ON JULY 14TH OF 2022 I WENT INTO CONTRACT WITH TAYLOR MIZELLE THE OWNER OF MIZELLE CONSTRUCTION HAS STOLEN $6200 OF MY DEPOSIT MONEY!!! REFUSES TO ANSWER MY CALLS OR TEXTS!!! I ASKED FOR A ESTIMATE FOR DAMAGES WITHIN MY HOME AND CHARGE ME $650 DOLLARS FOR AN ESTIMATE?!?! THATS COMPLETE LUNACY!!! NEVER AGREED TO ORIGINAL CONTRACT AND TAKES IT UPON HIS SELF TO CHARGE FOR THINGS NOT AGREED UPON! I CAUGHT HIM SMOKING MARIJUANA ON THE JOBSITE! ONLY SHOWS UP A COUPLE OF DAYS OUT OF THE WEEK AND LEAVES AT 2PM. WILL TAKE ON MORE JOBS AND LEAVE YOU ON THE BACK BURNER. ORIGINALLY PROMISED TO COMPLETE JOB IN 45 DAYS AND ITS PAST 90 DAYS AND ONLY A 1/3 OF ITS BEEN DONE!!! IM OUT A LOT OF MONEY!Business Response

Business Response /* (1000, 5, 2022/10/28) */ I was working with this person to help complete home renovations started by previous contractors that he claimed had ripped him off and stole his money. I agreed to help him out by honoring the quote from his previous contractor but anything beyond that would be charged separately. He did add things and change things which did require to be charged separately, including several repairs needed due to damages made by his plumbers. He began accusing me of overcharging and demanded a breakdown of everything completed and everything left to be done, line itemized specifically. I told him I'd like to go over the completed breakdown with him personally so that I could explain it in detail and answer any questions. I arranged to meet with him twice but both times he did not show up. When he did finally call me I was working on another project, to which he became very irate and began ranting again about me stealing his money and not paying me anything else. Later he began repeatedly harassing me, my wife and another of my employees with irate and threatening calls and texts. I chose not to answer his calls or texts for 2 days while I was away at my son's baseball tournament which is apparently what sent him over the edge. He told me that he would stop at nothing to make me pay for disrespecting him (by not answering his calls or texts) and that he would do everything he could to bring down my family and my company. He told my wife that he wasn't going to stop until she felt his wrath, cursed at her and said he would drag her through the courts too, despite her having nothing to do with his project. My wife has her own full time job and does not work for me nor had she had any prior communication with this man until he somehow found her personal cell number and began harassing her earlier this week. He also started calling my subs and telling them that I was on drugs and they shouldn't trust me or do work for me. He's also resorted to posting these slandering false claims on every social media outlet. His unprofessional and threatening behavior has left me with no option in resolving this amicably so we hired an attorney and a Cease & Desist demand is being served immediately. I haven't stolen a dime from this person. Please advise if the BBB needs something from my attorney in order to halt these false complaints from posting. This is basically the complete story of what happened... We have a mutual friend and his name is ***********. I stated to him that I been having trouble completing my house getting renovated because of a previous contractor of ripping me off. He told me I know of a guy that worked for me years ago and he did a good job. I trusted his word and when I went to review Mizelle Construction I did in fact see he was certified general contractor. The only red flag to me was zero reviews online only ***** word. So I asked John again and swore to me Mizelle would help me out. I got an estimate from from a different contractor and I asked Mizelle if he could match it and if so I would use him for the job and he agreed. He stated to me that he is working on another job at the time but he would work me and make it happen. Mizelle stated he would have the job completed in about 45 days tops by the time he walked off the job I was over 90 days in. At 1st I was impressed he came out with a crew and stated working. He stated he mowed my yard and cleaned up all the trash everything all over the property. I was like wow that was nice of him. The trash though was created by my roofing company which was still on the property in transition of completing it. Originally it was their responsibility to clean up when they were done. Later on I found out that he took it upon himself to charge me to mow the yard for $150 and $450 to clean up around the property! I never agreed to it in the 1st place! He did some other things like demo a outdoor bar and demo a small brick wall which he stated he wouldn't charge me much and I found out it was $1300 which is insanely high! He also shifted my kitchen island around 3 times which took about 30 minutes to figure out what direction it should go and he charged me $1000 dollars! As the roofing company I hired loaded tile onto my roof they created holes and I had water damage within my house while Mizelle was working. I asked him for an estimate to repair additional damages within my home and he tacked on a $650 to make the estimate! I would say during the 1st and 2nd week he worked 2-3 days each week 3rd week he told me he had covid and couldn't make it and that he would make it up the following week which still he only worked a couple of days. Every following week it was the same thing over and over only worked a couple of days from 8am to 2pm made multiple excuses why he could not show up it was either main excuse "baseball for his son" or ac went out he was sick and then he admitted to taking on more jobs which infuriated me because I'm on a time crush to get it completed from taking on 2 mortgages and have to sell my old house to recoup money I spent on my new house. I told him most likely I would have to take out a loan for a old house to get my current house completed. He proceeded to tell me that he has terrible credit and if I got him a $200k loan he would pay me a high interest rate if necessary. I'm saying to myself what in the hell is going on here how dare him ask me something like that! 5th week