The merchant in question has absolutely ZERO regard for the safety of children online. Their website contains no age verification script, they do not partner with any type of drug abuse foundations, and they are negligent in vetting who is ordering their products. All sales should require the scanning and verification of ID for all 50 states, and they do not. All you have to do is click a button. Parents have a reasonable level of care to uphold, but everyone has a job to put food on the table. These websites who are trying to keep their own business open should understand that not everyone is honest about their age.Not only are they selling this weed to minors, but they aren't even making returns easy. The box contains no documentation about shipping, the label does not contain the business name, and their old contact page lists a fake address in *********. And what about my child? They spent their hard-earned money expecting to smoke weed, and now that I have to take it away, they lose what they illegally paid for (enabled by D8 Gas), and don't even get their money back.This business needs to do better or needs to be shut down.Initial Complaint

They took my money and said they shipped my order on 1-22-24, gave tracking # and it never went past "Label Created" stage (It's **** , I messaged them 4 days later asking what was going on and why my order wasn't shipped. They say it was shipped...but the tracking number says it wasn't and still to this day 8 days later says it has not been shipped. I exchanged emails with this dude and after waiting the whole weekend, he finally emails me saying he was sorry blah blah and gave me a coupon code that was supposedly worth more than my order total was plus free shipping. THE **** DOESN'T EXIST. And now he wont respond to me and it's been over 24hrs. They think they can just punk ppl and play with their money. They took my money and have not given me what I paid for. This garbage was acceptable in 2005, but you don't do this c*** in 2024. This is straight trash service and ive never had worse experience as a customer in any online setting the past 15 years. And the worst thing is I used the only $ I had in my disposable budget so I can't just get it somewhere else. They have my money and wont give me what I paid for.AS YOU CAN SEE from "D8 2.png" *** PROVES THEY ARE LYING. They say they shipped 1-21-23 , but *** tracking info and still to this day, says and I QUOTE "Shipper created label, *** has not received package yet"This is fraud. This has wasted over 10 days of my time, my money and emotional capital. I'm very sorry about the inconvenience.I will not be happy with a simple refund at this point. The 10 days of my time, stress and frustration this has caused is in my opinion akin to interest. I ordered a product from them and they said it will relax you and let you sleep. The product didnt have any affect on me. So I wanted a refund because it was $30 and I dont have that money just to give to a company that approves fraud. And thats what this was. Was fraud. After looking through transactions on an account that my son has, I discovered that on 6/5/23 my 17yr old son was able to purchase a product from D8Gas.com for $35.95. First off, no minor should be able to go on your site and purchase these products. You, as a business are responsible for ensuring that the customers buying your products are in fact 21 or over. I emailed you about this issue on 6/12/23 with no response. That being said, I have filed complaints with the **** ** Attorney General, GA ********** of ******** as well as the ** ********** of ******** and Professional Regulation and am also looking to take legal action for your negligence.Business Response

6/27/2022, D8 Gas (A K ********** **** dba D8 Gas) shipped four ****mg HHC disposable cartridges to my minor son. We live in *****, and THC, HHC, Delta-8 and all similar cannabinoid compounds are illegal for anyone to possess or use. Additionally, their 'age verification process' is entirely inadequate, allowing them to ship these illegal substances to minors in *****, my son being one of them. This is very clearly a feature of their website, not a bug. I would like confirmation from this business that they will never ship any of their products to my son, or my address, ever again, for any reason. My minor son's name is *************************, and I will attach images of their invoice, shipping package, and product.Business Response

In response to **** Osgoods complaint with the BBB regarding D8 GAS.
On June 25th 2022 an order was placed on our online store for a total of $80.50 by a *************************. Upon receiving the package on July 1st, *************************, Landons father, contacted our company as a concerned parent regarding his sons purchase on our site. The first contact by ************************* was threats across several different companies, and agencies as he was looking for no sort of consensus or resolution. Being that his message arrived at 5pm local time on the Friday before the 4th of July weekend there was a delay in the response. The first response from D8 Gas to ************************* on July 4th explained that we would refund his order, investigate what happened on our side that allowed his son to purchase the products in a prohibited state, and blacklist his address directly to specifically restrict his home from ever receiving our products again.
In regards to the ability to purchase illegal substances in *****. This has and will never be an intent of D8gas. Due to the ever-changing laws surrounding Delta 8 and similar cannabinoids, D8gas is constantly testing for more efficient ways of restricting certain states, such as ***** from being able to successfully purchase. Unfortunately, as explained to ************************* at the time of his sons checkout, the installed plugin failed. We have since completely changed the plugin and assured that customers in states that restrict these products cannot successfully purchase said products, including the state of *****.
In regards to the, as claimed by, ************************* inadequate age verification process. The currently installed Age Verification pop-up will prompt visitors to the site to either confirm or deny if they are 21 years or older. At the current time, this age popup is the industry standard to assure the users of the website are of the required age. By clicking the yes the user agrees that they are of 21 years of age and accepts all responsibility of access, browsing, and purchasing the products for sale. D8gas has and will always be available for a prompt response to any issues that *** arise, such as this one with *************************.
We believe that this response, in addition to the ones sent directly to ************************* initially, will provide confirmation that we will never ship to his son or his address.
