SAVINGS; LOSS OF BUSINESS; LOSS OF OPPORTUNITY; LOSS OFGOODWILL; LOSS OF REPUTATION; LOSS OF, DAMAGE TO, OR CORRUPTION OF DATA;OR ANY COSTS OF RECOVERING, PROGRAMMING, OR RESTORING ANY PROGRAM ORDATA STORED ON YOUR PRODUCT OR ANY FAILURE TO MAINTAIN THECONFIDENTIALITY OF DATA STORED ON YOUR PRODUCT. PRECISION CAMERA &VIDEO REPAIR, INC. SPECIFICALLY DOES NOT WARRANT THAT IT WILL BE ABLE TO(1) REPAIR OR REPLACE YOUR PRODUCT WITHOUT RISK TO OR LOSS OF PROGRAMSOR DATA, OR (2) MAINTAIN THE CONFIDENTIALITY OF DATA. IF ANY PRODUCTSHOULD BE DAMAGED OR LOST WHILE IN PRECISION CAMERA & VIDEO REPAIR,INC.’S CUSTODY, PRECISION CAMERA & VIDEO REPAIR, INC.’S LIABILITYWILL BE LIMITED TO THE COST OF REPAIR OR REPLACEMENT OF THE AFFECTEDPRODUCT. PRECISION CAMERA & VIDEO REPAIR, INC.’S LIABILITY FOR ANYAND ALL DAMAGE SHALL IN NO EVENT EXCEED THE PAYMENTS RECEIVED BYPRECISION CAMERA & VIDEO REPAIR, INC. FOR SERVICES PROVIDED PURSUANTTO THESE TERMS. THE REMEDIES SET FORTH HEREIN SHALL BE YOUR SOLE ANDEXCLUSIVE REMEDIES FOR ANY BREACH BY PRECISION CAMERA & VIDEOREPAIR, INC. UNDER THESE TERMS AND CONDITIONS.

Backup of Data and Information: Precision Camera & VideoRepair Inc. is not liable for loss or corruption of data or yourconfidential, proprietary or personal information or removable data.Before you bring in your product for any repair service, you should makea backup copy of your data and remove any confidential, proprietary orpersonal information and removable media such as memory cards.

Abandoned Product: If you have not claimed your product andpaid all charges due within six months (180 days) after being notifiedby Precision Camera & Video Repair, Inc. that your product isavailable to be returned to you, Precision Camera & Video Repair,Inc. will consider your product abandoned. Precision Camera & VideoRepair, Inc. will provide such notice to you at the mailing address,email address or phone number you furnished when you authorized therepairs. Precision Camera & Video Repair, Inc. may dispose of yourproduct in accordance with applicable provisions of law, andspecifically may sell your product without liability to you. PrecisionCamera & Video Repair, Inc. reserves its statutory and any otherlawful liens for unpaid charges.

Complete Agreement: These Terms and Conditions are the onlyones that govern Precision Camera & Video Repair, Inc.’s repair ofyour product. No other oral or written terms or conditions apply,including any terms or conditions contained in any purchase order thatyou provide to Precision Camera & Video Repair, Inc. No one hasauthority from Precision Camera & Video Repair, Inc. to vary any ofthese Terms and Conditions.

Personal Information: You agree and understand that it isnecessary for Precision Camera & Video Repair, Inc. to collect,process and use your personal data in order to perform the service andsupport obligations under these Terms and Conditions.

Governing Law: The laws of the State of Connecticut will govern this Agreement.