of him working I caught him smoking marijuana outside he told he has to smoke because it calms his nerves and anxiety! Later that day he texts me do you think you can Zelle me $100.... Im like for what??? He said he needed to get materials for my house tomorrow and he was waiting on money to come in! While I have already given him over $20k! That's a huge red flag! I told *********** what was going on and he swore he wont screw me over. So like the fool I am I believed him. He saw that I had a prescription for Adderall in my kitchen and asked he can have some multiple times! He literally turned into the contractor from hell and after 3 months of his nonsense. I stated to him we have to talk because his revised estimate for everything was not was agreed upon and something had to get fixed or I was going to cut him loose. He kept asking for more draws of money and then kept working less and less. We met up at my house and went over everything and he got extremely anxious and frustrated and walked out of the house multiple times I had to talk to his helper to mediate everything. Mizelle finally came back into the house and gave the revised invoice which showed he still owed me a credit of $6200 dollars he stated if I agree to the new invoice that he would be fully committed to my project for from here on out. The same week when he did not show up on a Thursday he told he had to take quick door job that was essential and he would be there the following Monday. When he told me that I snapped I stated I wanted my $6200 credit back. He told me he would call me back after he got back home later that day. Which never happened. There after the whole entire weekend I called and texted about 20 times with no answer. I reached out to his wife which was completely unhelpful. Tommorrow I will be filing a police report with Seminole County Sheriff Department and proceeding in small claims court. Hopefully Taylor M****** will be arrested for Grand Theft and procession of Marijuana. Business Response /* (4000, 10, 2022/11/17) */ Yes, a mutual friend did recommend me to Mr. ********. Yes, I was in the midst of another project when I first reviewed and proposed Mr. ********'s project. He told me that his previous contractor ripped him off and he urgently needed to get the project completed. He said he'd already lost a lot of money and time so I agreed to help him by honoring the original contractor's estimate but there was additional work required outside of what the estimate listed. I advised those things would be charged additionally and Mr. ******** agreed. I had a break in my current project so I was able to get my full crew on his project 3-4 days for the first couple weeks but did have to return to my other project to get it finished up. I tried to split my time between both projects in the weeks to follow because as Mr ******** previously stated, he was in a time crunch and facing two mortgages, so I was doing what I could to help. Yes, I do help coach my son's baseball team so I try not to work evenings or on weekends. Yes, I did have Covid and was unable to work for several days. Yes, the ac did go out in my personal home and I had to spend a day tending to that. Yes, I did have to spend another day and a half completing a door install project that I previously committed to well before I began Mr. ********'s project. Yes, we did have to shift around the kitchen island at least 3 times for Mr ******** to decide out how he wanted it, which took way more time than just 30 minutes. Yes, I did charge him for cleanup and to haul away the debris that his roofers loaded into my dump trailer, without permission, when I wasn't onsite. They did not ask, get my consent or offer compensation and I did notify Mr. ******** of the situation. Regarding his drug accusations, the marijuana incident he is referring to is a day when he pulled up to his house and smelled it outside and asked me if I was smoking weed. I said no sir and pointed up to his roofers who had been smoking every day since I had been there working. However, I did joke with him that maybe I should smoke because it would help calm my nerves and the anxiety he was giving me. He never caught me smoking because it never happened. While doing kitchen renovations at his other house, I asked him to clear off the kitchen counter so I could finish up, which included removing his prescription bottles. He told me one of the bottles was for adderall and then went on to say that his previous contractor would sometimes barter his pay for adderall. I never asked Mr. ******** for his prescription drugs. I never asked Mr. ******** for a $200K loan. That doesn't even make sense. Yes, I did ask him to Zelle me money for additional supplies I needed to purchase for his project, same as we'd done since the beginning of his project, as agreed upon. Yes, we did have a meeting where I did get very frustrated with how Mr. ******** was berating me so I stepped outside. My apprentice stayed inside to try and "mediate" but Mr. ******** was already very combative and agitated so we left soon after. I did return the following week to finish the cabinetry work, drywall and a few other carpentry items, which completed the $6200 credit that he keeps referring to. When I tried to explain this to him, he became irate. He continued to call and send hostile texts and I chose not to respond to him the entire weekend while I was away at my son's baseball tournament. Unfortunately, there's nothing more I can do to remedy this situation outside legal action. As I stated previously, Mr. ********'s slandering false claims on every social media outlet, to the State Dept & BBB, as well as his unprofessional and threatening behaviors, have left me with no option in resolving this amicably or without an attorney. I have provided my attorney with dated pictures for proof of all work I've completed at Mr. ********'s projects. I truly wish he would've chosen to cool down for a day and reconvene with me to facilitate this in a decent manor but my attorney has found that Mr. ******** has done this same thing to many other subcontractors and companies, all for the supposed same reasons.
