      We engaged this business to complete civil engineering on a proposed multi-family residential project. We contracted them in June of 2022 and gave them a deposit of $4,000 . We've never received any plans, drafts or anything at all from them. After months of consistently calling, emailing and messaging with no response we formally requested a refund on 10/3/2022. They claimed work had been completed, we requested them to turn over what was done however they were unable to provide anything or any evidence as such. They have not responded to our requests or our attorneys requests for reimbursement. We are out the initial 4k, plus we lost months of time which incurred additional losses associated with holding costs and loss of income.

      Altec:

      Have entered in a contract as stated by the client. The deposit was made and Altec had stared work as instructed.  Altec have attended meetings and undergo hours of preliminary studies, which resulted in loss time. Altec have had numerous email going to both the client and his architect for request for information that pertain to the client project. These emails request for information will go unanswered.In our frustration we elected to remove our self from the project given these conditions.

      On 01/11/23 we had talked with one of the client rep ******,stating what Altec incurred $2,910.00 for cost in starting the project. We are happy to provide the difference not applied to the project to date.

      We still await a response on the matter.

      I am rejecting this response because: 

      The response from Altec dated 6/22/2023 is wholly untrue and purposely misleading to the reader.  None of the claims being made by Altec took place.  No communication, or efforts to contact us were made by Altec during the 4 months prior to us requesting cancellation on 10/3/2022.  On the contrary,  from the time we engaged the company in May ********************************************************** Oct 2022 we made regular and extensive efforts requesting updates with no avail.    
      To reiterate,  we have not received anything from this business to date.  They have not provided us with any service, documentation or made any efforts to assist us with what we hired them to do.   
      On 10/3/2022 when we cancelled and asked for a refund,  ****** Minus made similar claims that work was performed and stated that they would issue a refund less hours spent.   We asked for clarification as to what was completed and for them to provide us with the work performed.  The business never responded to that request or any further communication from us for the ensuing months.  On January of **************************************************** an effort to resolve the matter.  

      Below is the approximate timeline of the attorneys efforts requesting data from ****** Minus.  Attorney is ******************* from BHZLaw ***************.

      -In addition to numerous calls, which I dont have good dates for, see below.
      -We spoke to ****** via phone and he emailed on January 11, 2023, with the $1,290 and $900 figures.
      -We asked for a description of the work performed on January 12, 2023.
      -We made a second requestion for a description of the work performed/break down of the hours on January 18, 2023.
      -****** sent a random list of things on January 18, 2023.
      -We asked a third time for hours spent on each task on January 18, 2023.
      -****** promised to have account break down all our time sheets and send over to you on January 18, 2023. He never did. 
      -We asked again on January 24 for the break down, and he didnt reply.

      Its been more than a year since we paid this company a retainer and 8 months since we cancelled and requested a refund.  Altec never provide any service, and after numerous requests could not provide any evidence that any service was performed.    Their claim that email requests for information went unanswered is false,  and their statement that they elected to remove themselves from the project given these conditions is laughable.   No effort was made to complete the work they were hired to do.   We require that the full amount of $4,000 be refunded.   Far more was lost by us due to their negligence,  we suffered months of lost progress and holding costs.

      Hello:

       

      We have been more than fair on this matter. Altec have been on this project from February 2022 to Mid July 2022. Your design team i.e. the Architect have not been fort coming with information as requested in a timely manner from the start of this project. This resulted in lost of lost time going back and fort with my design team. You where made also aware of this matter on several occasions.  Altec have lost time and money on this project due to issues cause by the owner design team and others.

      We have attached all the emails of all the back and forth on these matters and given the limitations on how much can be load up on the BBB, i have elected to load up a few that you may find more relevant..There are more email and time line for your record if needed. Once again we are open to settle this matter as indicated in the previous response.

      I am rejecting this response because:

      Ive attached the initial email correspondence post cancellation between myself, my attorney and Altec.    It should clarify our position and my prior statements.   The last response from Mr. ***** was January 18, 2023.   He did not provide the requested information to back up his claims on the alleged time spent.  At that time he claimed they were billing us a total of $2190 which varies from his no alleged $2910,  neither of which are substantiated.   
      The issue lies in that they took our deposit and months of our time and never provided us with any product.  We pressed them to complete and asked regularly for updates,  yet received nothing from them.   The last month prior to us sending a formal cancellation they would not answer our calls or messages.  For them to insinuate that somehow it was our responsibility is ridiculous.   For them to bill us for alleged time spent when they never made the effort to complete the contracted work is also ridiculous.   They have taken zero responsibility in the time and energy we lost due to their incompetence.   I do not see why we should be held liable and take the full loss.   They were unable to complete the work they promised and as such should return our deposit.  This is why we have asked the BBB to assist in holding them responsible. We would like to at least see them offer a refund that reflects them taking some responsibility. We are willing to compromise in order to put this to an end.

      Please note at the time of the email sent to ******* on the estimated cost of what was spent was true at the time emailed. That do not neglect the true time spent on the project. I am sorry you feel this way, but Altec have been trying to work with your design team to get the proper answers to we can assist on this  project. But we did not hire your architect that delayed us and drag this process out, which in return cost you in the end. Our position still hold and if you would like to address my last offer we would be glad to close out this matter and move on.

      I've confirmed with my architect that you made no effort to complete the assignment and furthermore he exclaimed your overall incompetency and lack of knowledge at the **** meeting where you contributed nothing.  He will be putting together a formal letter outlining this which I will upload once received.  Furthermore, I spoke with both points of contact at the ****************** planning department who also confirmed that nor you or anyone at your office engaged them on this project. 

