      Ms. ***** ***** form this firm called an basically threatened me about some outstanding bills that is owed by a James Wilson, who apparently had the telephone number that I now have prior to me. This has been going on for over a year and it has gotten out of hand. I suspect that this is spam and each time I block the number I get called from, I get called from another number. The numbers they call me from are always local numbers but I was able to find out that they are located in Delaware, this is according to Ms. ***** *****. Is there something that can be done to stop them or is there a direction that the BBB can point me in to assist with these calls.

      Tim *****’s complaint claims he was threatened by a representative from our company over the phone in regards to outstanding bills. He states he has had the phone number in question for over a year and continues to get these calls. Mr. ***** would like all calls to cease.
      Upon pulling the recordings from the calls with Mr. ***** at no time did our representatives threaten Mr. *****. In fact, they were professional at all times. Mr. ***** was in fact the one that was rude and actually used profanity on one of the calls. On another call, in which Mr. ***** called us, he advised our representative that he was going to have the police come get her.
      It is obvious we have the wrong number on file and once we were notified that it was indeed the wrong number, it was immediately removed from our system.
      Mr. ***** will receive no more communications from SIMM Associates. Should he have any questions he may contact **** ********* **  ************************ ** **** ** *************** ********* *****

      I have reviewed the response made by the business in reference to my complaint and have determined that this does not resolve my  issue.  For your reference, details of the offer I reviewed appear below.

      **In order for the bureau to continue to assist you, you MUST provide your view on the matter or your complaint will be closed as answered.

       

        Every time they have called I have told them that they have the wrong number and have given them my name and have asked them to stop calling and each time I get told that my name and number will be removed from their system, same as they have told the BBB, but they have continued to call and try to bully me over this!!    They call from a local number so that I will answer and when I answer I find out that it is them again.  I ask them to stop calling and remove me.  I block the number they are calling from but each time they call me from a new LOCAL number, same as a spam caller does!   There has to be something that the BBB can do to assist with the shady practice of using the spam system to call someone!

      *** *****’s complaint claims he is still receiving calls from our company and he feels calling from a local number is a “shady practice”. 
      We have not made any call attempts or any other form of communication with Mr. ***** since his initial complaint. His accusations are simply false as the account that was associated with the original calls is no longer in our office.
      In regards to calling from local numbers this is common practice and perfectly legal. SIMM Associates owns these phone numbers and when called lead back to our company.

      On around October 4, 2021, I received an email from Simms associates stating that I had 3 payment options to settle with Klarna. The first option was to pay $25.57 in one payment to be paid in full. I chose that option, paying them that evening, and the payment was finalized on my bank account on Oct 6, 2021. I called to ask them why this payment wasn't marked as paid in full, as they were trying to make me pay another of the 3 option accounts, and I was informed that I have a payment scheduled to be taken from my bank account on Nov 4th, 2021. The one payment was to settle the account, which was now false, as they are charging me for the entire amount, going back on their offer of settlement to me and charging me the full amount since they have my banking information, which I feel is correct and they feel they have me where they want me and can do what they want.

      **** ******** was sent an email by our company on September 30, 2021 in regards to her two past-due Klarna accounts that she established when making purchases at oldnavy.gap.com. On October 4, 2021, she logged into our payment portal and set up two payments in the amount of $25.57, one dated for October 4, 2021 and the other dated for November 4, 2021, to pay off one of the accounts. On October 5, 2021, we generated a settlement offer via email to Ms. ******** advising that we would accept payment for $25.57, due by October 20, 2021, to settle the account. Since Ms. ******** received our settlement offer email after the payments for the full balance were submitted, we have canceled her November 4, 2021 payment in the amount of $25.57 and closed the account as settled.
      We apologize for any inconvenience this may have caused as it was due to a timing issue. Should she have any questions she may contact *** ******** **  *********************** ** **** ** *************** extension *****

      Their response is false. They only sent me the one offer, which is the copy of the email I sent, which was dated on 10/4/2021. I called their office immediatelyprior to registering this complaint, and the November payment was still scheduledtobe taken from my account. That was when I decided to file my complaint with the BBB totry to straighten out the matter. The lady I had spoken to on the phone stated she would have my case manager call me about the issue, and I'm still awaiting said call. I feel they had every intentiontocharge me the full amount instead of their proposed amount. Because of their shady practices, I WILL NOT do business with them to settle the other account.

      **** ******** still disputes this account. She claims she was only sent 1 email. This is simply false. We have records and account notes that would contradict that statement. I have copied below our original response which we still stand by. Ms. ********’s account remains closed in our office and all communications stopped after her initial complaint in October.

