      Business Response

      Date: 02/26/2025

We appreciate the opportunity to respond to ********************* concerns regarding her experience with Achieve Test Prep. While we regret that she is dissatisfied, we would like to clarify the facts of the case and provide documentation to support our position.

      1. Program Transparency & Credit Transfer
Achieve Test Prep does not claim to be a college; we are a test-prep organization designed to help students earn credits through the CLEP (College-Level Examination Program) and other credit-by-exam methods. Ms. ********* successfully passed her Humanities, Sociology, Introduction to Psychology, and Developmental Psychology CLEP exams, confirming that she attained the promised credits through our program.
Students are responsible for verifying whether their chosen college accepts these credits. This is clearly stated in our enrollment agreement, marketing materials, and onboarding process.
      2. Program Duration & Structure
Ms. ********* alleges that our program misrepresented itself as "accelerated." However, our prep courses operate on an average duration of 56 weeks, as opposed to the 16-week semester required in traditional college settings. This is evident in her attendance and course completion records.
She attended and completed multiple courses with us before requesting withdrawal. Her claim that she was misled is inconsistent with her active participation and completion of several courses.
      3. Moodle Issue & Word Document Submission
Ms. ********* expressed frustration over Moodle progress tracking and an instructor requiring her to submit assignments in Word format. It is important to clarify:
      - Converting a document to Word does not require any special subscription; this is a basic computer task that can be done for free using ****** Docs or other free tools.
      - When this concern was raised, Achieve worked with her to switch instructors and accommodate her request.
At no point did this issue prevent her from completing the coursework or passing exams.
      4. Financial Agreement & Chargeback Threats
Ms. ********* initially owed a significantly higher balance but was proactively offered a $4,000 reduction in good faith when she requested to withdraw. She agreed to a settlement plan to resolve her account, which was a clear compromise on our end.
She is now threatening to charge back her payments, which would be considered a breach of her reduced balance agreement. If she proceeds with a chargeback, Achieve Test Prep will reinstate the full balance owed and pursue the matter legally.
      5. No Contract Breach on Our End
At no point did Achieve Test Prep violate its contract with Ms. ********** She:
      - Enrolled in the program voluntarily.
      - Attended multiple courses and completed several with passing CLEP exam results.
      - Accepted a lowered balance when requesting withdrawal.
      - Was given a clear cancellation policy per the signed enrollment agreement.
Her claims of fraud and misrepresentation are unfounded, and her records contradict them.

      Final Position & Resolution
While we empathize with Ms. ********** dissatisfaction, her claims are not supported by facts. Achieve Test Prep has:

      - Provided her with the test-prep resources and support needed to pass multiple CLEP exams.

      - Delivered classes that followed the advertised accelerated timeline (5-6 weeks).

Reduced her balance significantly when she requested to withdraw, as a goodwill gesture.

      -  Addressed her Moodle and instructor concerns through multiple accommodations.

Given this, Achieve Test Prep will not issue any further refunds. **************** proceeds with a chargeback or continues to make false claims, we will pursue the full balance owed as per the original enrollment agreement.
We appreciate the BBBs time and review of this matter and are happy to provide any additional supporting documentation if needed.

      Best Regards,
Achieve Test Prep Customer Success Team

At Achieve Test Prep, we are committed to supporting our students in their academic journey and ensuring they have the necessary resources to succeed. We appreciate the opportunity to address this concern.

We regret that the customers experience with the College Mathematics course did not meet their expectations. While we understand the tutor's feedback may not have been received well, our intention has always been to set students up for success. We proactively offer our Fundamentals of Maths coursevalued at $999completely free of charge to students who may need additional support before taking College Mathematics. This offer remains available, as it was originally extended to help avoid an unpleasant outcome when attempting the **** exam. Our approach, while intended to provide value, may have come across too strongly, and we apologize if it was perceived that way.

Regarding course charges, we would like to clarify:

Course Retakes: Achieve Test Prep does not charge a direct cost for course retakes, as these are included in our service to ensure students have additional opportunities to succeed.

Cancellation Balance: The withdrawal balance is calculated based on the number of courses taken. The percentage used in the cancellation policy is determined by the total number of courses attended. We believe the customer may be confusing the retake policy with the course completion calculation for withdrawals.
It is also important to note that the customer has successfully completed other courses with Achieve, such as Developmental Psychology and Sociology, demonstrating the effectiveness of our program in helping students reach their academic goals.

We remain open to discussing any concerns further and encourage the customer to reach out so we can work toward a resolution.

