      I purchased a property in February 2022 with Chicago Title Insurance Company under my LLC. An Owner's Title Policy was issued on March 22, 2022. Chicago Title Insurance Company issued a clear title policy. However, the title has the following issues: Order of Permanent Injunction and of Judgment and Enforcement recorded 12/24/15 as Document Number ********** in favor of The City of Chicago for the amount of $23,567.30 plus costs, and defendant is permanently enjoined and restrained from renting, using, leasing or occupying the entire premises. Cook Circuit Court Case Number **********. injunction **********. I learned of this matter on January 18, 2024. I have a pending sales contract on the property and the buyer's attorney made my counsel aware of this matter. At which time, I contacted an employee of Chicago Title Insurance Company and was informed via email that the company was unaware of this matter. I have a current mortgage on the property that has a maturity date of March 1, 2024, and the lien holder is not willing to grant an extension. The sales contract has a closing date of February 15, 2024, which would have allowed me to satisfy the current loan. However, the buyer cannot take title given the fines owned to the City of Chicago which puts me in danger of foreclosure.

      Attached is paperwork showing that I have a loan maturity date of 3/1/24. The lender is unwilling to grant an extension at this time. If the lender is willing to grant an extension I will incur additional fees on this loan.

      At closing, last minute changes and mistakes were made that had me leave the table with $37,000.00 less than expected. Closing fees were not told until at the table and were predatory, The nterest rate was changed at the table. The amortization table given by ****** ****** to ***** ****** for the purpose of this sale, was false. It was later discovered that Mr. ****** ****** never applied any of the monthly extra principle payments or overages witch resulted inn a $15,000.00+ shortage of payment owed to ***** ******, the seller of **** ***** ***.

      We purchased a condo, our current home and not an investment property, at the end of 2022. Chicago Title was the title company that handled the transaction. When we made our offer there was also a Sheriff's sale of the property. Seller was still allowed to sell the property provided they settled with the Sheriff's office first. Close was delayed waiting on the paperwork, but the matter was settled and we closed in early December. Later we were looking into refinancing our mortgage and it came out that the Sheriff's sale had not been voided as it should have and the title reverted to that transaction (without any notification to us). We have been trying to work with the appropriate legal department at Chicago Title since but they have failed to resolve the matter in a timely manner and are completely unresponsive to any attempts at communication. We need this title issue settled. It jeopardizes our home and prevents us from refinancing our mortgage, which would save us significant amounts of money. Initial claim was placed 05/19/2023

      I was able to talk to Chicago Title and do some external verification and the matter does appear to be resolved. I am satisfied with their response and the case can be closed.

      I have a home loan with ********* *** ******** was servicing my payments. Almost from the inception of the loan in 6/21 I’ve had problems with Loancare. Signed up for Estatements and wasn’t getting them. Called over and over again and spoke to reps. to fix the problem and always got excuses. People constantly insisting I was getting the statements. I had my loan with Wells Fargo for over 20 yrs. and never had a problem. I pay all my bills and pay them on time. I missed a payment in July because of Loancare. I tried to make payment for July and Aug. in end of July but Loancare wouldn’t let me. Said they’d deleted all my info. out of the system and I’d have to deal with Watermark. The new system wasn’t going thru until middle of Aug. The minute I could get in I paid up completely. I’ve getting notices on how to pay on time, help with foreclosure etc. I DON’T NEED ANY OF THAT!!! I just needed Loancare to take care of me. They reported me delinquent and they ruined my literally excellent credit rating. It dropped 65 points in one day. I can’t get the loan I need for home renovation, buy a car and who knows what else. I worked very hard to get an excellent rating and now Loancare has destroyed it along with my life. I’ve tried and tried to get them to help me and they refuse. I asked to have all my recorded phone calls released to me and they won’t do that either. That proves everything I’m saying. I called Fidelity last week to help me, was told I’d get a call back, they knew how serious this was but I never did receive a call back. Loancare has got to admit it’s their fault, call TransUnion and whomever else they reported me to and bring my credit score back to what it was. If this doesn’t happen…I’ll report National Fidelity to every Government Agency for unethical practices. I’m crippled, have several other serious illnesses, and the sole caretaker to my 83 yr. old mom who has dementia. I have quite enough on my plate already. Please take care this!