      I have been receiving emails from Simm Associates Inc stating that they are trying to collect a debt from paypal (ref #15491044.) I have no such debt. Paypal shows that I have no debt with them. I would like to receive no more communication from this company.

      We received Ms. ******’s account on December 7, 2020. Our records, provided by PayPal Credit, indicate that this account was opened on May 16, 2016. If Ms. ****** feels this is in fact a case of fraud or would like to dispute the balance, we suggest she contact PayPal directly as they would be the ones to help resolve the issue.
      Due to this complaint, we have closed her account within our office and forwarded it back to PayPal. Ms. ****** will receive no more communications from SIMM Associates.       I received an email from this firm that was marked as "spam" saying I owed over $1300 on a PayPal account that is not mine. It's exactly the same thing as the other commenter, and I believe this is fraud.

      Samantha *******’s complaint states she received an email from our company that was marked as SPAM and showed an unpaid balance for her PayPal account. Ms. ******* claims this is not her debt and is fraud. She would like all communications to stop.
      We received Ms. *******’s account on May 28, 2021. Our records, provided by PayPal Credit, indicate that this account was opened on January 4, 2016. If Ms. ******* feels this is in fact a case of fraud or would like to dispute the balance, we suggest she contact PayPal directly as they would be the ones to help resolve the issue.
      Due to this complaint, we have closed her account within our office and forwarded it back to PayPal. Ms. ******* will receive no more communications from SIMM Associates.       I received a collection letter from this company about a “negative balance” with PayPal of $41.37, and I do NOT even have an account with PayPal. I am not going to spend my time chasing down PayPal or fighting with this company due to dozens of similar complaints. The fact is this is FRAUD. The SIMM account number they put in the letter is 17256940. The letter says they opened their account with me on 3/19/21 and the account number they listed is 1938418155095573196. I do not want to email or call this company due to the above mentioned dozens of identical complaints.

      I have been receiving an obscene amount of phone calls from SIMM Associates. When I ask who is calling me, they tell me it is in regard to a personal business matter but won't tell me who they are unless I verify the last 4 of my social security number, birthdate and address. I do not feel comfortable giving that information without knowing who/why they are even calling. I finally was able to get a company name after a few phone calls but still nothing more than a personal business matter as to the reason why they are calling. Every person who has called me has been extremely rude and non informative. I don't understand why I have to give all my personal information to find out why they are calling me to collect money. I finally was able to get ahold of someone today Monday, August 9, 2021 after trying to make an online account. They finally tell me that my account was closed as of 8/5 and to contact Fristmark services. I never want to receive phone calls/mail ever again.

      Jessica ****** states she has been receiving an “obscene” amount of phone calls from SIMM Associates and when she asks who is calling, she is advised that it is a personal business matter and no other additional information can be given unless she provides personal information for authentication purposes. Ms. ****** also feels that our representatives have been rude and non-informative.
      Ms. ******’s past due Towd Point Master Funding Trust 2021-SL1 private student loan serviced by Firstmark was assigned to our office for collections on July 16, 2021. Our first contact with the Ms. ****** occurred on July 20, 2021, at which time the she refused to provide information in order to verify with whom we were speaking. Our representatives are required to gather this information to ensure that we are speaking with the correct party and no third-party information is given. On August 9, 2021, Ms. ****** called in to advise us that she wished to have all future calls stopped and would be contacting the Better Business Bureau. The account representative advised her that the account was closed and returned to Firstmark and additional questions regarding the status of the account should be directed to them.
      Ms. ****** will receive no more communications from SIMM Associates. Should she have any questions she may contact *** ******** **  *********************** ** **** ** *************** ********* ****.

      I received a letter, with my last name misspelled, from Simm Associates dated July 26, 2021 indicating that they were collecting an outstanding debt of $30.27 that I allegedly owe to PayPal. I immediately called PayPal and talked to PayPal . They verified that I have no outstanding balance and there was no other account opened up under my name or my social security number. After reading numerous similar complaints filed against Simm Associates I must believe that this company is fraudulent and a scam. I want Simm Associates, if they are a real company, to remove my name/address from their mailing list and not to contact me any further.

      I received the attached letter dated May 11, 2021 from SIMM Associates informing me that they were collecting an unpaid amount of $49.52 for a PayPal account. I did not open that account. I called the phone number on the letter on June 1 and was informed they would contact PayPal to review the account. I called again on June 14 for an update and was told the PayPal investigation was not complete. I was told I would hear from them when it was. I called again on Aug 5, 2021 for an update and was told since the date of birth and email address they had on file for the PayPal account in question did not match mine, they could tell me nothing. I have logged into my PayPal account and find no unpaid balance there. I would like PayPal to delete the account someone has created in my name and cancel the collection by SIMM Associates.
