7/24/24 I gave a deposit of $1400 check number 1491 to ****** ********* to lay a concrete patio/sidewalk into the entrance of my home at ***********************************. He had worked for my neighbor across the street and laid a patio for her. ****** said he would send me a contract and never did. Did not show up to do job, did not answer my emails for awhile etc. When he finally called me said he had been busy. I told him I had a major sewer problem they dug up my front yard, I sent him a picture and said we would need to delay until they finished the work. Then I called him I need you to come to see and adjust the pour. He did not show up on the Sat. we agreed. I was fed and left him a message saying return my deposit. He has refused, ignored me, called me by the wrong name, told me to come get my material when it has to be done by a concrete truck etc. He has stolen $1400.00 from me. I am a 75 yr. old woman and I need your help to get my funds back from him. I just do not understand his attitude. I have emails on my phone etc. to prove his non compliance even when he was supposed to come to do the work originally. Please help me. I do not want to go to court or to cause him problems, but he has taken my money and will not return it.Business response

***, we have agreed on doing your concrete work from the day you gave us a check to do the work. From that day you said it will be awhile before you wanted to do the scope of work. Months have gone on and your back and forth of traveling and then out of no where after your contract states no refunds when materials are bought, that we would not refund your project. We have went out of our way to get your materials, planned dates to do the work. And then your response was that youre traveling.
I would give you the refund back of what has been spent and provided you with the materials and you did not want to do that. After materials you are left with $689.25 that was the concrete bill that would be used to do the project that youve stalled for months on. We dont just jump for you when you are back in town from traveling when theres others that wait just like you would have had to.
the 75 year old card is pathetic. Stop playing a victim role when your at fault for scheduling. Your no different than any other customerCustomer response

I am rejecting this response because:1. He never sent a contract we have no signed contract.
2. He came across the street to my house when he was working on my neighbor ***** ********** patio.
3. To do my front walkway and make it a patio walkway he said it would be $2800 dollars and he needed a $1400 deposit. I gave ****** a $1400 dollar check. He said he would send me a contract. He was going on vacation the next day, no contract came. So on July 24th I reached out to him saying any time in August would be fine to come do the work.
4. On Aug. 7th he reached out to me saying "Hey ***, we are getting closer are you about ready?
5. I answered back that I was on the other side of the state, I would call him.
6. Aug, 19th 10:17 am, I left ****** a message saying I would like to get scheduled ;
7. Aug. 19th 1:29 pm ******, sent text we will get you scheduled next week, I'm full this week.
8. Aug 26th, I texted ******, when are they coming to do my work.
9. ****** on Aug 26th said Saturday.
10. I said okay
11. Aug. 27th ****** texted single word delayed.
12. Sept. 3, 2024 I texted ****** saying big sewer issue we need to delay, I sent him him pictures.
13. ****** texted back on Sept 3, "okay that works keep me posted.
14. Sept 15th, I texted ******, I will be back sometime next week. I will probably drive back on Wednesday. Do you think you could come by on Thurs. or Friday? The concrete pour is going to have to be done differently. I cannot cover where the clean out is. I will need to discuss with you.
15. Sept 17th ******, I need a response from you. I tried to call you 2xs but there is no answer message to leave you a message. We need to discuss my options for the front pour, or you need to refund my deposit of $1400. ***** my neighbor has also sent you a text message regarding the excess concrete you left and needs to be picked up, she gets no message back. Please call me.
16. Sept 19th, 2024 Texted ****** please contact me. I have called numerous times what is going on that you are not getting back to me.
17. Sept 19th, ****** texted back, "sorry, I haven't gotten back to you because I been super busy. I also misunderstood. I was waiting for you to come back. I'm out for about two weeks right now.
18. Sept 19th I texted back alright, I will be back next week. Please schedule a day you can come and we decide what the pour will actually be. I want to get this work completed.
19. Oct 28th, 2024 Again I texted ****** saying I am back can you stop by so we can come up with a plan and get the work done.
20. Oct. 28th, 2024 ****** responded Okay your ack to get this done now?
21. Oct 28th 2024, I texted ****** back Yes, but I need you to look at the change what happened with the install of the sewer cleanout.
22. Oct 28th, 2024. ****** texted back to me "Okay, can we meet Saturday.
23. Oct 29th I texted back Okay, I will, just give me a time.
24. Oct 31, 2024 ****** texted back Okay I will.
25. Saturday, Nov 2, 2024 ****** what time will you be coming over.
26. No response from ******, he never showed up. I texted him two more times
27. Sunday Nov 3. 2024 I texted ****** saying you were supposed come yesterday, I know you are busy with your business, but I think it best now that you just return my $1400.00 dollar deposit.
After this there was continued text from him refusing and ignoring my texts to return my deposit.
This man has done everything possible to show up at appointed times to do the work, he knew about the sewer issues, but refused to come and see it when he said he would. I want my full deposit returned to me. Please tell me now how I should proceed.

I am rejecting this response because:I want case number ******** to be reopened. I do not agree with what Tidal Wave Concrete's last response was. He is lying. He continually did not show up on appt dates even before the sewer problem arose and I sent a timeline of the occurrences. He took my deposit and never sent a contract. I want my deposit back or he can show up and put a patio on the side of my house not where the plumbing issue was. The original cost he told me verbally was $2800. That is what he also charged my neighbor. If he will not cooperate, I would like to discuss with ****** what my next steps should be. This has gone on long enough.

We paid the owner of Tidal Wave concrete in full as demanded by the owner (*******************************) to extend and repair our driveway that was originally installed by him. Upon pay the driveway was to be completed. ****** has made false promises and committed to dated to come and complete the driveway but never shows up. Currently ****** is ignoring all attempts of communication. I simply want my driveway completed or a refund.Initial Complaint

I paid 2000 deposit for a concrete walkway that I never received. The seller is avoiding me and wont complete the job. When he does correspond with me he is aggressive and tries to intimidate. He created a huge mess in my yard and never provided what I paid forhe is a convicted felon and has terrible reviews, lawsuits and complaints on BBB from other customers. He took my money and never provided me with the service. He was supposed to show up today. Never showed up, didnt reach out to tell me why and wont respond to my correspondence. I want my money back and to cut ties with this untrustworthy company.Business response

Im sorry ******* that we couldnt get to you in a timely manner. You were refunded via PayPal. I think its best next time you want a project done dont stop the company doing so and being so cheap with what you are wanting done. Thank you have a great day.Customer response
