The resolution I'm seeking is the full reimbursement of my $3,800.00 cash deposit immediately, in cash.Evans & Son Lot And Land Clearing put me through a series of horrific experiences while dealing with their fraudulent, deceptive, violent, and fear based manipulative ways of conducting business.I was nothing but kind, loving and respectful to these men and they were awful!Prior to signing contract and demanding cash deposit they NEVER TOLD ME nor gave me any indication that they did NOT HAVE ANYONE to haul the logs and debris out of my property at all! they NEVER told me either that they only have 2 inadequate pieces of equipment that are not strong enough to handle the magnitude of my land clearing project. I would have NEVER hired them have I known all that! These men have zero integrity, zero shame, and they have no conscience! Father and son are Evil! ********** left my property in even worse conditions than it was before. He was so busy being ****** off all the time that he was leaving huge holes on the ground in addition to all the mess!People like ********** and ********** Evans that lie and deceive others onto signing a contract and demanding cash payments clearly KNOWING that they don't even have ANYONE to haul loads of more than 100 tree logs and debris and ONLY have two (2) totally inadequate pieces of equipment and no manpower or experience for the magnitude of these projects, should NOT be in business, in my humble opinion. They obviously cannot handle more than one job at the time! Collecting cash deposits KNOWING that they had, higher paying jobs in the burner and then simply dropping me because they feel they didn't charge me more and because they held a grudge for me "hiring someone else the first time" is completely unprofessional, deceptive and fraudulent! Knowing my health problems, and the fact that I don't have job, I don't know anyone in town, that I have no electricity, no refrigerator, no lights, it's pitch black after 5:30 p.m., nowhere to wash my dishes is cruel, inhumane and Evil! A clear depiction of who they truly are!I had requested a quote from **************************** back in October 6, 2022. At the time I was having other contractors provide quotes as well. At the end, I decided to hire the contractor that met my financial budget and would also take care of the septic and well water installations at one, in one package. Unfortunately, the contractor I hired got in trouble for child endangerment and neglect while having the child do dangerous work at my property. After that experience, I called 3 new contractors to get new quotes based on the new state of my property. I also reached out to ********** from **************************** to ASK if he would still be interested, to which he replied yes.* I met with *** Evans Sr. October 18, 2022, we walked my entire property together and while he kept telling me that "I should have hired them the first time." *** Evans Sr. provided a verbal quote of $7,500.00 while he was still at my property, and later that afternoon I received a text message from *** Evans **** including a photo of the contract. After I reviewed the contract, I reached out to ********** and asked him to please be very specific about their scope of work (as I was legally entitled to). He responded as if he was offended, upset even! He also brought up the fact that I'd hired someone else and "it back fired" on me, and refused to do it and told me to" find somebody else!" 15 minutes later he changed his mind, sent me a picture of a lot that looked very nice and at the bottom of the picture he wrote: "at the end We will leave you with." On the same text message he also said: "we don't do bad work nor do we leave jobs that are not ready for a home to be pulled on it."* Prior to signing contract and receiving cash deposit I met ********** October 25th at the ******* in *******, and his first words out of his mouth were: "you should have hired me the first time around!" He spoke for over 2 hours about his personal life and previous roofing business, getting stabbed, his late wife dying of cancer etc., etc. As soon as I had the chance, I made ********** aware that I'd moved to Georgetown looking for peace and quiet for health reasons, I showed him pictures of the horrific cancer I'd survived. Hence the importance of getting my property fully done in the least amount of time possible. I told him, I didn't have a job and about my living situation, and he told me that he would "clear a spot to place my travel trailer on." Which he eventually did. He even drove my trailer onto the spot he'd cleared (I have a video of it). He said "he'd let me know when to move it out for him to work in that area." He told me several times that day that "they would show up and would NOT stop work until full completion. Thus, reiterating what ********** had said to me on one of his text messages, and the reason why I decided to ***** them the job! ********** also mentioned that him "and his son worked really well together, that they never got in other's way." While standing next to his brand new truck which he had running for more than 2 hours while he did most of the talking ********** stated that it "should take them 4-6 days to complete the job. "* Prior to signing contract and receiving cash deposit ********** told me "we just finished the only job we had." I asked where it was located and he responded " ********." I was NEVER told that there would be any delays, any issues or any problems that would prevent them from beginning working at my property right away as ********** told me many times before signing the contract and receiving the cash deposit. * I also asked ********** if he was going to pull a permit and he responded: "we don't need a permit to clear the lot." I recently found out that ****** County does require a permit when stumps are being removed because it changes the elevation of the property, and they also require contractors to be licensed!* Prior to signing contract and receiving cash deposit ********** sent me a text message stating that I had to pay cash or he "will have to add tax I hope you understand." I sent ********** a couple of messages explaining my concerns about giving them cash up front!* I spoke with ********** regarding the 50% CASH deposit and he stated that "they'd been burnt before!" I now clearly see why.