      Sincerely,
      **** F. *****

When I signed up I was told that I would be able to add or take away courses as I need or wanted to. Then when I tried to have 2 courses I did not need removed they said there is a drop fee. I was not told about a cancelation fee as especially of 30% of the total cost. Being upset that this scam happened I told them I wanted to cancel. They said I needed to sign something and pay around 3 grand. I obviously do not want to pay 3 grand for something I used twice but now they are telling me I owe them 10+ grand... STAY AWAY FULL BLOWN SCAM THIS IS NOT A SCHOOL AND YOU CAN LEARN MORE ABOUT A SUBJECT FROM A ******* VIDEO AND CLEP ON YOUR OWN!!!

Thank you for reaching out and sharing your concerns. We understand your frustration and appreciate the opportunity to clarify your account details.
Upon reviewing your enrollment records, we want to confirm the following:

      - During your enrollment call on July 24, 2024, you agreed to and accepted the terms and conditions, including the bi-weekly payment schedule of $141.14 for 77 periods. A $600 deposit was made at that time.
      - The cancellation policy was reviewed and initialed as part of your enrollment. This policy states that after the first 24 hours following the signing of the terms and conditions, students remain responsible for the courses they registered for, plus 30% of the total program cost.
      - You actively participated in the rewards program during your time in the program and redeemed points for your accomplishments.

Regarding your concern about course adjustments, while students can add or remove courses, there is a drop fee associated with course removal, as outlined in the terms agreed upon at enrollment.

We understand that unexpected situations can arise, and we are happy to discuss potential options with you. If you would like to go over your account in more detail or explore possible resolutions, please dont hesitate to contact us at **************. We are here to assist you and find the best path forward.

Date started: 8/6/24 Amount paid: $7350 Dispute: Not providing the proper service they advertise. I was told to attend ******************. I started taking their classes only to find out I don't qualify for their program when I tried to talk to someone with Achieve about this. We did figure out a plan for the future but it would cost me an additional 1000 on top of the 7350 I already paid. It was only after this I was asked for my transcripts only to find out I have taken the classes they assigned me already. Getting to this point I've though several "advisors" most of whom no showed several meeting including their manager and assistant manager. When speaking with anyone in this company it feels like there is no communication I'm having to repeat myself several times what is going on even when I do get ahold of someone. There is a lot more to this story but in a nutshell their misguidance in pursuing a college that even if they were to give me a chance in their program I would have to "knock all prerequisites and entrance exams out of the park" already putting me under the radar to fail is what it sounds like. I have submitted an appeal with Achieve only to be offered a small refund after attempting to get ahold of anyone multiple times and given empty promises. After everything I did entertain the idea of giving them another chance only to have multiple meetings were they (advisors with Achieve) continued to no show for meetings and lack of communication continued so I've decided to ask for the refund only to have continue meetings dodged and my phone calls avoided. Achieve has multiple advertisements saying how user friendly, and will to work with the student in their journey for there degree.

      Business Response:
Achieve Test Prep has worked diligently and in good faith with this customer to address her concerns and provide a fair resolution. Upon submitting her formal appeal, our team engaged promptly and consistently, with interactions occurring almost weekly to ensure a timely review of her situation.
      Original Financial Obligation:
The customers original balance, as per the cancellation policy outlined in her enrollment agreement, was $6,594.
Adjustments Made During the Appeal Process:
Taking into consideration the unique aspects of her case, Achieve Test Prep removed the cost of ODT courses and reduced the amount owed to $3,077.20a significant reduction demonstrating our commitment to finding a workable solution.
We acknowledge the customers frustration but must emphasize that Achieve Test Prep is a preparatory service, not a college, and we cannot guarantee admission into partner institutions. Program eligibility remains the responsibility of the student, including disclosing any prior academic issues, which in this case (an academic expulsion) directly impacted her acceptance.
Despite this, we made continuous efforts to support the customer, including providing alternative options and offering clear pathways to resolution.
      Current Status:
Due to the customers breach of the confidentiality clause in her formal appeal, the appeal has been closed. Our executive team is currently reviewing whether to uphold the latest reduced offer or revert to the original terms of her cancellation policy. We remain committed to treating this matter with fairness and will communicate our final decision promptly.
Achieve Test Prep has maintained transparency, regular communication, and a willingness to work with the customer throughout this process. We encourage the customer to re-engage with us directly should she seek further assistance.

      Customer Answer

      Date: 12/19/2024

      Complaint: 22693565

I am rejecting this response because: Of inaccurate information on their behalf. I submitted my appeal on 11/11/24 and frequently checked to see if they had received my information. I did not get a response from them until 12/9/24. When I submitted my forms I was informed that it is a 2-3 week process. When I spoke with H (male) on 12/9/24 I was informed that they had not yet reached a decision and would get back to me in two days. We scheduled a follow up appointment for 12/12/24 but he failed to call. I then called Achieve and spoke with S (female) who stated that there was no records showing any information on my appeal. She told me that she will pass this on to H (male), who finally called me later that morning. He then offered me a new offer that was $3920.80 out of my $7350. I rejected this offer as it was too low having only taken one class as stated in my appeal. We (H and myself) then scheduled to meet again only to have him tell me through a second party that he will email me a new offer. Unfortunately, I did not hear from anyone until I called the following Monday (12/16/24). So their statement of them keeping in touch with me weekly is false. Any contact that we did have was initiated by me. I was then informed that there was some issues going on with the company, but this was far from the first time employees from Achieve had not attended our meetings.

