We have reviewed the complaint and account of ****************************** claims the account is inaccurate, unverified, and violates the Fair Credit Reporting Act (FCRA) and requested a correction to her credit file. We have completed a review of the account for the 2014 Dodge Charger and have verified the trade line is reporting correctly to the major credit bureaus.  As such, there is no FCRA violation.  Mid Atlantic Finance also has a copy of Ms. ********* signed installment sales contract which serves as verification of the loan.  ************** would like to resolve the account, she is urged to call our ******************* at **************************.

Mid Atlantic keeps calling my business asking for a person who has not been a client since March 2023. I have called 2 times and have asked to please remove my business number as its not his. I have picked up the calls and said its not his and have asked someone to reach out as well which has not happened. This is not his t number and the last time I spoke with a person (*****) I did say I would be reporting them if I continue to receive these calls. I will also do with *** since we are on the do not call list. It is ridiculous that even after being notified that this is not that person number that they continue to harass my business. A simple ****** search or even a look at the website they would be able to see the number they call belongs to a business. At this point I am taking it as harassment. Have attached copy of the amount of calls we have received the month of April

I am rejecting this response because: there has been MULTIPLE Consumer Rights Violations and there has been multiple attempts to try and remedy this contradictory issue. This company is NOT the first party creditor as I have in writing from multiple representatives and verbally informed by ****** Auto Sales Finance Manager a Ms. ****** that the account was SOLD to ************************************************* from ***************** Sales. You simply cannot purchase an Account and also be the original creditor. The COPY of Contract is ineligible and have multiple discrepancies with the account payments from both Mid-Atlantic and ****** Auto Sales. I was also told by another representative at the time of the last payment that the loan has been paid in full and that my title should be released. There is no reason for me to pay anything further.

      Sincerely,

We have reviewed the response from ***********************  Mr. ********* states there have been multiple consumer rights violations, but did not specifically state which consumer rights he feels have been violated.  Mr. ********* purchased a 2013 **** Explorer from ******** Auto Sales on September 6, 2024, and Mid Atlantic Finance bought the account from ******** Auto Sales in January 2025.  ******** Auto Sales is the original creditor as they are the entity that originally extended credit.  Mid Atlantic Finance is the first party creditor and as such, payments are made to us.  A review of ************************ account shows when he made his last payment on February 26, 2025, he called our office, and a representative confirmed the payment was pending, but did not tell Mr. ********* that his account was paid in full and title would be mailed. The title does not get released until the account is paid in full.  A clearer copy of ************************ contract will be mailed to him.  **************** has questions, he is urged to call our Account ******************** Department at **************************.

      I am rejecting this response because:I am if this company allegedly PURCHASED the account then provide the information I requested because as I stated previously there are multiple discrepancies between the information provided by Mid-Atlantic and Lovitts Auto Sales as far as payments, information in regards to the amount financed and accounting records. This company allegedly PURCHASED an account and has no proof that the account has not been paid in full but is continuously calling me to collect an invalidated debt which is boarding the line of harassment as well as violating my Consumer Rights;

      The Full Assignment Contract

The amount of the Debt owed

The name of the creditor to whom the debt is owed

The chain of custody & bill of sale

      The double sided accounting records

      Customer Answer

      Date: 05/01/2025

      Dear Better Business Bureau,
I am writing to provide an update and formally close my complaint regarding the account I had with **********************, associated with Freedom Car Sales.

I have now communicated directly with Mid Atlantic Finance, resolved the outstanding balance, and my account has been closed. I am currently awaiting the delivery of the vehicle title, which they confirmed will be mailed to my updated address.

I am satisfied with this resolution; however, I would like to note that my credit report still reflects the previous delinquency. As mentioned in Mid Atlantics response, they committed to submitting updated information to the credit bureaus showing all payments as on time.
For peace of mind, I kindly request written confirmation from Mid Atlantic Finance that this correction has been submitted to the credit reporting agencies and that my account will reflect as paid in full and closed in good standing.

Thank you, BBB, for your assistance and mediation throughout this process.
      Sincerely,
      *********** *********

I purchased a car from **** car dealership in ****** **** in March of 2024. I always paid in cash at the dealership. When I called the dealership about my Oct payment I was given the number to Mid Atlantic finance. I never received any documentation from either business about this transfer. I made my Oct payment and each payment after to current on time to mid Atlantic finance. However, since October they have had me in there system as late telling me I was suppose to pay them several months before which I didn't know anything about and was making my payments on time to the dealership. I have submitted receipts of those payments to Mid Atlantic and I have tried myself to rectify the situation between the two companies just to go nowhere. I am treated rudely by this finance company when I call in and I am harassed with late calls and have to argue with there employees when I have never been late. I did not want to be with a finance company that is why I purchased the vehicle at moms where made my payments in person.

I am not liable for this debt with Mid Atlantic Finance Company, I do not have a contract with MAF AUTO. They did not provide me with the original contract as i requested. 15 U.S.C. 1681 (Fair Credit Reporting Act) regulates credit reporting and ensures consumer rights to dispute inaccurate credit report information. For debt validation, it falls under 15 U.S.C. 1692 (Fair Debt Collection Practices Act), which requires debt collectors to: 1. Provide written notice of the debt within 5 days of contact. 2. Cease collection if the debt is disputed within 30 days until verification is provided. Both laws protect consumers from inaccurate reporting and unfair debt collection practices.

BBB Business Profiles generally cover a three-year reporting period. BBB Business Profiles are subject to change at any time. If you choose to do business with this business, please let the business know that you contacted BBB for a BBB Business Profile.

As a matter of policy, BBB does not endorse any product, service or business. Businesses are under no obligation to seek BBB accreditation, and some businesses are not accredited because they have not sought BBB accreditation. BBB charges a fee for BBB Accreditation. This fee supports BBB's efforts to fulfill its mission of advancing marketplace trust.
