We utilized FBC Mortgage LLC for our new home purchase with Maronda Homes. The loan was initially managed by Central Loan Administration & Reporting. On January 7th, 2022 we received a letter that stated all payments due on and after February 1st, 2022 were to be sent to FBC Mortgage LLC. We sent a check to FBC Mortgage LLC as requested and cancelled our automatic payment. On February 1st our automatic payment was initiated anyway and on February 8th a second automatic payment was initiated without our knowledge. After this incident I contacted FBC Mortgage, LLC regarding the multiple payments that were taken from our account. I was initially told that the second automatic payment would be reversed and that I would receive a check in the mail for the error. A few days later I received a call from FBC Mortgage, LLC and was advised that they would not be reversing the charge, even though they created the issue with the multiple automatic payments, and that there was nothing that could be done to resolve the matter. This is unsatisfactory and an example of lousy customer service to say the least. When you make a mistake, you take responsibility for the mistake and correct the issue. That did not happen. I'm requesting a refund of both automatic payments that should not have been taken out of my account. The check I sent FBC Mortgage LLC covered the mortgage payment. That is all they are due at this time.

On November 2nd, FBC Mortgage pre-approved me for a mortgage loan. The process kept going and all the necessary paperwork was submitted. The loan process went to Underwriting and only 2 days before closing I received a phone call stating that due to a research error the loan could not move to closing. I couldn't have 2 FHA loans according to FBC, but this error was not caught during the pre-approval or Underwriting process. I had already paid my $5,000 escrow deposit and the closing agent was never notified by FBC of the error, so the closing agent received the closing docket and only when they reached out to my realtor was when they found out that the closing was not going to happen. To this date, FBC hasn't communicated with me any further, nor have they admitted to their mistakes in the process. I will lose my $5,000 deposit and the seller has fallen in default due to FBCs less than desirable practices. I demand my money reimbursed and they should be grateful that I am only asking for the deposit and not asking for a refund on the appraisal, which was an additional $500.00. I have the email strings to support my claim. Thank you.

Business Response /* (1000, 21, 2022/04/11) */ FBC Mortgage, LLC ("FBC") is in receipt of BBB # ******** from ******** ********. Ms. ******** had contacted FBC Mortgage, LLC for a FHA purchase mortgage loan. The loan originator and our underwriting team determined that Ms. ******** was collecting rent on another FHA loan in her possession. The borrower never revealed this other property during the pre-qualification stage or throughout the loan process. Therefore, the Borrower exceeded the FHA program guidelines on FHA financed properties and her application was denied. Consumer Response /* (3000, 23, 2022/04/12) */ (The consumer indicated he/she DID NOT accept the response from the business.) The lender was fully aware of the existence of the other home mortgage loan and knew of my intent to rent the property out. They decided to move forward with another FHA loan application in spite of this. I have all the email exchanges between me and FBC mortgage regarding this matter and they should retract their statement implying malice on my end or I will seek legal restitution. Business Response /* (4000, 25, 2022/04/13) */ FBC Mortgage, LLC stands by its response. There were no federal, state or regulatory guidelines that were violated per the review. The financial reimbursement requested by the Consumer is a contractual matter between the buyer and the seller. The Loan Originator on this file worked diligently in order to qualify Ms. ******** for the loan requested.

FBC/RMC has lied to us, my family and I, they made us believe that we will able to get a loan if we sold our house and paid off our car. Now almost a year later, when the house is almost ready and we had paid over $20,000 in hotels. They are delaying insidiously the process, blaming the government's FHA loan process! I reached out the FHA department myself and they stated that those questions that FBC/RMC are making are not required. We, my husband and I, also have noticed the change in the house market and strongly believe that FBC/RMC are hindering the process in order to resale the house for more money. Also they want to keep pulling our credit report until is useless and no one would want to do business with us. After all the gaslighting, the harassment, the abuse... We CANNOT change mortgage companies, in the contract that was signed back in 12/20/2020, bind us to buy the house with this lender or lose the house. We are being scammed, deceived, abused. Please help.

      Business response

      12/09/2021

Business Response /* (1000, 8, 2021/10/26) */ On October 15, 2021, our company received written instructions from Mrs. ***** to stop the loan transaction. Consumer Response /* (3000, 10, 2021/10/29) */ (The consumer indicated he/she DID NOT accept the response from the business.) They MUST remove ALL credit report inquiries from my husband and I. And refund the $560 dollars that they say they will refund but it has been 2 weeks and we have received nothing. As always, lies and deceit while causing chronic stress, mental agony and physical suffering. Obviously, they are going to hide in the "she ask us to stop, so "we" stopped"; when they DID NOT stop and kept sending obnoxious emails on the following Sunday evening!! We are not asking for the refund on hotel, bills that cost us about $25,000 (meals and storage unit fees included); the lack of stability, after harassing us into selling our home in North Carolina and paying off the car. For the times they pulled the credit, it was useless and painful, while killing our score!! REMOVE THE INQUIRIES!! GIVE US OUR MONEY BACK!! Business Response /* (1000, 23, 2021/11/22) */ On October 15, 2021, our company received written instructions from Mrs. ***** to stop the loan transaction. We refunded her the appraisal fee on 10/22 and the payment has been cashed by the consumer. We have ceased all communication with this Consumer. Consumer Response /* (3000, 25, 2021/11/22) */ (The consumer indicated he/she DID NOT accept the response from the business.) I would like to know when they removed the inquiries from the credit report. Although, RMC/FBC refunded the money, they don't specify when the credit report is clear from their inquiries. I believe that after all the hurt you (FBC/RMC) caused, it would be easy for this company to leave everything clear and clean. The credit report must be cleared. It was useless for us to applied with your company. You never meant to give us a loan! You have made us believe that we were going to get the house and the mortgage. You have lead us on. All we want now is a clear and clean credit report and be able to do business with some honest company, somewhere else. Clear the credit report! Ps/ WE had to request the stop to your ridiculous emails. FBC/RMC was still sending emails! So is not that the company stopped communicating, It's that US don't want any business with them! Clear the credit report!! Business Response /* (4000, 27, 2021/12/01) */ For a consumer to attempt to remove an inquiry the following must happen: 1. Consumer writes letter to RMC Home Mortgage, LLC disputing the inquiry. Letter from consumer must have their wet signature. 2. When RMC receives the letter from the Consumer, RMC will attach any supporting evidence and send to the credit reporting company. 3. When the credit reporting company receives the request, they will review and then submit to the bureau(s). The bureau(s) do not usually respond to RMC on whether or not our request was honored. Consumer Response /* (2000, 29, 2021/12/02) */ (The consumer indicated he/she ACCEPTED the response from the business.) We will try their suggestion. Even though, RMC doesn't give a time frame for this "pretend to fix the issue", we will follow the directions and let BBB the results. Lets see if RMC can remove the inquiry, the hard hit from the credit report.
