N. Mill Equipment is using malicious and fraudulent business practices that are not in accordance with the laws and procedures of the BBB. N. Mill Equipment has made a hard inquiry on my creditreporton March 19, 2025 without my authentication. Attached is a hard inquiry done on my ******** credit account which I did not authorized. North Mill Equipment has an account with ***** ******. The collateral that was subject to the Security Agreement was recovered and sold, leaving a deficiency balance owing in the amount of $125,519.42. A deficiency letter was sent to Mr. ****** on October 30, 2024 and follow up calls have been made. As a result of his lack of response, North Mill Equipment Finance is attempting to collect this debt and evaluating the account for further legal action. Creditors can access credit for permissible purposes, such as to determine creditworthiness, or when a debt goes into collections, as outlined by the **** ****** ********* *** *****). I am rejecting this response because:
There is not such debt to this fraudulent financial institution. Whatever debt is still on their records needs to be removed immediately. There is no legal reason for hard inquiries to be made on my credit report. And they have not presented any legal documents to further support such claim. I respectfully request for the malicious and fraudulent business practices to stop. And the harassment from these people has gone to personal levels. This or any further response need to be accompanied by legal documents.

Mr. ****** defaulted on his contract which resulted in the asset being repossessed, sold and after net proceeds were applied to his account, a deficiency balance remains. Attached please find the contract, Notice of Default, Notice of Private Sale and the deficiency notice. North Mill has a valid balance owed and has complied with all applicable federal and state laws. I am rejecting this response because:This equipment, which this fraudulent financial institution refers to, was not repossessed. This is one of many lies. This equipment was voluntarily returned by myself due to a fraudulent restructure of the loan these people came up with. Which tripled the actual loan. None of these documents submitted states the equipment was repossessed. Nor do they state there's any further debt. They are making all this fraudulent debt in order to rob me. Exactly what they are doing to all their clients and need to be stopped.

North mill has reported false information of a repossession on my credit report when they were paid off buy the insurance company an has constantly ran my credit with out my consent. This account was an insurance loss. By the terms of our contract and insurance loss is an event of default. The insurance company was provided a payoff in the amount of $108,102.15. Insurance companies issue payment based on the value of the collateral, stated value, or the policy limits. In this case the insurance paid $62,344.25, leaving a remaining balance of $45,757.90. A debtor would have the option to carry GAP insurance to cover the difference between the payoff and the amount the insurance company will pay.
We did have an issue in how we were reporting the shortfall, initially they were all reported as repossessions, and when the customer inquired, a former employee provided a letter clarifying that it was reported incorrectly as a repossession, and it should have been a charge off. Once addressed, the change to how it was reported was made immediately and changed from Repossession to Charge off.
Our customer is under the false impression that all accounts designated as a charge off are reported to the *** a forgiveness of debt and that we are required to provide a 1099c. A charge off does not mean cancellation of debt, the debt is still owed until it is paid/settled or forgiven at which time a 1099C is required to be filed. We are not forgiving this debt and sent the customer a deficiency letter, outlining the remaining balance. Initially the customer did respond to that letter and offered to start paying on the balance. He stated at the time he was not currently working but would start with $200 per month for six months, until he can get back on his feet. He never made a payment on this agreement, and as a result the account was forwarded to an attorney, and suit was filed for the remaining balance on the contract.
In summary, we did not report this to the *** as a cancellation of debt and therefore are not required to send a 1099c. We are pursuing the customer for the remaining balance through the courts, this is a valid debt owed in the amount of $45,757.90. As for pulling his credit, pursuant to the Fair Credit Reporting Act, your credit can be accessed by entities with a “Permissible Purpose,” including lenders, creditors, landlords, employers, with your permission. Exceptions to needing permission is debt collection issues.