Another reason why I am rejecting this is because I believe they haven't properly reviewed my appeal. There was obvious miscommunication between H who had knowledge of my appeal in depth, but his upper management either didn't understand my appeal or didn't read it. I understand that Achieve is not a college. That isn't the problem. The problem is that their guidance for what I am paying them was inaccurate, but when I tried to resolve the situation, giving them the benefit of the doubt multiple times, they asked for more money. If you look at my time with Achieve the classes I was assigned, I had already matriculated and passed at ***************. If I was properly assisted in finding the right college and the right courses I needed, we would not be having this discussion today. I understand that they cannot guarantee my acceptance into a program but I was willing to work with them. But their policy on not switching unused classes for others is ridiculous.

Lastly I would like to bring to your attention that their breach of confidentiality clause they say they have is a one sentence on their appeal. I reviewed their terms and conditions that I supposably signed and there is no clarification on there confidentiality clause. Everything I said to the BBB I said to Achieve. I do have the right to make the BBB aware of the situation. This wasn't a one time mistake as multiple issues were handled incorrectly. I feel I have been more then flexible with this situation. Also the term and conditions that I was told I signed does not have my signature on it nor does it say it was electronically signed.

      Sincerely,

      Brittany Hanson12/19/24

      Business Response

      Date: 12/27/2024

Thank you for sharing your concerns through the BBB and for detailing your experience with us. I want to take this opportunity to address the points youve raised and clarify the steps weve taken in your case.

      Review of Your Appeal
Your appeal was carefully reviewed by multiple teams, including management and executives, to ensure your concerns were given full consideration.
Regarding the outcome of your appeal, our policies are designed to strike a balance between fairness to customers and the terms of the agreements in place. While we understand your dissatisfaction with the resolution offered, we stand by the tuition adjustment amount, which reflects a significant reduction based on your circumstances.

      Confidentiality Clause
You raised concerns about the confidentiality clause in our appeal process and its placement within the agreement. While the clause is indeed present and part of the appeal terms, I understand your perspective on its clarity. We will review this internally to ensure that future agreements are clearer and easier to understand for all customers.
At the same time, the breach of confidentiality still stands as it relates to the information disclosed to the BBB during an active appeal process. This impacts our ability to offer additional flexibility in your case.

      Guidance and Policy Concerns
Youve also raised concerns about guidance and limitations regarding switching unused classes. Our policies on unused classes and program switching are in place to maintain fairness across all students. Your feedback is appreciated, and we will consider it as we continually evaluate our processes to ensure they best serve our customers.

      Next Steps
Our final resolution remains the tuition adjustment of $4,125.70, which reflects the original withdrawal terms. This resolution balances the investment youve made with the services provided while adhering to the terms and policies in place.
If you wish to proceed, we will send the updated cancellation agreement for your review and signature. Once signed, your withdrawal will be processed, and the refund will be issued promptly.

      Closing Statement
We understand that this resolution may not meet all your expectations, but we believe it reflects a fair outcome given the circumstances. Should you have additional questions or concerns, please do not hesitate to reach out directly at ************************************************************************************ or **************.
We are committed to learning from this situation and improving our processes to better serve our students in the future.

      Business Response

      Date: 01/03/2025

We appreciate the opportunity to address ******** Hansons concerns regarding her cancellation and appeal.

Clarification on Policy and Terms Provided:
******** previously requested the cancellation policy and terms associated with her enrollment. These documents were provided promptly to her as part of our ongoing efforts to ensure transparency and resolve her concerns.

      Next Steps:
To provide further clarity, we will now issue an itemized invoice outlining the specific charges associated with her program cancellation. This invoice will include:
1- The cost of the completed coursework: $1,099.00
2- The cancellation fee: $3,026.70 (30% of the total program cost of $10,089.00)
3- Total amount owed for cancellation: $4,125.70
The calculation adheres to the terms agreed upon at the time of enrollment, specifically:
In the event of program withdrawal, the customer will owe the cost of completed coursework plus 30% of the total program cost.

      Resolution Plan:
We remain committed to ensuring ******** fully understands the process and calculations. The detailed invoice will be sent promptly, and we are available to address any further questions or concerns she may have.
We hope this provides the clarity necessary to bring this matter to resolution. Please let us know if there are any additional actions required from our side.