      This is the standard letter I keep receiving. There’s nothing right or true in this and I have evidence of it. If this isn’t taken care of…there will be legal ramifications. So so many reviews on social media have same or similar problems with Watermark/Loancare that I do. All this can’t be denied. I also received a letter from **** ********* that has false information. I’ve proven this to him with actual physical evidence. Your organization is unethical and I’ll make sure everyone knows about it.

      I have a title insurance claim (assigned to ******* ********) open for 4+ months without any determination or resolution. Furthermore, I have been trying to reach the supervisor for the Omaha claim center (**** *****) with no response. Claim #****** Claims Administrator: ******* ******** Supervisor: **** ***** Claim: Discrepancy in the title found by Surveyor: Recorded property map is newer than the one referenced on the deed (property line was moved on the latest map). Issue: Over 4+ months in the “coverage determination” phase of this claim. No visibility into the progress by ******* and FNF co. Resolution is a hard blocker for our project (impacting contracts w/ Surveyor, Geotechnical, Architect). Lost time and money (construction window has slipped by 6 months, and now risks slipping by 1 year.       I refinanced my home mortgage with ** * ********* *** and they used Chicago Title Insurance Company to disburse the funds and pay off loans. On August 27 2021 I signed the documents presented to me on behalf of Chicago title company. ****** *********** was the agent working for Chicago Title Company. She only paid off my Mortgage and did not pay off any other loan or send the remaining funds. I spoke to her and gave her the information she said she needed along with my credit union representative spoke to her. Her continued excuses and refusal to pay off funds has cost and continues to me financially in more interest. It is clear she is deliberately not paying the loans and funds. I request reimbursement for continued interest due to ****** *********** refusal to do the job.

To complete my investigation, I have ordered a title search of the property at issue as the complaint alleges that only one mortgage was paid off and no other loan was paid off.  I am still waiting to receive the search. 

       

      In addition, the complaint alleges that ****** ************ was the employee at Chicago Title who handled the refinanced of *** *******’s refinance.  In investigating the complaint, I found that *** ************ no longer works for the Company.  Due to that, I am trying to obtain a copy of the closing file for *** *******’s refinance so that I can review it in order to fully investigate the complaint and to provide a thorough response to the BBB as *** ************ is not available to discuss the allegations with.

       

      Due to the foregoing reasons, I am requesting a 2 week extension of time to respond to the complaint so that I can complete my investigation and respond to the complaint accordingly.

