I was advised my ***** ****** at MCA Resolve that they could help me pay off my finance amount with Skyinance alot faster and save on the interest. I set up with them to pull out of my account weekly. I kept asking them to find out what we needed to do to pay Skyinance off. ********* had put a lien on two of my companies commissions that I get monthly. I talked to *** at MCA resolve about getting me a settlement and that is when I started wondering about them. He kept telling me he contacted Skyinance and they said I still owed over $63,000 and that took into effect all that I had paid and was on hold for. I knew this could not be correct. I decided to call *** at ********* today. He advised me that MCA Resolve had not called him at all and had sent him any money, that I had been scammed. I am a 69 year old woman that has worked all her life and just found out I have pre-cancer colon. My husband is disabled and has been for 10 years.I need this money back in order to clear my business with Skyinance. I guess I trusted these people too much. Can you help me? I have had my bank to stop any further drafts from coming thru.Business Response

I signed up with this company August 2024 to help get some relief with debt. They sent me a contract that outlined what they would be able to settle my debt for and their fees. Everything seemed reasonable in the beginning. However, as the months passed and I checked the escrow account I noticed that there were a lot more fees being taken than what were mentioned in the contract. I also received a call from my *** and she stated that they will need to extend my payments past the end date of December 1, 2024. Something didnt seem right to me. Once I reviewed the account and contract deeper I noticed that I am paying much more than what was in the contract and unfortunately more that my initial debt. I then called my *** and sent an email to stop any drafts and remove me from the program and refund the balance in the escrow account. My *** responded and stated that she will stop payments and send a document for me to sign to have the escrow account balance refunded. Its now been a week and I have not heard anything from her and I have sent multiple emails and made several phone calls with no call back. This company is predatory and is only out to take your money and place you into further debt.Business Response

Dear *******,
As outlined in the contract attached to your BBB complaint, the figures provided upon enrollment were clearly stated as estimates. We strive for transparency, and as noted on page 8 of the contract, the fees allocated to your account were explicitly detailed when you initially signed the agreement.
You enrolled in a four-month program, and we fulfilled our commitment by negotiating a settlement with your lender as agreed. Unfortunately, you chose to decline the proposed settlement. Please understand that we completed the work you hired us to do, and we provided you with a good-faith resolution that aligns with the terms of your contract.
At this point, there is no further action we can take if the settlement offer is not accepted.Business Response

*******
Thank you for reaching out. I would like to address your concerns directly.
First, please note that there are no hidden fees associated with our program. All fees are clearly outlined in the contract, which is 100% transparent.
Regarding your account, we successfully settled one of your debts. However, you requested to cancel out of the program despite the settlement progress. You mentioned that a refund was not issued, but our records show that we refunded your escrow balance of $8,213.08 as per your request.
Its important to note that accurate reporting of your other debt is essential for the success of the program. Unfortunately, discrepancies in the debt amounts you initially provided impacted our ability to fully address your financial obligations. Without the correct debt information and corresponding funds, we are limited in what we can do to resolve the remaining balances.
We are committed to providing transparent and effective service and hope this clarifies the situation.Initial Complaint

I setup with MCA resolve to negotiate MCA debts. I was given a contract with the broken down terms and conditions thinking they could help me I moved forward. They negotiated the first account and then the second account they could not they decided at the end of the contract they needed more time, however during this process I was being sued by the other company. I ended up settling out of court and now owe 11k more than original contract. They refunded what was in my escrow account but took out an additional amount because they say the amount owed to the company was different than originally started. This however is not true because I had to settle which cost me more money. MCA Resolve owes me the other 5100 dollars they (stole in my opinion) took out after they realized they could not do as advertised and did nothing but cost my business thousands of dollars. The company is a scam and does not hold up their end of the deal. They charge you and charge you and make it your fault because you got yourself in the position in the first place.Business Response

****,
It appears there was a discrepancy in the debt amount you initially reported to us, as you provided a figure significantly lower than the actual amount owed. While we successfully settled with one lender, we were unable to settle with the other due to the inaccurate information provided and your refusal to allocate additional funds to cover the underreported debt.
Unfortunately, this misinformation prevented us from completing the settlement with the remaining lender. Despite this, we refunded your escrow balance as a resolution.
Please understand that this is your debt, and we cannot assume responsibility for paying it on your behalf. Simply believing you owe a different amount does not alter the facts, as we had previously explained.Customer Answer

I am rejecting this response because: they had the owed amount they received the information. The amount they are referring to is the amount that we had to settle out of court on because they didn't hold up their end of the contract and as far as getting the money back I got part of it back.
Sincerely,
**** ******Business Response

I am unsure what you mean by your message, however the fact remains that we assigned attorney to handle both of your outstanding debt's and we also settled with one of the lenders before you chose to cancel out of the program. You hired us to settle your debt and that is exactly what we did.Initial Complaint

This dishonorable company preys on struggling business owners! Do Not Use! ...they said they'd help with a MCA...we made an agreement, they were accommodating with payments (late, missed) UNTIL their "fees" were paid for. Things were tight for 3 weeks and they terminated me, took my 6500 in fees and sent me on my way with a middle finger. Basically a scam taking advantage of a desperate situation and did NOTHING with the original cash advance i came to them for. ...Of course this is all after receiving marketing calls every single dayBusiness Response

I noticed you mentioned concerns about our debt relief program. You enrolled less than a month ago in our 12-month program, designed to help you manage and pay off your debts. Given the short duration since your enrollment, Im surprised to hear you describe the program as a scam.

