As I am reading contract I seen they are saying I agreed to making a down payment for a 2017 **** Explore XLT of $3500 when I agreed to putting $2500 down on a vehicle that has *******. Now I got all the way back to my destination Im literally 10mins out from my destination an I start feeling to car doing something worried, so I arrived to my destination as I pull in the car literally doesnt want to back up now it shut off on its on now. Now I see why they you you to sign a contract stating you cant use them.Business Response

I live in ******* by the way. So about December 14th of last year I bought a car from family Auto Mart. I put 2k down and it was about 500$ a month. I was going to college and using my GI Bill to pay for it, but my GI bill got messed up 2 months in. They repoed the car 12 days after a missed payment. Which I'm pretty sure the law states it has to be a month afterwards. The law also states they have to give you an opportunity to retrieve items from the car before they repo it. They didn't do that. Finally I call the guy to get my items back the next day. He tried to charge me 150$ to get my stuff back. I said nope left and talked to my lawyer in the state of *******. He stated that they can not charge me to get my items back. I had him email that to me and I showed it to the repo guy the next time I made an appointment, he said that my lawyer was wrong. Now this is where it gets shady. My mom went with me to get my car and to get my stuff back. The truck the guy pulled up in. My mom stated she saw it in Family Auto Marts lot hidden in the back like they didn't want people to know. I had medications in the vehicle, I know for sure because they're not in the house. And they're not in the bags I got back.Business Response

In response to complaint # 21810088. Our hope is that the customer honors ******************** agreement. Unfortunately in this case, it was not. We had no choice but to hire a recovery company due to default. Personal belongings are between owner and recovery company.Customer Answer

I am rejecting this response because:The repo company isnt a company it's just y'all again, and 2. Y'all have to follow the laws you did not several times apparently according to your reviews you do not follow the law on time required to be passed before you can repo the vehicle. PER FLORIDA STATE LAW a month must have passed without payment. I was 12 days. And The lender must send a Notice of Right to Redeem Vehicle within 45 days after the sale. This gives the borrower a chance to pay the deficiency balance plus fees to redeem the vehicle before the title is transferred.
60 days The lender has 60 days after repossessing a vehicle to send a Notice of Sale informing the borrower of the upcoming public sale date or that a private sale will take place. Those are other things you didn't follow. Might I also add, you are supposed to send an Inventory list of what was in the vehicle. THAT DIDNT HAPPEN. And before you say it was the repo company again, YALL ARE THE **** COMPANY YALL **** YOUR OWN VEHICLES. My mom saw the repo truck while we were at the lot!!!! H*** we rode by a couple days later just to make sure and SURE ENOUGH THERES THE **** TRUCK IN YOUR LOT. Keep playing with these illegal business practices. Y'all already have ****** off a lot of us? What happens when we all come together and go to a news outlet? **** my words yall will be closed. Your illegal business practices will not be allowed to continue. Y'all broke 4 statutes for repossessions. I have all 4 that you broke listed in this paragraph too. Not that y'all are actually going to read it because why would you? You're criminals.
Sincerely,

I am rejecting this response because: y'all are lying scum to stay in business. Mine and my mother's claims are not inaccurate. WE HAVE BOTH SEEN THE ****** and I've only seen 1 fat guy on your property and it was the fat guy that repoed the vehicle. Care to keep lying? Because this can be made a whole lot larger with a whole lot more people. You don't realize the magnitude of the people y'all have screwed over. Also I love how you don't even acknowledge the fact I LISTED THE **** YOU BROKE. completely ignored them huh. Guess I was right on those 4 laws you broke and you know that.
Sincerely,

They said an invoice can be paid for to prove my statements false. I also have several people who can prove they never did anything required by law during a repossession.Initial Complaint

After complaining about predatory attitude that they were doing. They refused to deal with me anymore and called the local police on me and and trespass me. That's their way of dealing with a bad deal. I guess they're used to it **** and his cronies need to be held accountable for their actions of taking honest people's money and dealing what they do and sell them complete garbage. They say they check out their vehicles and they do not. I had my mechanic look at mine and he said it was never looked atBusiness Response

I understand the vehicle was sold as is but come on. I drove the vehicle 26 mi before. It had a major electrical issue that they couldn't resolve. Then after paying $7,000 they only offered me $5,000 on a trade-in towards another car that they wanted additional $6,000 on top of the $5,000 that they allowed me total scam and I was left with no other situation either. I have a car that runs or a car that has a major electrical issue. They left you at no choice. Total scam artists