Hi, i got a contract with this company, has been 2 years now and they been adding fees for months and now they claim we don’t pay the full amount every month when they invoice us for amounts then later the payment is short so they can add a late fee payment, I have to call every month they just not professional at all. *** ******* brokered a laser for me in October 2023 for the purchase price of $119,000 from North Mill Equipment finance but with taxes and fees ended up being 127,194.70 which was not disclosed on the contract. I did not know this was happening until later when I got an email from North Mill. This laser has never worked properly and the laser company even had to replace it with a second one and it still doesn't work. I've been trying to get some help before my 2 year warranty runs out and this had me looking at how much I owe on the machine. I now owe $166k. When I emailed *** to ask how I owe way more than I financed they basically said I signed the contract and nothing can be done about it. They said I chose a deferral and North Mill is the only ones who do that and they don’t offer early buyouts on deals that have deferrals. I did not ask for a deferral. They offered me $99x6 mos then monthly payments of $3256.08x60 mos. I took that because it was the only option they gave me. They didn't say "this is called a deferral so you will be waiving the right to pay it off early." They didn't say, once you agree to this, we are going to add up all of your 66 payments and you'll eventually pay $195,958.80 for this device along with a 15% monthly interest rate on that whole amount and you no longer have the option to pay it off sooner should you choose. North Mill did not disclose any of this either. This has all been a huge scam. Their financing terms constitute unfair and deceptive trade practices. They are praying on small business who don't know better by not disclosing all of the information and having vague contracts. This is how most go out of business within 5 years. I emailed North Mill for their amortization schedule because *** said it could be different from the one they JUST sent me. I haven't heard back. If the amortization schedule had been attached to the contract, I might have known that something fishy was going on and I could have asked more questions.Business Response

You signed an Equipment Finance Agreement with *** ******* on 10/30/23. On the first page of the agreement, the section labeled in bold “Disclaimer of Warranties and Claims” reads as follows: We make no representation or warranty to any matter whatsoever including the merchantability or fitness for particular purpose of the Collateral. This EFA is irrevocable. Your obligation to pay all amounts hereunder is non-cancellable, absolute, and unconditional and will not be subject to any reduction, setoff, defense, counterclaim, deferment or recoupment for any reason, even if the Collateral is damaged, destroyed, or defective. You acknowledge you selected the collateral and the supplier and your supplier is not our agent, nor are we their agent. You acknowledge that no one, including their supplier, has been authorized to waive or change any term or condition of this EFA. No representation by the supplier as to any matter shall bind or affect your duty to pay all amounts and perform all obligation hereunder. I am rejecting your response and writing in response to your statement regarding my Equipment Finance Agreement with *** *******. While I acknowledge the clause you referenced in the agreement, I want to highlight several critical points that were not adequately disclosed and that invalidate the contract under both the law and the terms of our agreement.
1. Fraudulent Misrepresentation:
I was explicitly told by *** ******* representatives over the phone that I would have the option to pay off the loan early without penalties. This is now contradicted by the fact that I was informed only in the past few weeks that such an option does not exist due to the deferral agreement I was unknowingly forced into. I was not informed that the $99/month for 6 mos was considered a deferral, nor was I told that such an arrangement would waive my ability to pay off the loan early. This lack of disclosure amounts to fraudulent misrepresentation.
2. Defective Equipment:
Additionally, the equipment provided under this agreement has failed to work properly since its delivery. Despite receiving two separate devices, neither has functioned as expected and has currently been broken down for over a month costing me tens of thousands of dollars in lost revenue. I was led to believe they would meet certain standards of performance. This constitutes a material breach of contract as the equipment has not met the representations made at the time of signing the contract. As the equipment has been defective from the beginning, I assert that this should void the agreement under applicable law.
3. Violation of Consumer Protection Laws:
Given these circumstances, I believe that North Mill Finance and *** ******* have engaged in deceptive trade practices, which entitle me to a full cancellation of the agreement and relief from the ongoing financial obligations. I have paid every payment on time and I still owe $166,000 on a laser sitting in the corner that will not work. Things like this are what shut us small businesses down.
I am requesting that North Mill Finance immediately cancel the agreement and work with me to resolve this matter fairly being that all of these issues are a breach of contract, misrepresentation, and deceptive practice . I have already filed a formal complaint with the ******** ********** ****** ** ***********, outlining the deceptive practices and issues regarding this contract. I expect that North Mill Finance will take this matter seriously and work with me toward a resolution.

