    On 10/27/22 I entered into a contract (see attached) with Smithbilt Deck and Patio ****** ***** ************) for a new 12' x 27' Trex deck and screening of my existing covered porch. The total was $17,825.00. I wrote a check at that time for 1/3 of the amount ($5941.00). Smithbilt cashed that check. My HOA package was submitted including Smithbilt Bond/License (see attached) and they approved the deck project in December 2022. I provided the approval notification to Smithbilt immediately. Smithbilt has provided little communication or correspondence to my phone calls or text messages (will provide under separate correspondence). When they do offer dates to start or deliver material, they do not. They have not met ANY commitments they establish. James of Smithbilt has been experiencing health issues and stated another person would be filling in but again, NO contact. At this point, I just want my $5,941.00 deposit back. I have requested this in text messages and phone calls to Smithbilt but have not received any correspondence back.

    The contractor told me he would be working on permits and gathering materials for the project. I have contacted my community HOA and he hasn't made any attempts on obtaining permits. I also asked him if he had the materials and he told me no. I requested for him to purchase materials and Bring to me until the job can be started and agreed to and stopped responding to all forms of communication after that.
