Painter1 of Boca Raton - ********************************** of contract, voided warranty, fraud, strong arming.Date of original transaction: 10/28/2021 Amount: $2,960. I contracted Painter1 of Boca Raton to paint the exterior of my house with Behr exterior paint. The company specifically purchased the cheaper alternative paint and color matched the Behr swatch, which voids the warranty. Shortly after I had work done on my house (approximately 600 sq ft) and repainted the wall with the correct color. It looked completely different than what they used to painted my entire house. When I asked for an explanation they denied color matching or even using ******* paint instead of the **** paint in the contract. Later the owner said it was because they believed ******* was a better paint. They have continued to make excuses and most recently told me the paint store put it in the wrong bucket. After ignoring numerous attempts to contact the owner, I requested a quote online on 02/08/2023. After realizing it was me, the owner continued to deny the breach of contract, but agreed to have her project manager come out and give me a quote under the condition that I remove a bad review that I posted on Angies in July 2021. *************************** attempted to strong arm me into changing my online review in order to rectify her mistake. I hesitantly agreed. Her project manager was incredibly abrasive and ended the conversation by telling me they werent going to do anything and threatened me and my family by saying I know where you live. I have since contacted the corporate office who told me they cant force there franchisee owner to do anything. It doesnt appear that they have a business plan in place to protect customers against fraud. My complaint is against Painter1 of Boca Raton for breach of contract, voiding manufacturer warranty, fraud, strong arming and threats to a customer. I would like my house repaired and to hold the business owner accountable for fraud and strong armingBusiness response

Painter1 was awarded the job to repaint the exterior of the home after they had their windows replaced. When windows are replaced by the window company or contractor, this leaves the areas around the windows with raw stucco applied. Painter1 pressured washed the house not getting the raw stucco wet. The customer requested that we use *************** paint. I explained to the customer that I was not familiar with that paint as I have a national account with ********************************
Upon arriving at *********** I asked the clerk which paint is most like SW Super Paint and he guided me to the ******* Product. I gave them the color that the customer asked for and they then mixed the paint.
We proceeded to use SW HOT STUCCO PRIMER, applied first as that is the best primer for raw stucco. We then applied the top coat of the ********** paint.
After the house was completed, the customer was thrilled with the job, paid by check and put a 5 *********** review on ****** for us. (I have over 380 5 Star Reviews)
The referred ** to their neighbor to the left of them, and we completed that house as well with no issues.
I am not sure how long after we completed the job, but apparently the customer in question, had the top of the house, left side, RE-STUCCO due to not liking the original stucco there. So once the stucco people re did their work , the customer asked them to repaint the affected area, so now the paint is clearly not going to match, as the stucco did it too quickly, did not primer right with the Hot Stucco Primer plus needed to spot prime, as we covered the house in two coats. They are not painters and should have left it for a painter to do.
Once the customer reached out to me with HIS problem Not mine, he accused me of all sorts of stuff. Now mind you I have not heard from this customer for over a year. When he tried to get in touch with me, he cursed out my Project Manager, my CSR girls who answer the phones and me as well. At one point I calmed him down and offered to help him and repaint the affected area, but to no avail, this man has called me names that I cannot write. He slandered my company, on all sites with his blown out events. He harassed me by calling me over 20 times, and I answered him twice, and told him I will not be spoken to like that and hung up on him.
I told him he would catch more bees with honey, but of course he only knows how to curse and scream at me.
I hired a lawyer to send him a ceased and desist order and demanded he remove the reviews as that was deformation of my company. I believe he did remove them.

The customer requested that we use., Behr paint.This is factual information. However, ***********************;has never expressed that she was not familiar with Behr paint, nor did she indicate that she had a contract with *****************************. I was well aware that they dont normally use Behr paint, thats why it was a request. However, Painter1 of Boca Raton assured me verbally and in writing, that Behr paint would be used. This is the reason Painter1 was awarded the job and created a contract.
The contract was created by Painter1 of Boca Raton and explicitly states that the job would be completed with Behr paint. It is irrelevant that she is not familiar with that paint, and frankly seems highly unlikely. In fact the smaller portions of the house like the trim of were painted with Behr paint.

This is an exaggeration. I was satisfied with the finished product, but did express that the color appeared slightly off. I was told that this is normal and **** hounded me for the review. The review was changed to 1 star after the real paint color and brand was applied to both the raw stucco and a primed portion of the house and l could clearly see it was different. At this point Painter1 refused to answer my phone calls or reply to texts. I have text messages from 02/21/22 with photos of the ******* 5 gallon paint bucket purchased by Painter1, the mismatched wall colors and drops of paint on my patio. **** even said to me that she ignored me because I changed the review, saying: why would I talk to you after you left me a bad review. Although this is not a direct quote, it is the reason she gave for not replying to my requests. The claim that she has over 350 5 star reviews is a red flag as she hounded me for the highest rating and ONLY has 5 star reviews beyond mine. Additionally, she recently strong armed me to remove the review in order to rectify her breach of contract. I believe that the company chose the wrong paint on purpose to save on costs at my expense. I also find it highly unusual that the trim of the house was painted with Behr paint but the stucco the house was painted with the cheaper alternative, considering the stucco is the vast majority of the house.
I have not heard from this customer for over a year.

I have spent hundreds of dollars and painted over portions of my house that have been primed and the Behr paint still clearly does not match the ******* paint that Painter1 knowingly purchased and applied to my house without my verbal or written consent.
They are not painters and should have left it for a painter to do.
This was not possible, as she would not return my phone calls or text messages.

I apologized to *******, her receptionist, at the time of the call and have also apologized to **** personally to no avail. **** has never apologized for using the wrong paint, she has only denied it.

My accusations are 100% factual. The contract created by Painter1 of Boca Raton, signed and agreed upon by both partys clearly states that Behr paint would be used.

Again, *************************** personally threatened not to fix my house unless I removed a bad review from 2021. I also have text messages of this, that were ignored by **** and Painter1 of Boca Raton.
I am seeking my house to be fixed and reject Ms. ********** statement that this is HIS problem Not mine
