    My son purchased a ************************************************************************* his existing car and put money down.The loan agreement was for 75 a week payments.My son has made every payment on time, until the June 6, 2024 payment In May of ************************************************************************************************************************* the military. He provided his fiance's number as a point of contact for payments in case there were issues with his upcoming military check On June 11, 2024 at 1:30 am my son's truck was repossessed from our driveway despite him notifying the dealership that he was away on active duty for the army.A creditor for automobiles is required to do a search prior to issuing a repossession of a vehicle This dealership is in direct violation of the Servicemembers Civil Relief Act (SCRA). Specifically, 50 US Code Sec. 3952.We contacted the dealership on June 11th and notified them that our son is away on active duty and that this repossession is not legal. The dealership refused to return the vehicle, We continued to try to speak with the owner about the law and that we are willing to pay what is owed on the weekly payments as our son's military money is now depositing into his account and we will continue to pay.On June 14th, the dealership would only allow us to have the vehicle if we paid $320 for a release fee from him personally, and the towing company an additional 400 cash for storage of this tow.We informed the dealership we do not have that kind of money to pay for something that was illegal in the first place and he refused to return the truck.My son is away and unreachable by phone and cannot do anything while away, serving for our country and dealerships and people should not be permitted to continue to do business while illegally taking advantage of the soldiers that fight for their freedom.

    We sold *************************** a 2004 **** Ranger. We are a buy here pay here.and we financed the Truck. At the time of the purchase we explained to ***************** that we have a 7 day *********************** and that on the 8th day after the payment was due that we would repossess the vehicle and that he would have to pay the entire balance owed to get it back. He acknowledged and we gave him a copy. He did tell us that he would be going into active service. We had no knowledge of any law that probits us from recovering a vehicle in default because they are in active service. We are not required to do any searches prior to peposessing a vehicle. We are required to get continuing education every 2 years to renew our dealer license. After reading the law on line and contacting the ********** of ***** Vehicles. We offered to release the truck to his father. We told him that he would have to pay the repo fee that I was charged.  (The law does allow for fees to be charged. )   He was willing to pay that untill he found out yhat the repo company wanted addional fees.

    I purchased the vehicle with $3000.00 down. Made every payment. Without so much as a courtesy call I overlooked the fact that my payment was one week beyond the payment date. On a weekly payment of $75.00. I had been Hospitalized two weeks earlier and was unable to fully manage my financial affairs. The vehicle was siezed within 24 hours after my payment due date over a matter of $75.00. This is appalling.

    When ************** purchased the truck, he was informed that if he was one day past due that he would subject to repossession however we have a 7 day grace ****** and that on the 8th day that his truck would be repossessed  ( no exceptions ) and to get the truck back the entire balance would be due in full. This was explained to him and he signed and received a copy.
