      On 9/20/20, a Sat., Gabe C. from MCG brought over his "PROPOSAL Contract". I would be liable to pay for the deductible and extra fees. He said MOST deductibles he's seen have been around $800. I said if it's more than that, no deal since it was during Covid and I was unemployed at the time. He verbally agreed. BTW, if you don't Dissolve the PROPOSAL CONTRACT within 48 hours & don't have the work done, you pay a percentage of the estimate to MCG or they will put a lien/sue you. Gabe said if I didn't sign, he couldn't help me. So Sat - Mon evening was all I had. I gave him my insurance and mortgage company numbers. I didn't hear from him ALL week. The contract cancellation period had already passed without knowing any amounts. Home inspector came out following week. Gabe radio silent for over two weeks. He finally informed me my insurance company would not speak with him, and I would have to do his work for him, ie. put in claim and find out deductibles, etc. Had Gabe contacted me that Mon. morning about the issues he had, letting me find out the $2000 ded., I would have cancelled the contract immediately. But his lack of communication didn't allow me that option. I was bound to his company whether I wanted it or not. Insurance wrote a check to me. I informed MCG I could not afford $2000 additional for the work to start but did want to get work done at a later date. They were adamant about stopping by for "their" check. If not, they'd put a lien on my home. I wanted to speak with Gabe, however, was told he was no longer with the company. They're asking me to pay them for their salesman's terrible communication and service, and then leaving me to pick up the pieces. I was completely upfront with them and since then have moved or I would have had the roof replaced. They purchased no materials, hired no crew, and did no work. I did all the phone/insurance work and now am being taken advantage of for this percentage and fees on top.

      Business Response /* (1000, 8, 2021/12/13) */ Good morning, I'm sorry to hear about the situation. I will address everything as it comes in your complaint. 1. The contract is for 9-12-2020 and Gabe was your sales representative. 2. As you stated, he did say you would be responsible for you Deductible. Marlin Construction Group does not set the deductible amounts. That is between the policy holder and their carrier. That is not information a contractor will have or can make up. Also it is Florida law for the H/O to pay said Deductible, and is illegal for a contractor to waive any part of it. 3. We have H/O's that have $500.00, $1,000.00, $2,000.00, and $2,500.00+ Deductibles. he is not wrong stating the average at that time was around $800.00. 4. The window to cancel the contract is not 48 hours, but 72 hours. It is stated on line 14 on the back of the contract for the Buyers Right to Cancel. It States Purchaser(s) has the right to cancel this contract within 72 hours of the contract, but must do so by Certified Mail or Overnight Mail. 5. While I do apologies for your sales representatives lack of communication. We do have notes in the system that states we were reaching out to the carrier, that's when we found out that it was through you mortgage company. Once we received the inspection date, we sent our roof inspector at the time (William) to be there at the time of inspection. He took a few more pictures and uploaded them to they system as well for a time stamp. With the coverage being though the Mortgage, we as a contractor are not able to receive information regarding the claim as we would need access to you Social Security Number and Security Questions that information would not be appropriate for a contractor to request or have on file. This forced us to to abnormally go through the H/O for updates on the claim rather than contacting the carrier directly. 6. For the deductible, it's the responsibility of the H/O to know their Deductible. It's a contract between the H/O and carrier and both parties must agree and sign, this would have been prior to Marlin getting involved. 7. Once you received the check the notes show that you did deposit as you stated and were going out of town and wished to wait a month before doing it. Here is the email from you stating such. 12/21/2020 "Hello Gabe! How are you? Listen, I received the check from the insurance company. I'm going to get the roof done however want to wait until the new year because I have accepted a position in Jacksonville and start on the 21st of this month. That will take care of the deductible by January so that's why I want to wait. I know there was some other form I needed to sign and let's just regroup after the holidays. I will have the money to get the ball going then absolutely. Have a great Holiday and New Year and talk to you soon." 8. After the email we Followed up with you on: 1/8/2021 - LVM 1/8/2021 - Email 1/8/2021 - Spoke with Brittany in the office 1/16/2021 - Spoke to Christian - State you would be back the following Friday and would call him back. 1/22/2021 - LVM 2/9/2021 - Spoke to Brittney from the office - H/O stated she was going to wait another month, Brittany informed H/O that the claim was settling in December and we need at least half down to get started. otherwise she will have to give this over to the owners of Marlin and possible face a lien on the property. Brittney stated she was wanting to avoid that. H/O started to become hostile and hung up on Brittney. 2/23/2021 - Sent to attorney. 9. As you can see we made every attempt and allotted the time to you stated you needed to move this into production. Again, I do apologize for your experience here at Marlin; however, you had signed a contract knowing you were responsible for the deductible. You received calls from Gabe as well as the staff of Marlin to get through the process. The claim was approved and paid out for a total of $10,730.88 Less the $2,000.00 Deductible for the full replacement of the shingle roof and the living room ceiling repair, you yourself stated in an email that you were going to get the roof done. You received numerous attempts to move forward with production. As a result, you were sent to the attorneys for a Breach of Contract.
