    Lender lied about closing date costing me thousands. ********************* the lender has lied and created illegal business practices during our transaction.

    Hello I got a pre approval for a home loan with usda through i3 lending for the guaranteed home program. I have a disability and I became ill due to the disability. I made late payments but some of the creditors removed them under the disability act. I also provided documentation. I was told to due this but Cynthia ca**. I also had given the law office that was doing the closing my earnest money. I also paid the buyers interest on the loan they had to give me 30 days to get back on track with payments. I did all the work and the lender was supposed to due a rapid rescore but did not. So they did not follow the due to my responsible accommodations with there rules or the guarantee program rules with usda. They did not submit paperwork to usda to even see if they would approve it. Can you please help me with getting me a home.

    On 01/19/2022 We took the loan application for Ms. *******. We received all requested documents on 01/24/2022, and we pulled her credit on 01/27/2022 where are scores were ******** **** ***** ***** **** *** ******* ***. At that time, she was in line to move forward with a USDA loan. I advised her that this loan will allow the full purchase price to be covered and she would then have to pay her closing costs. We immediately introduced her to an agent, and they began to look at homes. We advised her that her buying power was 190,000. When we advised her of the buying power, we asked her where she would get the closing cost from and she said it would be a gift. On 2/19/2022, Ms. ******* called and asked if there was any way she could increase her buying power. The question was asked if she had any additional income, etc. She advised yes, we added additional income and increased her buying power.  During that time I advised Ms. ******* she must maintain credit, etc. 03/10/2022, Ms. ******* advised her child support would increase and we increased her buying yet once again once the information was provided and we increased. 03/24/2022 Ms. ******* requested that she wanted to switch agents and she did. 04/05/2022 a conference call was scheduled with Ms. *******, so we could go over buying power and ensuring she was maintaining credit, income, etc. Please also note Ms. ******* had four different agents.  While we hadn’t heard from Ms. ******* she had found a fourth agent that went out and found her a home. They sent the contract to us. We immediately got updated documents from her and pulled her credit report, because her report had expired.  Once it was pulled, we had scores of the following: ******** **** ***** ***** **** *** ******* **** I went over the credit and advised Ms. ******* that she had not been paying her bills from the beginning, even though I had advised her that her credit had to be maintained. She her late payments in 2022 in April, January, May, and February. I advised all parties we couldn’t move forward at this time because Ms. ******* hadn’t maintained her credit. I advised the agent, etc.  I questioned Ms. ******* regarding the late payments and asked what happened. She advised that she was sick and was off work. I did tell her that she would have to provide paperwork for that, but she never told us that she wasn’t working. I continued to explain to her in detail but during this process learned that Ms. ******* is schizoaffective disorder. I began to ensure that I did everything by email and in writing to make sure she was understanding our end. She then advised that she had gone back to work and would call the creditors to get the late payments removed. We even assisted Ms. ******* by writing the letters that she needed to send to the creditors so that we could do the rapid rescore. I continued to stay in communication with the agent that Ms. ******* had chosen.  As it got closer to the time to close, the agent advised that we could ask for an extension.  The seller wanted the buyer to pay for the additional interest that he would have to pay by keeping this off the market.  We both explained to Ms. ******* this would be a risk and that she wouldn’t get her money back if she paid this amount. Her earnest money was given to the title company, but that was the choice of the agent. This has nothing to do with our office as well as the extension.  The creditors did remove lates and we requested the rescore on 7/7/2022 with our documentation. The rescore was completed on 07/11/2022 and Ms. *******’s scores were as follows: ******** **** ***** ***** **** *** ******* ***. As we had worked alongside Ms. ******* to assist with clearing up the late payments Ms. ******* established while looking for the home. As we got those removed Ms. ******* had gone and opened a trade with Republic Finance in June, which we did see, but she didn’t make a payment on this account on 7/22 and 6/22. She opened ******** *** on 4/22 and didn’t make payments on 6/22 and 5/22. ****** *****, didn’t make payments on 4/22, 5/22, or 6/22. Central Loan was late 4/22. Fingerhut had a late payment on 6/22. All these late payments weren’t reported in the June report pulled, these are things that happened during and after our discussion of the June pull.  My office did exactly what we said we would and rescored her report, but once we repulled we saw that Ms. ******* was continuing to not be responsible and pay her bills on time.  No, we didn’t submit to the lender because there was no need to because of the continued late payments and the guidelines clearly state the 12 months must be clear of late payments.

    I am rejecting this response because: I did all the work that she told me to do I did pay my bills on time . If that was not the case then why did she did the rapid rescore. What was my scores before the rapid rescore and the rapid rescore was in June not July. I presented that as well. I also gave u the paperwork for the creditors that worked with me to remove so that was not true. When I told her I had been sick and given paperwork to her she should have did all she could to help me and she did not. As a lender you have to follow the rules and guidelines of usda. They offer a responsible accommodations for applicants with a disability. Did bbb review all the paperwork I presented to them. I need a better solution. So the lender can not honor the rules and guidelines of usda. My application was not even submitted to them. That is where the funding comes from. It also is a home guaranteed program. So it would have been up to usda and she did not even submit it to them with the resonbile accommodation. They did give those. It is the law under the disability act. I would like to purchase a home that is all I am asking I came to far and I can’t control when I get sick. So you gonna hold that against me and not even let me live like a regular citizen that works everyday. You are breaking the law by not under the disability act.