MCA Resolve claimed they would cut payments by 40%, negotiate with my creditors on the *** loans we had, and put us in a better position with our financial situation. They are a predatory organization offering relief that we never got. In fact, MCA Resolve took money directly from our account along with the same *** account Ts they promised to help us with. We recorded their promised dates and amounts, and are now being charged after I told them I am not going to be allowing their debits from our business account. They caused our rent to bounce, and are attempting to take the money for a 3rd time illegally. We are filing with the Attorney General currently for fraud and wire fraud. DO NOT GIVE THESE PEOPLE YOUR BANKING INFO. As you can see all of the complaints are parallel and very current. They take NO responsibility and try to charge fees that are not proven. BEWARE!!Business Response

I want to address your concerns regarding the impact of MCA Resolve on your rent payments. The issues you are experiencing are not a result of our program but stem from your decision to take out multiple merchant cash advances without the ability to repay them. This initial debt situation was present before you enrolled in our program.
You joined our 6-month program but chose to cancel after only one month. This premature cancellation did not allow us sufficient time to negotiate with your lenders effectively, as initially planned. Additionally, you mentioned not allowing drafts to go through, despite having signed a clear and detailed contract. The contract explicitly outlined the debit amounts and dates in large print, leaving little room for confusion.
We discussed these terms and conditions thoroughly in our conversations. It's important to reflect on these points before attributing blame. Taking multiple merchant cash advances without proper financial planning is illegal and detrimental to your financial health. We wish you nothing but the best in your future business endeavors.Initial Complaint

When I started with MCA resolve, I owed my creditor $21,130.95. MCA Resolve sent me a contract to pay them $18,985.20, my original creditor has held funds equaling $2,562.00. I have paid MCA Resolve in full, with the funds held that brings my total from $18,985.20 to $21,547.20 paid. Which is more than what I even owed the creditor. Now MCA Resolve is telling me they need 3-4 more months of weekly payments (an additional $6,000 - $9,000) in order to settle the debt to the creditor, and if I don't pay it, they won't settle the debt. In other words, they're not holding up their end of the contract. I've already paid more than what I owed, and now they want to ***** me and my small business for thousands more. I recommend everyone to stay away from this scam.Business Response

As per our agreement, we provided an estimate based on our expertise and analysis of your specific situation. However, it appears that the creditors are currently adamant about requesting the full balance.
I understand your desire to proceed with settling the matter immediately. However, it's crucial to recognize that if we were to pursue this course of action now, the creditors may continue to stand firm on their demand for the full balance which is the reason for the request of additional funds.
What I want to emphasize is that with the passage of time, there's a greater likelihood that the creditors may become more open to negotiating a more favorable deal. Patience could potentially lead to a more advantageous outcome for all parties involved. I regret that this situation had to escalate to this point rather than being resolved through communication within our office, none the less, your understanding and cooperation are greatly appreciated. Please feel free to reach out if you have any questions or concerns regarding this matter.Customer Answer

I am rejecting this response because: That is a lie, my contact with MCA resolve just told me they will never settle for what they have in escrow and what is in there will depreciate with waiting. I held up my end of the contract, MCA Resolve has failed to hold up their end, and they want me to pay for it. In other words, I still have to pay the creditor the full amount, so I have paid MCA resolve over $9,000 in fees to do absolutely nothing for me.
Sincerely,

From the onset of our program and reiterated throughout the contract you signed, it's important to recognize that our agreements are estimations. While we're committed to advocating on your behalf for the best possible settlement, it's crucial to acknowledge that acceptance of any terms is ultimately at the discretion of the creditors.
I want to emphasize that our program operates with a focus on long-term solutions rather than immediate gratification. Presently, it appears that the creditor is firm on accepting nothing less than the full balance. However, with time, we aim to negotiate a more favorable settlement on your behalf.
****, I urge you to prioritize our communication channels so we can address your concerns effectively and work towards a resolution that meets your needs.
Looking forward to hearing from you soon.Initial Complaint

The business never negotiated any accounts for our business. One account, I had to negotiate and send in additional funding to pay off. The copy of the agreement I uploaded, I never signed. Someone in their office digitally signed my name illegally as you can see they never signed it as well. I only received this copy because I repeatedly asked for a copy of the contractual agreement months after they were taking payments from my account. The contract was not sent to me until 02/20/24. Please see the uploaded screenshot that is also time stamped.I have called several times with no response as well as sent text messages and emails. I have only received promises of call backs with no one reaching out to me.Business Response

*******, I am utterly confused at your statement. You stated that you never signed the agreement and was unaware of how you were even enrolled in the program. However, I would like to clarify that upon being physically served with a lawsuit, you ensured to provide our office with the details and our office promptly took action to appoint an Attorney to assist you with the matter. Additionally, in response to your request, we settled your debt within the first month of your enrollment in the program, which was initially structured as a 5-month program.
It's important to note that our program has proven to be effective for all clients who consistently make on-time payments. Regrettably, you chose to cancel your enrollment just one month after initially joining the program.Initial Complaint

I'm reaching out regarding your enrollment in our 14-month program aimed at breaking the cycle of debt from which various lenders have had you ensnared. Just three months into the program, you sought and applied for another Merchant Cash Advance (MCA), which directly opposes the objectives our office is striving to achieve for your financial stability.
As clearly stated in the transparent contract you signed upon enrollment, our policy regarding refunds is explicit. Regrettably, the act of taking out another MCA during the program's enrollment, especially so early into the process, does not warrant a refund. We understand this may not be the outcome you had hoped for, but it aligns with the terms to which you agreed when joining the program.
*****, we genuinely wish you the best in all your future business endeavors. Our primary goal is to support you in achieving financial freedom.