* On October 18, 2022 ********** sent me a text me a message stating that the definite starting date would be "Wednesday next week" which was October 25, 2022!* After signing contract and giving ********** the required cash deposit *** Evans Sr. told me: "I'll call you later this afternoon and let you know what time I'll be at your property tomorrow morning." ********** signed the contract, took $3,800 cash deposit and Evans And Son Lot and Land Clearing failed to show up for ten (10) days after that day!!! They never called me nor sent me any text messages to let me know why. I had to call and text ********** and at that point I knew I was in trouble! I even thought they had ran with my $3,800.00 cash deposit! When I was finally able to get ********** on the phone he told me that he hadn't showed up at my property because the owners of the "******** job changed their minds and requested they remove 40 more trees." And the second excuse was that "one (1) of the excavator's hydraulic hoses broke at the ************* property and he had to wait for a technician to show up, remove the hose on site and come back another day to bring and install the new hose and after that I'll call you." Then I received a text message that in part says: "I'll be knocking down three trees and then yours and Friday best I can do."* When ********** finally showed up on November 4th, he brought a very small excavator and two (2) chainsaws. After a couple of hours of cutting into smaller size pieces the trees the previous contractor had cut down, and moving them to the side, ********** proceeded to stop working, and to tell me that "he didn't have anyone to remove any of the logs or debris out of my property" and that "there was nothing" he "could do about it!" When I asked him why wouldn't he use his own trailer to haul them out he just told me "we just don't do that anymore" and walked away. During the same conversation he said to me again "you should of hired me the first time!" In the same conversation, he shared about a car dealership salesman that "pissed him off and he was about to drive up there and beat the c*** out of him and his wife stopped him." A story completely out of subject! I took it as a "warning not to **** him off?!" Which later on turned out to be true, when he called me yelling and screaming at me! The more I listened to ********** the more I discovered that everything he'd said to me about the reasons of not showing up were nothing but lies. He said to me that they got "a lot of jobs after we signed the contract." Meaning my contract.* The following day ********** had ********** on speaker phone while I was sitting a couple of feet away while they were talking about "NOT having enough nor the proper equipment to do these jobs and how their reputation was getting ruined and how they also needed to hire people to work." at that point, I raised my hand and told ********** they needed to hire me, he responded back to me. This clearly confirmed what was truly going on. Same day, he also shared with me that he hadn't had a day off in months before starting my property. When I told him he was a no show for 10 days he told me "I should have charged you more, and you should have hired us the first time around." He then told me another story of a time he lost his temper and got into a physical fight. I felt unsafe and extremely scared.* November 6th( (two (2) days after he'd finally started) he showed up again, he worked almost two hours and then told me he had to "take the wife out to eat or I'll have to hear it." I asked him if he could still help me get some pallets so I could build a platform and enclosure to set up my generator because I have no electricity, no refrigerator, no lights, no place to wash my dishes and is pitch black at night and he emphatically told me "NO pallets or generator."* November 7th, ********** showed up again for a few hours, struggling to get anything done with the small excavator! That day he told me again that "after we signed our contract they" got a lot of new jobs" and how they "didn't have the right equipment nor the man power to pull it off!" That same day my little dog got hit by a car.* November 8th ********** showed up the earliest he's ever been, and seemed startled when I said "good morning" to him, he got really nervous and proceeded to tell me that "they only had the one (1) excavator and people were unhappy, yelling and screaming at him" so that he had to "stop working on my property and take the excavator to do another job" and that "there was nothing I could do about." He then promised "I'll be back tomorrow."* November 11th ********** still had NOT showed up, nor called nor texted me. I sent a heartfelt text message to ********** stating all the lies and deceit and the awful conditions I am in because of not having electricity nor a fridge, nor lights, and feeling extremely stressed out and extremely sick. Eighteen minutes later ********** Called me, he was belligerent, screaming and yelling about how "dare I sent him that message," and how he "could care less about my health and my problems." His screaming was so awful that I literally begged him not to do that over and over, I told him that if he couldn't speak to me with the same respect I spoke to him with, it was not going to work. He said he was "fixing what the other guy did" and I told him that when he came out to give me a quote based on the new conditions of the property he never said it was a problem! ********** screamed even louder that" they didn't have equipment" and asked me: "do you want me to work with my fingers?" I responded that they should rent equipment and hire people, that he should know as a business man that is all tax deductible! He yelled at me that I "should have hired them the first time!" And it hit me like a rock, they had been punishing me, making me pay for "not hiring them the first time" and I asked him if that is what they were doing?! Are you still holding a grudge against me? and he hang up the phone immediately! He sent me a lengthy text message using his trademark guilt trip lines: "we rushed out gave you a estimate and you shopped us and found a cheaper deal then no called us."I have to emphasize that when ********** walked the property with me on October 18th he never said there was an issue about the new state of the property! I had other three (3) quotes from other contractors. I didn't beg him to do my property, I called as a courtesy since he'd been out here before and I specifically asked him: "would you still be interested in giving me another quote?" I never put a gun on his head either, and I didn't ask him to give me a better price even though the other quotes I'd gotten were a whole lot less!