      Dear *** ******:
      Chicago Title Insurance Company (the “Company”) has reviewed the information provided by the *******
      ******* (the “Customer”) in the above-referenced Better Business Bureau (“BBB”) Complaint assigned
      number ******** (the “Complaint”) and hereby responds on behalf of ***** ***** ******* ** **********
      (“*****”) as follows:
      On or about June 2, 2021, ***** opened a title and escrow order for the refinance of the Property (the
      “Transaction”) wherein the Customer obtained a new loan from *** ********* (the “Lender”) in the
      amount of $118,030.00. Specifically, the Customer refinanced his mortgage recorded on May 19, 2006, at
      ***** ***, Page **** (the “2006 Mortgage”), in favor of ******** ******* ****** ***** (“****”) recorded
      in ***** ******, ********, and securing an original loan amount of $95,000.00. As part of the Transaction,
      the Lender executed lender’s escrow instructions (the “Lender Instructions”) which are enclosed. On page
      4 of the Lender Instructions, the Lender instructed ***** to provide evidence that the following debts have
      been paid in full: “******* ***** #***** $11,353.00; ******* ***** #***** $5940; *********** #*****
      $23,235.00” (collectively, the “Loans”). The Lender also instructed ***** to pay off the 2006 Mortgage.
      On August 27, 2021, the Customer executed a mortgage in favor of ****, solely as nominee for the
      Lender, securing a loan amount of $118,030.00 (the “2021 Mortgage”), and the Transaction closed on or
      about September 9, 2021 as indicated on the Final Disbursement Report (the “Final Disbursement Report”).
      The Final Disbursement Report indicates the 2006 Mortgage was satisfied in the Transaction as $65,419.08
      was disbursed to ****. Moreover, the Loans were satisfied pursuant to checks (the “Checks”) issued by
      ***** on September 16, 2021. Specifically, a check for $23,250.00 was issued to ***********, and a check
      for $17,293.00 was issued to ******* ***** for both accounts (#***** and #*****). Copies of these
      Checks are enclosed. Finally, the Customer was wired proceeds in the amount $4,903.82 (the “Proceeds”)
      upon providing ***** with the correct wiring instructions to wire the Proceeds.
      In the Complaint filed on or about September 14, 2021, the Customer asserts that ****** ***********, an
      employee of the *****, only paid off the 2006 Mortgage the Customer was refinancing, and additionally,
      did not pay off any other loans and or disburse any remaining funds to the Customer. The Customer alleges
      that he has been charged more interest because the alleged additional loans were not paid off and requests
      reimbursement regarding the same.
      Please be advised that the escrow instructions to the escrow holder govern the rights and liabilities of the
      parties and the escrow holder. ****** ********* ********* ***. v. *********** ******* ***** ***, ** **** *** **** **** *** **** ***** ** **** ** **** *** (2002). The parties are only entitled to the performance
      provided in their instructions, and the escrow holder is only obligated to perform in accordance with the
      instructions from the parties to escrow. Id. An escrow holder incurs no liability for failing to do something
      not required by the terms of the escrow or for loss caused by following the escrow instructions. Id.
      As to the allegations that the Company did not pay off the Loans in addition to the 2006 Mortgage, please
      note the Loans were paid off in the Transaction via the Checks on or about September 16, 2021 pursuant to
      the Lender’s Instructions. Moreover, the amounts disbursed pursuant to the Checks match the Lender
      Instructions and these Checks have been mailed to the lenders of the Loans. Next, as to the allegation that
      the Customer did not receive any excess proceeds from the Transaction, the Final Disbursement Report
      indicates that the Customer would receive the Proceeds in the amount of $4,903.82, and these Proceeds
      have been wired to the Customer pursuant to the updated wire instructions the Customer provided to *****.
      A copy of the wire confirmation for the Proceeds is enclosed.
      Based on the foregoing, ***** complied with the escrow instructions for the Transaction as all
      disbursements were made pursuant to the instructions submitted in the Transaction. Accordingly, the
      Company, on behalf of *****, denies any and all liability with respect to the Transaction, the Loans, and
      the Proceeds. Moreover, the Company declines to reimburse the Customer any amounts requested in the
      Complaint with respect to the Transaction.
      Based on the foregoing, the Company requests that the BBB close the Complaint with no further action. In
      the meantime, please contact the undersigned at ******************** or ************ with any
      questions you may have.

      I am rejecting this response because:

      ***** title company started blindly mailing checks on Sept 20th 2021 after my initial complaint, without checking with me or confirming any amount due or any other information. 

      On Sept 20th 1 check was mailed to ******* ***** account ending **** in the amount of 17,293.00 which was 13264.53 ovwr amount due.. Nothing was sent or paid to account ending ****.

      Account **** had a balance of - 13264.53 

      Account **** was showing charges for late payment and fees.

      On Sept 22 

      ***** title company paid 11353.00 to account ****  leaving a balance of -2807.73 and canceled the payment to account **** in the amount of 17293.00 which now created a late payment and fees to that loan.

      As of 8.54 pm ******** time on Sept 27 2021.

      My ******* ***** loan # **** is past due and late fees. Balance is 3988.76

      My ******* ***** loan # **** has a balance of - 2807. 73

      This lack of professionalism also created over drafts charges and fees in my personal checking account, that is clearly the fault of ***** title company inability to do the job hired to do. 

      It is very clear that ***** title has not lived up to the terms of their agreement to pay off debts associated with my mortgage.

      With all this back and forth, checks and amounts being changed and reckless check sending,  I request an external audit at ***** title expense and to be done by the title company i first requested to handle my loan back when I first spoke about this loan.  This entire process has been flawed with mistakes and guessing on behalf of ***** title company. 

      I have forwarded this entire file to my attorney for further action.

      They have shown thier lack of ability to carry out the job they were hired to do, by repeatedly doing what they feel is correct and not seeking out any information to make sure what they were doing was correct. 

      My taxes still have not been paid by them, the escrow money taken from **** is gone without any proof of where it went.

      The process has been stricken with flawed from the start.

      There mistakes have cost me in fees,, late fees,, over drafts payments and in 6 months a year or 5 years I do not want to find out they have  made even more mistakes and possibly  at that time have it cost me 1000's of dollars or  my house,.

      Therefore once again I request an independent audit by a company or lawyer of my choosing to be paid for in full by Chicago Title or ***** Title whatever name the are using now, to review the entire process that ***** title was responsible to do, to guarantee there is no more mistakes that they have made.