A collection/repossession for a lease with North Mill Equipment, in the amount of $26378, suddenly appeared on my ******** credit report at the end of June, when an updated credit report was pulled during the closing stages of a home mortgage. This does not belong to me. It states that I am a co-signor on a lease opened in 6/2019 with a "last activity" reported in 2021. This has never been on any prior credit reports and is not my debt, nor have I ever co-signed for any leases. My lender, their credit report provider, and myself have all tried to call the company to have them validate that this does not belong to me however, no one at North Mill answers the phone and the call is sent to their voicemail. Several attempts to make contact with them to resolve this problem have failed and their mistake is causing me to be unable to close on my mortgage. I need to have this corrected ASAP, as it has caused major damage to my credit.Business Response

June 3, 2024 I opened my bank online to see two withdrawals that were unapproved and never discussed with anyone at Northmill. NMEF 3 for $1150.00 and NMEF Funder 2022 -B in the amount of $8791.24. We are current on our payments. Our payments are $1150.00 and we have been current. NorthMill is due today. I will pay once my bank has sorted out all payments from this morning. North Mill sent notice 02/16 to start charging us for insurance, they state that this is their final notice, yet, It was the first notice I received. unless we sent proof that we had insurance. Gave us 10 days. However, the notice is postmarked 11 days after the notice, and we did not receive it until March 9, I tried calling them to tell them that we have insurance. I sent numerous emails with proof of insurance. No one answers the phone, I left a messages. No one responds to my numerous emails. They added the $177.74 onto my payment and debited my account on 03/14. NO one has ever returned my phone calls or emails. I did send proof of insurance in the emails. I want the $177.74, that was unauthorized, returned. And I want them to stop debiting my account for insurance. This company is listed on our commercial insurance. I received a voicemail from Napoleon, at North Mill Financing late yesterday. He stated that he was going to overnight the refund. The address that he provided is incorrect. This is part of the problem. North Mill Financing has the incorrect addresses on their records. When I go online to try and correct the address, it does not allow me to. Someone need to contact me and verify our mailing address. The address Napoleon provided is a truck parking facility. North Mill needs to update their records to reflect our business address and mailing address. I will try to call Napoleon, however, this company has been non-responsive to phone calls and emails in the past. My company purchased a trailer in June of 2023. North Mill was the lender financing the purchase. North Mill sent the title to me, so that when registering the trailer with the state, I could have the title sent to ******* to be filed as an electronic lien. We went to tag place and registered the trailer and all paperwork (including title) was sent to *******. ******* rejected the paperwork several times for various issues (PUC number issues, manufacturer was not listed in their system, etc..) North Mill was contact with me via email several times and via phone once on 1/24/2024. Each time they emailed me asking the whereabouts of the title and to which i responded the issues we were having with *******. I received a call from North Mill on 1/23 and they left a voicemail asking about whereabouts of title. I called the tag place that processed the paperwork on 1/24 and inquired on the status of registration, to which, the tag rep told me that ******* has since lost all of our paperwork and also informed me that North Mill called them the day before on 1/23/2024 inquiring as to the whereabouts of the title. The tag rep explained the situation and that the tags were currently lost in ******** system. North Mill knew exactly what was going on as to the status. On 1/26/2024, North Mill electronically deducted $1,000 from my bank account without my permission. When I called the Title Dept and spoke with Yocasta (who was very rude and unprofessional), she informed me that they basically thought I was evading them by not returning their calls or emails, so for that they are penalizing me with a $1,000 penalty. I explained the situation and that I responded to all their contacts. She kept talking over me and i finally asked for supervisor. I have put in several calls in the last two days and they keep telling me shes in meetings. I read my contract and there is nothing there mentioning title filing deadlines or anything about govt titling issues. This looks like a breach.Business Response

North Mill Financial has engaged in fraudulent activity by billing charges to an equipment account without any legal justification. When these activities were identified we decided to declare a breach of contract. Furthermore, they have stated they are not bound by any federal or state laws to follow lending laws. The contract fails to have any legitimate binding clause preventing early termination and termination fees. Furthermore the contract is purposefully designed to be misleading and therefore predatory in nature. Staff failed to verbally explain any hidden agreements or expectations not detailed in the agreement. I truly believe this bank can easily be held accountable at the federal level with the right legal representation and funding. I have reviewed over 500 similar reviews from other small buisiness victims much like my self. I would like to gather those willing to prepare for a class action lawsuit. Its companies like this that need the maximum undivided attention from the BBB.Business Response