* A while later I received a series of phone calls from ********** (there was a bad connection), he apologize on behalf of his father and here comes the discovery of one of the big lies: *** said he was sorry for not showing up and that it was because "two (2) hydraulic hoses had broken and they had "to take the excavator to the shop to get it fixed!" Sr. said "one (1) hose, on ************************* property, tech doing the hose replacement on site!" I didn't say a word. Then he too brought it up, "you should have hired us the first time!" And then he said to me: "you know we're doing you a favor, we put you in front of the list!" What list?! *************** me October 18th at my property and October 25th at the ******* in ******* that "I was next on the schedule" and he "was going to start my property next day!" October 26th!* Then he assured me that his "dad was going to be at my property the next day (November 14th) to finish up and have everything ready for him to bring the skid steer!" ********** has NOT even done one fourth of the tree removal! And they have NOT REMOVED EVEN ONE (1) LOG OR DEBRI out of my property yet!!! I didn't say a word!* November 15th ********** showed up again, as Jr. had said. ********** removed the two trees on the west end of my property making a new entrance while leaving two (2) huge holes on the ground! And then he proceeded to the north part of the property to work over there (200 feet away from where my trailer is). A little bit later ********** sent ***** to ask me which trees they were cutting?! I told ***** that ******************* had already talked about it and that it is even on the contract: "All trees except the ones within 10ft buffer around property". Later on ***** came back to ask about the trees in the middle of the property within the berm that Sr. had suggested "I keep as an island for privacy." I told ************ was not going to keep the island for security reasons, and all h*** broke loose again!* After I said "I'm not keeping the island" I received a called from ********** speaking to me with a scolding tone saying that "I was making all these changes that were not on the contract." I calmly responded that I didn't make any changes. Jr. **** said that they couldn't cut the trees I'd marked with a yellow ribbon as ********** had instructed me to do (at 7ft length as ********** had agreed to on November 4th) which I need in order to place spot lights and cameras on, and not worry about a storm knocking a tree on top of my mobile home. I offered to hop on the excavator and cut them myself and he said no. He then said they were going to cut them at 4ft and I answered: "I guess you all are going to do what you want like you have been doing all this time!" Then he told me angrily: "you know my dad is not supposed to be there today, right?!" ********** called me on Friday November 11th to tell me his "dad was going to be here!!! Now he's not supposed to be here?! ********** implied that I would have to pay to get the "changes" I wanted done which is KEEPING about 6 or 7 trees because "they were not part of the contract!" My request which was discussed and agreed upon from the very beginning, which takes a lot of extra work, a lot of time away from them and now it's a problem?! Maybe they should pay me, give me a credit for not removing 6 or 7 huge trees and stumps?! And they should also pay me big time, give me a huge credit for ********** deciding NOT to remove the giant Oak Tree on the west side of my property either?!* Sr. suggested I keep the island (berm), it was never my idea, I have the right to decline, since it is my property especially, if it's going to make me feel unsafe, correct?* ************** said that, he was "going to dig holes and stand logs to make me a fence," (out of guilt for all stress and their failure to follow through)? I expressed my immense gratitude, but it was NOT my idea nor my request!* I did request that they set aside some of the logs to use around my property later on. ********** said "yes" before!* ********** then jumped to the subject of my trailer being in his dad's way! First of all, before we signed contract and gave cash deposit ********** offered and followed through with clearing a spot and placing my trailer inside my property. And now it's "in his dad's way?! My trailer for the record is 200 feet away from the area ********** was working! I HAVE PICTURES AND VIDEOS OF EVERYTHING! There's also the fact that there are many, many trees and palms left on the west side of the property and my trailer is at least 100 ft away from that area as well! There are a tone of trees in the center area of the property also that my trailer is at least 100 ft away from too! My property is 150 ft wide and 299 ft long! I calmly told Jr. that Sr. was supposed to let me know when to move my trailer out.Jr. ordered me to move the trailer out right away and I got started immediately. Sr. and **** were communicating over the phone while I was cranking up the 4 jacks from my trailer and moving my rain water container, I had everything out of the way, I even had my trailer hooked onto my *********** was literally in my truck about to pull my trailer out when ********** called me and told me "not to take my trailer out!" That "it was raining and his dad couldn't work under those conditions!" It was not even drizzling! It was a mist that didn't even last 5 minutes! So ********** removed the excavator out of my property and off he went! ********** also said to me " I'm going to call you tomorrow (Monday) and let you know when we are coming back!" I asked Jr. if he was no longer coming Thursday and Friday (November 17th and 18th) to fully finish as he'd told me before and he said "I'll let you know tomorrow." That was yesterday, and I never heard from ********** This was clearly all a game of manipulation, deceit and FRAUD!************************* ************
