I put a deposit of $1032 on a vehicle yesterday And called them this morning to get my contract and finalize the paperwork only to find out that they were in the process of selling the vehicle to somebody else and according to Florida State law "******* Actionable, unfair, or deceptive acts or ************ is an unfair or deceptive act or practice, actionable under the Florida Deceptive and Unfair Trade Practices Act, for a dealer to:(10) Require or accept a deposit from a prospective customer prior to entering into a binding contract for the purchase and sale of a vehicle unless the customer is given a written receipt that states how long the dealer will hold the vehicle from other sale and the amount of the deposit, and clearly and conspicuously states whether and upon what conditions the deposit is refundable or nonrefundable."*************************************************************(10)%20Require%20or%20accept%20a,deposit%2C%20and%20clearly%20and%20conspicuouslyBusiness Response

Good afternoon,
we received a deposit for this vehicle and at the same time got another salesperson getting another deposit for the same vehicle, as the system wasn't updated yet with the hold. All customers has 3 days to do the payoff, and this other customer finalized the payment that same day. Because of this, we refunded Mr. ******** his deposit, as the vehicle was paid off that same day by the other client.
This doesn't happen often, but it may happen, like in this case. Attached you can see the deposit refunded to this customer.

I am rejecting this response because: I Was in talks with this business on Sunday evening, and nobody. had sent me a valid payment link. Thus, when they told me somebody was at the yard, looking at the vehicle, I told them to let me pay them now. So they sent me a payment link. I paid this Deposit and let them know I was ready to pay in full as soon as they told me. But rather than allow me to do that, they let the other person buy the car because he was there in person. They are. lying and I have all of this recorded.. so they can continue to lie or they can do the right thing because I already have a lawsuit with an attorney in Miami and we're going to go after their *****. I told them, when they did this to me, that this is what I was going to do. And rather than try and facilitate what should have happened because of the law in the state of *******, which they are very aware of, and I made sure that they were very aware of. Should have allowed me to purchase this vehicle before the other person, because I made my deposit before them and told them I was ready to send the rest of the payment whenever they gave me the link to do so. they are lying to try to save face. And I am not going to put up with it, just like I told them. I will be after their **** in court, and I am going to pursue this bbb complaint to the very end. stop habitually lying, you repugnant scum of an excuse for a "business." I even went as far as to find the owner's personal cell phone number confirmed he owned this business and explained to him what was going on. And he had my side until he spoke with his manager, who let him know that I mentioned I was going to call an attorney if they went this route. They got scared because I threatened to get my attorney involved. And rather than do the right thing, they decided to do the stupid thing. So now I'm going to make them pay for it.
Sincerely,
****** ********Customer Answer

I can provide you with any documentation you need, but guarantee I am going to take this to court. these guys are scammers and they tried to s**** me out of the deposit And ultimately just ended up s******* me out of the car because I told them I already had an attorney on retainer for things just like this. This business needs to be held accountable for practices that are against the law in the state of *******. If you look them up, you can see they have done this to other people and they need to be held accountable and I am willing to do whatever needs to be done to make sure they are held accountable. That includes everything up to appearing in court in ******* Make sure that they never do this to anybody again. The worst part is, after they did this to me, they then tried to sell me multiple other cars, which was just. let's you know that they don't give a **** about me. They only give a **** about money now.Business Response

This a serios business that has been practicing for more than 10 years. The only payment for deposit received was refunded the same day. We, a car dealership, have the right to refuse to sell a vehicle, even if it's been advertised or a customer has expressed interest, we are not obligated to enter into a sales contract and can choose not to proceed with a sale for various reasons, such as the car being unavailable or the dealer deciding to not sell to that specific buyer. We never refused to sell this car, this car wasn't available anymore, the customer could either chose another vehicle, or like in this case, payment of $1000.00 to hold the car was refunded. We are not engaging in deceptive practices or discriminatory behavior.Initial Complaint

Paid $1000.00 deposit for what was advertised as a clean title 40k mile vehicle, when the sales person presented the title it was showing a branded classification with fraudulent unknown odometer number. The entire exchange took place over a few hours and when i requested a refund I was told due to the policy i signed that wasn't possible.Business Response
Date: 11/21/2024
Good afternoon
the title didn't have any problem, is under the dealers name and the miles that shows is ****** TMU. All deposits for the vehicles are non-refundable. This customer was financing the vehicle with a finance company on his own, and we waited for the approval of the loan until the customer decided he didn't want the vehicle any longer.
Attached is the copy of the clean title that was showed to the customer for the financing with the bank and the non-refundable deposit signed by the customer.Customer Answer

