5 starsWords cant express how thankful we are to ****** and the Sposen Signature Homes team. Yesterday, my parents were caught in a severe storm, and I was terrified for them and their new home. However, thanks to your incredible craftsmanship, they stayed safe and sound, never lost power, and barely noticed the storms impact. Waking up this morning to find the house in perfect condition was such a relief. Your commitment to quality and protecting families like mine means everything to us. Very deceptive practices from beginning to end. The sales consultant told us it should take no longer than 12 months to build our home (even with pandemic delays), knowing full well it would take much longer. We had 5 different construction managers. Communication was horrible. After voicing concerns to the owner, we promptly received an invoice for an additional $41k due in 5 days. He claimed the charge was a result of delays due to the pandemic almost a year earlier. Even after involving an attorney. Sposen refused to produce invoices to substantiate the invoice. The owner happily referred us to our contract that states he didn't have to justify price increases and that he was not obligated to notify us of charges in a timely manner. We were told any negative reviews on ****** would result in a slander lawsuit. When we finally moved in, we discovered the craftsmanship to be subpar and definitely not worth the cost. Our experience with Sposen Signature Homes equates to financial fleecing, price gouging, customer intimidation, mismanagement, and wilful misconduct.Sposen Signature Homes, LLC

1. Very deceptive practices from beginning to end.
Response: We highly disagree with this statement; As a scattered lot builder that doesnt provide the land to build on, we make it a point to disclose all the risks of vertical construction on lots of our clients choosing. We fully disclose all these risks within our written agreement with our clients. There is no fine print, all the text is in 12 font, a complete copy of our agreement is attached hereto for your reference of the same as I answer the questions below. This is a situation where the owner chose to build on a lot that required a seawall, the seawall permit and construction caused a large delay in the start of the project, which then caused additional costs due to the delay of start. All of which are disclosed in our agreement well before starting. ******************** hired an attorney to review our agreement as well as the cost shifting language due to the delay experience from a site-specific issue outside of the builders control. His attorney advised him that the monies were due under the contract, and he paid them. The house was delivered, and he signed off accepting the house which is reflected in our final walk sheet (attached).

Response: A. Our build times are disclosed in our agreement under paragraph 11: Builder shall make all commercially reasonable efforts to achieve Completion within one (1) year from the delivery to Builder of the certified copy of such Notice of Commencement. This Contract shall be in full force and effect until the date that is the earlier of (i) when all punch list items hereunder have been completed by Builder in Builders determination, (ii) any date this Contract is terminated prior to the completion of such punch list items pursuant to the terms hereof, and (iii) two (2) years following the date hereof, unless extended by mutual written agreement of the parties by the execution of an amendment to this Contract, and subject to extension for delays due to (a) Change Orders and/or (b) acts of God, strikes, lockouts , material shortages, lack of availability of utility services, fire, storm, theft, vandalism or other causes beyond Builders control (each of such events in this clause (b), an Event of Force Majeure). In no event shall Builder be liable to Owner for any damages for such delays and Owner hereby waives any such claims.
B.This language is clear and puts ******************** on notice that we will do our best to finish the home within 12 months from the signing of the Notice of Commencement, but is in full force for 2 years, PLUS any force ******. ******************** choose to build on a lot that required a seawall which caused a large delay in his start which then pushed his job into the time where there were mass shortages of both labor and materials. To top it all off, we had a direct hit from a category 5 storm which further extended build times another 4 months due to no power, internet or even accessibility. (would like to share the document)
C. To ensure that our clients dont have any verbal promises outside of our written agreement and because Sposen Homes is not part of the initial meetings and discussions with the licensed realtors who sell the products, we have an additional provision to our contract that basically tells the owners that if there were any verbal agreements that counter the written contract they need to let us know. That is covered under paragraph 17: 17. ENTIRE AGREEMENT. This Contract constitutes the entire agreement between the parties with respect to the transaction contemplated herein, and it supersedes all prior understandings or agreements between the parties. If there was a promise of a 12 month build by a sales agent then ******************** should have come forward with the conflicting information when he read and signed the agreement as it states up to 24 months, plus an items of force majeure.
3.We had 5 different construction managers. (would like to share the document)
Response: There were and still are challenges with the lack of skilled labor in the construction industry, this is an industry challenge and not a Sposen Homes challenge. We invest in high-quality construction managers, offering a competitive annual salary a company vehicle, and comprehensive benefits such as medical, dental, and retirement plans. Despite these investments aimed at driving production, the challenges persist within this industry when it comes to retaining quality construction managers.
Response: We communicate everything through our build portal via messages, schedule share and daily logs. ******************** had full access to this. For instance, there are 332 daily log posts with updates and pictures, so to say communication was horrible just doesnt make any sense. (Can't upload documents but have screen shots to share).5. After voicing concerns to the owner, we promptly received an invoice for an additional $41k due in 5 days.
Response: The reconciliations were sent as a provision of the contract On had nothing to do with the other. My staff or I was always available to answer any questions they may have had. The invoice was for the delay costs as outlined in our agreement; we sent the full detail to him on 5/17/2022 a copy of which is attached. The charges had nothing to do with the pandemic, only the delay of start due to his seawall. A full accounting of his original pre-approved costs against the final pre-approved costs was provided as well as a full accounting of all the allowance items. (Would like to share the document)

a. See attached ******** cost increase email as well as two attachments outlining the details of the over items. See the body of the email that references the provisions in the contract that allows for the cost shifting due to the lot specific delay of start because of his seawall. His attorney reviewed all this and advised him that it was due and he paid it. I attached a copy of the email between our legal and his attorney where his attorney agrees that it is due and advised him to pay.
7. We were told any negative reviews on ****** would result in a slander lawsuit.
a. We do pursue any slanderous statements that are factually incorrect. I believe his attorney advised him against this as well.
8. When we finally moved in, we discovered the craftsmanship to be subpar and definitely not worth the cost.
a. Our homes are all built to a specific standard that is outlined in our agreement under paragraph 32. We are one of the only builders that I know of that commits to this type of oversight of our work. We also hire a 3rd party engineering firm that is hired by the owners to oversee all the inspections. At the end of the build, we complete a ******************************************************************************************** our agreement with the owners. There is no way to do subpar work with this type of oversight.
b. As a final check to make sure the owners are happy with the home, we have them perform an in person walk and homeowner orientation. The house was built so well that his walk only had 4 items on it, all of which were completed and signed off on by him prior to taking possession (see attached walk form). The form states right above his signature: I acknowledge that this is the final list of items that need attention. There have been no verbal commitments beyond what is outlined in the list. The only obligations by the builder to ready the house for delivery and my final acceptance are in writing above. He signed the form and initialed on each item as being complete. A copy of this form is attached, which shows he agrees the home is built to the standard and quality promised.
9. Our experience with Sposen Signature Homes equates to financial fleecing, price gouging, customer intimidation, mismanagement, and willful misconduct.
a. We dont see it this way and the documentation provided should show that.(We have several documents to attach but are unable to here - please advise on the best way to share these documents)