Thank you for the opportunity to address ******** Hansons concerns and provide further clarification regarding her case.

      Clarification on Refund Process:
******** financed her program through Climb Credit, and all payments she made were directed to her loan provider. Any overpayment resulting from the adjusted balance of $4,125.70 will be refunded by Climb Credit, not Achieve Test Prep. Once her obligation to Achieve Test Prep is fulfilled, any remaining funds will be processed by Climb Credit and refunded directly to ******** based on her loan terms.

      Next Steps Required for Resolution:
The only pending item preventing the completion of this process is the signed cancellation agreement, which outlines the terms of withdrawal. Since January 8, 2025, we have sent ******** the cancellation agreement multiple times, but we have yet to receive her signed document.
Without this signed agreement, we are unable to finalize her withdrawal or initiate the refund process through Climb Credit. We urge ******** to review, sign, and return the document at her earliest convenience.

      How to Proceed:
1- Review the Cancellation Agreement: ******** can review the cancellation agreement previously sent to her via email. If she requires it to be resent, she can contact us at ************************************************************************************ or **************.
2- Return the Signed Document: Once we receive the signed agreement, we will immediately process her withdrawal and communicate with Climb Credit to finalize her account and refund any overpayment.

      Closing Statement:
Achieve Test Prep has consistently worked to provide clarity and resolution. We are ready to proceed and finalize this matter once we receive the necessary signed documentation. We appreciate ********s cooperation in completing this step so that we can close this matter to her satisfaction.

Thank you for the opportunity to address ******** Hansons latest response.

      Clarification on Documentation and Process:
In response to Brittanys request for a bill or invoice, we want to clarify that her loan is financed through Climb Credit, not directly with Achieve Test Prep. As such, we are unable to issue an invoice or bill for her account. ************, as her loan provider, has already settled her balance with us. Once ******** signs and returns the cancellation agreement, we will process the necessary adjustment, and any overpaid funds will be refunded directly to her by Climb Credit.
We have already provided her with a detailed breakdown of the charges and adjustments, which were included in the cancellation agreement sent to her on multiple occasions. This document outlines her financial obligation and serves as the formal step required to finalize her withdrawal.

      Final Position:
We must emphasize that our decision is final. This process has already gone through multiple levels of review, including the appeal process. Additionally, as outlined in previous correspondence, Brittanys breach of confidentiality policy further limits our ability to revisit the terms of her withdrawal.
The next step remains clear: ******** must sign and return the cancellation agreement for us to proceed with processing her withdrawal and initiating any refund adjustments through Climb Credit. Without this signed agreement, we are unable to take further action and will have no choice but to close the case as unresolved.

      Next Steps:
If ******** has questions about the breakdown already provided, we are happy to clarify further. However, we cannot accommodate further negotiations regarding the agreed-upon terms.

Thank you for your understanding and continued assistance.

I am rejecting this response because: Because of the breach of confidentiality agreement that achieve says I violated did not say that I could not file with the BBB. on 10/17/24 I had a conversation with achieve test prep. I started to enroll with the company to complete the program outlined on the attached file. The initial payment did not process with an AHC payment. I told the company not to go any further with this enrollment, and I would contact them back. The company then started requesting my debit card, I did not respond to the company. I received a phone call the following day requesting me to return the call so I could complete the online enrollment. On the 21st the company called me on the phone, at that time I told them I did not wish to complete the enrollment. I was then sent to the business office to notify them I was no longer interested in their program. I did not receive any type of email containing any type of information about a contract. on the 17 or the following day. They now claim I owe them money and I feel this is completely wrong as I never completed the enrollment, paid any down payment nor received this contract until I requested it on the 21st. I am asking for any type of help to resolve this matter.

Thank you for sharing your concerns.

To address them, we want to clarify our standard enrollment process. This includes a review of terms, course selection, payment arrangements, and the cancellation policy. You electronically signed the contract on 10/17/2024, confirming your agreement to these terms, including the deposit and cancellation policy. When an issue arose with your initial deposit payment, you informed us you would contact your bank to resolve it, and we allowed a split-payment arrangement so your enrollment and progress remained unaffected.

During a follow-up call on 10/21/2024, our advisor continued the onboarding process, introducing you to the portal and resources. At that time, you indicated you no longer wished to continue. We restated the 24-hour cancellation period, as discussed during enrollment. Since this period had passed, the contract obligations remained in effect. Unfortunately, the call disconnected before we could transfer you to complete the cancellation.

We also received a call from an individual identifying as Mr. ********* your legal advisor. Without formal documentation of representation, however, we could not continue the conversation, in line with our commitment to privacy.

We are committed to finding an amicable solution and ask that you contact us at ************ or email ************************************************************************************ so we may discuss this further.

Thank you for your feedback; we look forward to assisting you.