I am rejecting this response because: My interaction time with Elite Motor Cars of Miami consisted a phone conversation and text messages that took place September the19th, 2024 all in for a total of about three hours early that afternoon. I found the business through the ************** website where the vehicle was listed for sale as "clean title" (2017 ***** Corvette, with 44k miles on the odometer. That day I spoke with ********* "*****" in sales on the phone, as I was committed to the purchase contingent on viewing a copy of the "clean title" status that ***** assured me of the ****** status before taking my $1000.00 payment for holding the vehicle. ***** sent me a copy of the ****** after that phone call and I immediately called ***** back that same afternoon upon receiving a copy of the title, and requested a refund because the title presented to me reflected inaccurate mileage. ***** said they could fix it, i declined the offer and again requested the refund, ***** said okay, it may take seven to ten business days. I have not received the refund as of this message.

Good afternoon,
we understand the process of the customer with the sales person. The vehicle was posted for sale as clean title with ****** TMU miles, meaning "True Mileage Unknown". Nothing in the description of the vehicle for sale was deceiving.

I am rejecting this response because: Elite Motor Cars of Miami's advertisements use of "clean title" is misleading, as the vehicle's title classification as "not actual" miles indicates potential damage or reconstruction that could compromise its true condition and history. In ****, state law prohibits titling a vehicle with inaccurate mileage.Despite your understanding and the sales representative's assurance of my $1,000 deposit refund, I have yet to receive the promised funds.

I bought a 2019 ****** Impreza in August 2022, a vehicle, according to the FL DOT, belongs to a bank, and I was not issued a valid Certificate of Title, one necessary to operate the car. It doesn't make any sense what the customer is saying. If the customer doesn't register the vehicle, of course is not going to be able to get a title as never was registered in ******* or any other state as the customer is not from **. As soon as they receive the title they have to register in their state. We are a dealer, we do reassignments in the titles, we do not register every vehicle under the dealer's name, its not an obligation or necessary.
Again, if the customer wants a duplicate of title because they lost it, we will be able to get a duplicate that will be send the same way with ***** so we and the customer has a tracking number as the one they received before. Our email is ******************************** The can always email us to request the duplicate title.
We NEVER sell a car without title. We are a dealer that has been in business for more than 7 years, we are aware we cant and NEVER have, sell a vehicle without a title.

Good afternoon,
we don't have information for the specific matter. Indeed we sell damage vehicles, we sale salvage, rebuildable, junk. The type of title of the vehicles are always disclosed and the damages of the cars as well. However, we always tell all futures clients when they call, that they are more than welcome to send an inspector before making any deposit. If we receive any call, our salesperson send even videos of the cars we have posted for sale, so the clients can have a better view.

I saw a vehicle listed on **** for sale by AE of Miami (they use different company names to sell their vehicles). I made an offer that was not accepted (on ***** then made another offer and it was accepted (on *****. I didn't know that they had taken the vehicle off **** after they accepted my offer so they could sell to me OFF ***** Doing this cancels my **** buyers' protection that **** offers. They then send me a form to sign saying my deposit was non-refundable. I was confused because the **** ad does NOT say the deposit is non-refundable and at the time I didn't know the vehicle was taken off ****. They are doing this to people other than me so they can scam people out of their deposits. I found this out after doing research after they did it to me. This company owes me $500 (my deposit) and they need to be shut down and the owners need to be thrown in jail for fraud! Apparently this is how they are able to stay in business. They scam people out of their deposits. They are selling wrecked vehicles, not disclosing all the damages and then stealing the deposits people are making on the vehicles. They are also demanding full payment within 3 days after deposit is made. If you don't live in ** it is impossible to get to their location in time to inspect the vehicles before your deposit is stolen by them. By the way, they list high-end vehicles for sale as eye candy to make people think they are a real high end and reputable car seller! (examples of ads included in documents.)Business Response

On or about Jan22,2024 i contacted this company to discuss buying a car. Upon speaking with Main *** of this buisness he said he would take $29,000 for the vehicle we were discussing. He said he would have to talk with his partner to see if they could take that for the car. i called him back after a few hours and he said $30,000 would be the lowest they could go. at this time i requested more pictures of the car and we discussed damage. The vehicle was a wreck and was a rebuidable. when i asked if there was any other damage to the car than the obvious in the pictures he said no other than an electrical isssue. I purchased the car and asked for verification of payment received and after reading a few reviews online asked if the car in the pictures presented to me was the car that would show up? it offended ********** and communication stopped. when the vehicle showed up it had decking wood screws and sheet metal screws along with zip ties holding panels on. It was also missing the hood from the pictures and a diffrent front wheel from what i had purchased. it was a bait and switch. These guys are straight crooks,i would recommend noone buy a bolt let alone a car from these people. i have the pictures that were emailed to me and the actual car that showed up. I would hope not only to get the message out to keep someone else ***** getting scammed.Business Response