      I don't have any more time to waste on your lies.  We've made our position abundantly clear, I've been cordial and given you the benefit to remedy this.  You've made no effort to reciprocate.   I don't see the BBB doing anything to hold you liable so at this point either you return the money you've taken from us I will turn this over to my attorney and the **************************.

      I am a private citizen. I entered into a contract with *************.Since ************* does not have a general contractors license, they partnered with **********************. for ********************** to provide the use of their license in exchange for a nominal fee that has long since been paid. Aug.2021 I entered in contract with Altec Inc. chosen for me by **********, *************, for use the license. My contract required the home to be built in six months. In June 2022, 10 months later, the concrete slab had still not been poured. I requested Altec Inc. to get involved to urge ************* to get started on my build due to numerous delays with permitting and other issues. Concrete was eventually poured Aug. 1st, 2022 by *************. I later found out the numerous delays were caused by Altec Inc. To pay for the concrete slab, a $30,400.00 draw on my construction loan was granted and provided to Altec Inc. for Altec to pay ************* for the work performed. To this date Feb. 20, 2023 Altec Inc. and owner ****** Minus have still not provided the money to *************. Additionally, Altec Inc. refuses to return the funds to me so I can pay *************. Altec Inc. claims that there is something wrong with the measurements of the concrete slab; however, I have personally measured the slab and it is well within acceptable tolerances. Altec Inc. claims that the slab measurements are off but has refused to do anything about it, their license is on the line, so they have the responsibility to take charge and force installer to fix the slab assuming of course it is wrong (it is not). It has now been 5 months since the draw was sent. Altec Inc. is still refusing to return the money to me or the finance company to date. This is even after trying to negotiate its return through his attorney. The owner has now resorted to extortion by demanding $10,000.00 fee and to return only $20,000.00 of the draw, claiming contractual damages, he is not entitled to under my contract.

      We have two contracts, one with the home owner and one with the developer, Steel ** We started the customer's home build, it was being managed by Altec. During the construction phase, we pointed out to the developer (who was acting as the builder) the defect issues. We put a stop work order on the job, which the customer agreed to. After the stop work order was issued, the homeowner asked us to stand down and to allow Steel X to move forward with the build. We maintained the stop work order to the developer, letting them know we had issues with the work being done as well as the payouts. The payout for the foundation: the sub-contractor that was hired by Steel X never provided proper documentation (licenses, insurance, etc) to conduct the work as required by our prime contract. Steel X request payment for the sub-contracted work for which the sub-contractor could not provide proper release and warranties for the work that was done. Therefore, Altec withheld all release of payment for that scope of work. **************** breached the contract by informing Steel X to move forward and having Steel X hire a different contract to work underneath the prime contract. **************** and his attorney has been in talks with Altec's attorney to come to a solution to move forward to waive all liabilities for Altec for work that **************** approved with Steel X so that payment can be released to the sub-contractor.

      I am rejecting this response because:

      Altec, ****** Minus, has wrongly kept funds that belong to me that he did not pay to the concrete contractor. He has also attempted to extort $10,000.00 of the $30,400.00 owed to me. The contract was for me to provide funds to Altec and for Altec to pay out. 
      it seams funny the concrete slab that he considered incorrect excepted the steel prefabricated frame perfectly. Altec was using **************** after lathe and concrete stucco was applied instead of the actual blueprint dimensions.

      Altec Inc position has been clear from day one. If the client feels that he is not in breach of his contract and he feel he has merit, please do move forward with legal. All items stated has been the truth on the matter. The client is always welcome to resolve this matter as i have instructed with my legal team.

      Altec Inc have numerous emails and text from the client that renders our position to the truth. The client has options to resolve this matter and we have always kept a processional communication open on the matter. The client should make whole Altec Inc on this matter for his breach of contract.

      I am rejecting this response because:
      After numerous attempts to negotiate this amicably even through legal. Altec does not even respond to his own attorney request for response. A settlement was agreed to that he and his attorney countered,  however Altec has again refused to take action. Again the funds were to be paid out for the slab installation and he refuses to pay is as in the contract. He is still in breach of contract  1st for not paying for work completed after receiving the Draw Money. 2nd for not taking over the build after putting the builder in default. 
      Altec stalled the build so long, that one day prior to my construction loan running out I was forced to fire Altec and install a new G.C. Now 5 months later I am still trying to recover the $30,400.00 draw money.

      Altec Inc was hired as the General Contractor to build my home. Altec Inc was given funds (20+k) from my mortgage bank to pay for permits. Altec never paid for the permits. Altec was then fired as the **** by the developer and because they never paid for the permits, Altec was no longer approved by the mortgage company to continue the build of my home. Altec was asked to refund the money Altec received to pay for the permits. Altec is now refusing to refund the funds they received. I found that there are other families going through the same challenge with Altec. I will be reporting Altec to the **** and retaining an attorney if they do not refund the money given to them for the permits. This can all be avoided if Altec would just refund the money given to them for the permits.

      This response was taken verbally by BBB:

      We have two contracts, one with the home owner and one with the developer, Select Homes. This customer signed a contract with us for the build. In the duration of working with *********************** and the developer, *********************** was asked by the developer to switch general contractors from Altec to Icon without notice to Altec, therefore breaching his contract with Altec. The developer also breached their contract. In addition, *********** are in talks with the developer over this breach, whcih is pending a final outcome. The permits were submitted pending approval, but the permits were not approved because the developer was controlling the design and engineering and had defaulted on their contract with us before the process could be finalized. Out of 200 homes that Select Homes contracted, they were only able to get permits on 27 homes. We are not in control of the design or permitting process.
