      I rented a unit from this company, and it is ***** infested. Management refuses to do anything about it. The pool is filthy and cannot swim in it without getting sick. We are supposed to have Valet garbage, but they never pick up the trash which causes more bug issues, and the gym is supposed to be 24 hours but there is no access.

      ******************************* on June 14, 2023, took occupancy of a dwelling unit at ************************************************************************************************************ to a residential lease agreement with The Preserve at **************, a multifamily apartment community.  She immediately contacted the community management office complaining about roaches. ******************** previously lived in **********.  Such complaints are common with residential tenants relocating from northern states. Notwithstanding that, the landlord immediately arranged and paid for professional pest control treatment of her apartment.  ******************** failed and refused to perform the pretreatment requirements.  The professional pest control vendor made three (3) attempts to treat the apartment, but could not because of ********************** refusal to make the apartment ready for treatment.  After the third attempt, ******************** demanded that the treatment be rescheduled two weeks out.  ******************** finally thereafter made the apartment ready for treatment. The full treatment took place on August 11,2023. On August 12, 2023, ******************** complained that she still had roaches. We contacted our pest control vendor and were advised that there was not any pest control problem in that apartment before the treatment and there could not be a problem after the costly treatment was performed.  If the alleged ***** problem was so bad, why did it take ******************** almost two (2) months to make the apartment ready for treatment?
      After this and other unpleasant experiences with ********************, we decided to look more closely at her application for rental.  In our opinion,******************** misrepresented material facts in her application.  Because of that we have terminated her lease with us.
      ********************** allegations in her BBB complaint are demonstrably fabricated. There is no ***** problem in her apartment. She has never complained about the valet trash service, nor have other residents.  The pool is spotless and maintained in accordance with the law. Finally, the gym is open 24/7 and we have never received any complaint from ******************** or other residents about it not being open.

      ******************** has now misrepresented material facts to the BBB.

      I am rejecting this response because:

      I have attached just a FEW of the emails I sent to management in regards to these matters. I moved into the ***** infested apartment because I had no choice. Management kept pushing back my move in date to deal with the ***** infestation which resulted in me almost becoming homeless. Management promised to take care of the problem and never showed up. When the exterminator DID show, neither management or the exterminator provided clear instructions for me so naturally- I was not ready! I never had to deal with roaches before regardless of where I came from. I live in a clean apartment.  I have been discriminated against and harassed by management. This is the second time they accuse me of falsifying my application when in reality it is THEIR management not being able to perform their job duties. Bring on the eviction, I can not wait to stand in front of the judge. You are terminating my lease so you dont have to deal with your ***** infestation. The proof, the videos and emails speak for themselves.

      Management of my living community has retaliated against me with a letter of non renewal based on the fact that they created a barrier between me contacting the corporate office due to their negligence, because we received rental assistance that they did not want to accept. Eventually, because we did not stop asking for corporates number they did how ever accept part of our payments but did not handle this appropriately. Now they're telling me I have no right to contact corporate and that they are the last point of contact for handling any issues we may have. The decision for non renewal was solely in retaliation for us attempting to contact they're corporate office to make them aware of there behavior and non professionalism.

      Business Response /* (1000, 5, 2022/01/06) */ This complaint is not only frivolous but full of mis information. There is no retaliation. The lease is being upheld and a renewal is not being offered, per the lease agreement either party (landlord or tenant) can give notice to not renew without any reason being given. The complainant continues to harass other properties, other property employees, and the corporate office as they do not like the answer that is being given to them.