Hi,
this vehicle was sold as a damage, inoperable, airbags deployed, electrical issues car. The customer was aware of this at the time of purchase as well is stated in the sales contract that has been signed by the customer as well, see attachments. Also attached are the pictures of this car posted on our website.
We always encourage the customer to inspect or send someone to inspect the vehicle before putting a deposit or making a final payment. We sell damage cars, as is, no warranty or arbitration.
The customer received the same car in the same condition as it was advertised.

This car was grossly misrepresented. I was aware of it being wrecked. I was not told it was a hard rollover with parts zip ties and screwed together with wood screws. This car has mismatched body panels. The company obviously welded parts, put a windshield in it and done what patch job they could just to s**** someone on a sale. They are crooks, plain and simple.Business Response

Good afternoon,
We can resell the vehicle in our lot on behalf of the customer as a consignment car, we will need the vehicle here at the dealership. Whatever the price the customer agrees on posting the vehicle for sale, and is a fair price on the market for this type of car, we can do. As soon as the vehicle sells, and we receive the payment of the sale and clears in our bank, we will send a wire or check to him.

We can post the vehicle for sale up to 3 months on our websites. The car doesn't have to be here, as most of our vehicles we sell it over the phone or online. We will just need updated pictures as of today. We will post the vehicle for a fair market price, and until it sells, we will send the profits to the customer.
Attached is an example of the forms the customer has to fill out. This is not our vehicle any longer, but the customers.

I was looking for a car. I called and enquired about a 2019 ****** that was about $5000 to $6000 dollars I asked the employee what was wrong with the car and he said the car drives back and forth. It got wet inside but that means it could have been a bit of water inside. The car works. I said I wanted to see it and if I could come by. ****** said to pay a deposit so I can pay the rest in 2 days just so no one will take the car I sent him my id and he kept asking for more ids. I did more research on the car I asked friends and they all said flooded and savage means the insurance has been claimed because this car cant be driven. I then got a receipt where it said there was no refun for my $500 dollars and they would not refund me under any circumstances. I texted ****** asking him why he took my $500 in the first place and to give me a refund. This was all within the same day. I asked for a refund of a deposit to be able to see the car. ****** doesnt speak fully Spanish or English and then he tells me his main language is Italian. I asked him and called the establishment multiple times to refund me and they wouldnt. I live in *************** didnt even see the car. Didnt sign anything and they think they can keep ripping off people who are not very knowledgeable. I want at least my money back. Theyve caused me anxiety and stress. No one should go through thisBusiness Response

Good morning
All the deposits for all cars are not refundable, that's the dealership policy. The reason for this is because once the vehicle receives a deposit, we take it out of all the websites posted for sale, so the customer don't lose the car to another client and we also don't have the opportunity to sell it to another possible client. Attached is the deposit showing all deposits are not refundable, we apply this to all customers with no exception.
The vehicle is indeed a salvage car, meaning it has to be inspected to be able to drive legally, we specialized in selling damage vehicles. Once it get inspected, it can be registered, its not a car for parts, it was a car reported flood.

Good afternoon,
The vehicle is a damage vehicle, you can see in the pictures posted for sale in our website, so it will carry some issues. It required some fixing to do in order to being able to be driven. Attached are the pictures posted.
Indeed we haven't been able to provide the title to the customer. The vehicle is a clean title, the issue we had is that the title was lost on the way to the dealer, and we had to order a duplicate which should take two weeks because it was expedited, but still we have to wait for the state and sometimes they take longer. We are aware of this, so we call every couple of days but we keep getting the same answer, the state is working on it.
The title will be provided to the customer as a clean title as soon as we the duplicate with us.
We are really sorry with the customer, we have been answering emails and phones calls received from him. Still working on it.

I am rejecting this response because:We have now past 90 days and i still have no title, on background checking the vehicle i see no movement has been done to obtain said title. how then could it be lost on way to dealer??
i am well aware of the damage to the vehicle and im also aware of the recorded conversation we had and the text messages on my cell confirming condition, presence of named components. i did not expect to be provided a parts car with multiple critical components removed or replaced with faulty components.
it is clear this vehicle was used to part out for other vehicles and the shell sold as a clean title/salvage vehicle.