On July 2021 I purchased a truck with a loan from North Mill Equipment Finance NMEF. I spent a whole year paying my truck and decided to buy another one. It was like they couldn't get me on the first truck, so they went all in on the second one type of deal. They noticed I was never late on my payments with the first one and I didn't have any issues with them until unfortunately I get into an accident on October 2022. My insurance company looked at the truck a said it was fixable. That's when all the problems started with these NMEF people. I had paid 3 months on my 48 month agreement of 3,700. I had to stop paying for this equipment because it was in the shop. I was injured in the accident and couldn't work. While the first truck was never late, I kept paying it on time because I had someone driving it while the other truck was fixed. At first they were fine ,but because of some miscommunication, the shop took longer than usual to fix my truck. So I spent 6 months waiting for this truck. Once it was out of the shop, these NMEF people didn't want me to pick up my truck unless I signed a restructure of the debt. They illegally provided my private information to the shop and tried to hold them accountable if I took my truck, threatening them. But since it was my insurance company who had paid for this repairs, the shop released the truck to me, with no consequences. Then they aggressively went after me ,threatening me with repossession of the truck if I didn't sign a restructure. I asked for the document to review it, and these people had tripled the original agreement price and were expecting me to sign. When I asked why they were doing this, the answer was with a whole bunch of lies and mathematical equations only they can understand. They told me that there was information they do not provide, so I couldn't get where they were getting such huge amounts on a simple math that just needed to add 6 payments that I missed. I am rejecting this response because:Back to the same spot. Again, North Mill Equipment Finance LLC trying to deceive with subtle lies. Using terms that seem wonderful at first glance, but after a deep analysis are malicious, in a fruitless attempt to denigrate their clients and make them look bad just because they are defending their investments and did not fall for their ilegal business practices.
How am L going to request an interest free loan? That assertion in itself is ridiculous and malicious. Unheard of. First, the staff, Ellen M*****, at NMEF made it clear to me that they do not provide information regarding the interests to any client. So, how is it possible that I want an interes free loan if I'm not even provided with the interest informacion. This is simple math equation. A first grader can answer. If you were going to pay $1000 and in a restructure, you're going to end up paying triple the actual amount $3,000. How does interest decrease here? Someone please explain.
I see this response from NMEF as disrespectfull, not only to me , but also to this honorable institution BBB.
in addition, I wold like to provide the contact information from the shop that did the repairs on the truck. They can testify on how these people at NMEF tried to threatened them with lies, to keep them from releasing the truc, in order to get me to sign the abusive restructure they were presenting. Northmill Equipment Finance never attempted to negotiate a fair and equitable agreement and settlement on the debt restructure. In addition, the equipment was late 6 months due to an insurance claim and settlement that took over 3 months to determine that the Semi-truck was repairable or not leaving me in a situation of pass due amounts. The period of non-payment went from November to April. We paid August to October and May to July. What is true is that Northmill Equipment Finance would only settle in adding $92,000.00 to their profit and leaving me in a debt trap of over 67 months. Any reasonable consumer or business would walk away from such an abusive offer and deceiving contractual practices. The broker received a $20,000 down payment and does not provide any additional assistance. We returned the equipment to Northmill Equipment Finance. Therefore, we are not interested in bringing the account current. We are interested in highlighting that our second financed equipment is not collateralize to the vehicle in question per the original contract. The company has used the term collateralize to Repo our vehicle that has been up to date on every payment.Since May of this year 2023, I have been trying to figure out what accommodating means for this North Mill Equipment Finance LLC company. There are wasted hours, a large number of saved emails, a large number of recorded calls as evidence that this company has no intention of accommodating me in any way, shape or form. On the contrary, they are trying to rob me with crooked business practices, with absurd lies, with illegalities. Using persuasive terms, as they just did in this response, to see if I give in to their malicious intentions. Wasting my valuable time as well as this institutions BBB valuable time.
All I need is for these people to provide a legal document signed by me that has my other truck co- collateralized with this truck. If not, to call off the repossession attempt on my 2016 ************ ********.

It is completely disappointing to see how easily this honorable institution BBB considers illegalities and lies as legitimate answers to a serious complaint. I am still waiting on a legal document with my signature that collateralizes the truck I returned to the truck I am paying. I am not only unsatisfied with the runaround this company North Mill Equipment Finance LLC has done. I am unsatisfied with BBBs closure to this matter without any type of concrete solution or answer from the company.
